Partner Lauren Tabaksblat was quoted by Courthouse News Service in a hearing last week over MindGeek's motion to dismiss a group of sex trafficking lawsuits by women who were minors when sexually explicit videos of them were posted on pornographic websites owned by MindGeek without their knowledge or consent. Tabaksblat co-leads the Brown Rudnick team representing the women. During Friday's hearing in downtown Los Angeles, MindGeek argued that the plaintiffs' claims are barred by Section 230 of the Communications Decency Act, a federal statute that shields websites and social media platforms from liability over content posted by third party users. But Tabaksblat noted that MindGeek moderators actively edit the videos and add tags and that they collaborate with the posters to upload their content, which helps drive traffic to the child porn postings and generate advertising revenue for the website. U.S. District Judge Wesley Hsu noted that goes beyond providing neutral tools for users to upload their content as was the case in other lawsuits where defendants successfully argued they were protected by Section 230 from claims by trafficking victims. “I don’t know that I can ignore that,” Judge Hsu said. “Shouldn’t they at least have some discovery to find out if they’re wrong?” Read the full article here: https://lnkd.in/ea42rZsQ

The U.S. Patent and Trademark Office (USPTO) has rescinded the 2022 memorandum issued by then-Director Kathi Vidal, which had provided interim guidance on the Patent Trial and Appeal Board’s (PTAB) discretionary denial of post-grant proceedings in cases of parallel district court litigation. In a new BRiefing, Erick Robinson examines the rescission’s implications, the likely effects on PTAB practice, and the broader consequences for patent litigation strategy. “The Vidal memorandum was designed to bring clarity to the PTAB’s approach, ensuring that strong invalidity challenges could proceed while balancing judicial efficiency concerns,” Robinson wrote. “By removing this guidance, the USPTO is signaling a shift that could increase the frequency of discretionary denials and alter the calculus for both petitioners and patent owners engaged in parallel litigation.” Click image to read the full post.

A Chapter 11 plan developed by Brown Rudnick for Tehum Care Services, a nationwide provider of healthcare services to prisons and jails that filed for bankruptcy in 2023, was confirmed by U.S. Bankruptcy Judge Christopher Lopez earlier this week. This represents the first time that a debtor created pursuant to Texas’ divisional merger statute has confirmed a Chapter 11 plan.
