AGG Healthcare of counsel Alan C. Horowitz, Esq. was quoted in an article by McKnight's Long-Term Care News regarding a prolonged legal battle involving a Virginia nursing home fined $1.8 million for an alleged safety violation regarding coffee temperatures. The facility’s appeal has stretched nearly eight years and remains pending before the Department of Health and Human Services’ Appeals Board, which faces a backlog of cases dating back to 2014. Alan explains that these delays can discourage providers from appealing due to the time, expense, and likelihood of rulings favoring regulators.
