This website is owned and operated by Khosla Ventures, LLC (“Khosla Ventures”, the “Company”, “we”, or “us”). Khosla Ventures may collect personal information about you. We are a controller under the General Data Protection Regulation (“GDPR”) and we process Personal Information provided by you through your use of our websites. This Privacy Policy sets forth how we use and protect Personal Information collected about you, including through the Khosla Ventures website, https://www.khoslaventures.com and Khosla Ventures Talent Network, available at https://jobs.khoslaventures.com (collectively, the “Sites”), as well as during the normal operations of our company. 

1. What We Mean By Personal Information

For purposes of this Privacy Policy, “Personal Information” means any information from or about a person that either identifies that person directly or that makes that person identifiable when it is combined with other information from or about that person from any source.

We collect Personal Information that you voluntarily provide to us, such as through forms you choose to submit to contact us to obtain more information about Khosla Ventures or through your use of Khosla Ventures Talent Network. We may also collect Personal Information through the use of cookies on our website, and from third party providers, as detailed below and in our Cookie Policy.

Khosla Ventures also collects Personal Information about individuals in connection with due diligence we conduct when considering investment opportunities.  

We collect Personal Information from individuals associated with our portfolio companies in connection with events we host (e.g., CEO summits or Khosla Ventures workshops). Personal Information is collected from individuals in connection with their roles as Khosla Ventures partners or as affiliated with Khosla Ventures portfolio companies. 

In addition, in the ordinary operation of our business and as described below, we may collect Personal Information from portfolio companies regarding the shareholders of such companies, typically in the form of capitalization tables.

3. Notice of Information Collected About You

Categories of Information Collected in the Last 12 Months

We may collect the following categories of Personal Information: 

(A) Identifiers such as your real name, home address, business address, unique personal identifier, online identifier, email address, telephone number, account name, social security number, driver’s license number, employer identification number, passport number, date of birth, or other similar identifiers.

  • We collect this information in order to facilitate the operation of our website, to conduct our ongoing investment operations, consideration, and review, to refer for consideration candidates for employment to our portfolio companies, and to conduct due diligence and ongoing oversight with regard to prospective and our current portfolio companies. 
  • We may collect this information from you directly, from our portfolio companies, from talent search firms, directly from other public-facing or social networking platforms, or from third parties such as research and investigation services in connection with due diligence.  
  • We may share this information with our service providers, data analytics providers, government entities (where required by law), and commercial partners as necessary for the operation of our business.

(B) Characteristics of protected classifications under California or federal law, such as age, sex, race, national origin and citizenship status.

  • Our current and prospective portfolio companies may supply us with this information as part of our ongoing due diligence surrounding our investments or potential investments, for considering additional investments, and in connection the overall operation of our business operations. 
  • We may receive this information about you directly from you or from our portfolio companies. 
  • We may share this information with our service providers and others as we consider our investments, new opportunities and as part of our business operations.  

(C) Internet or other electronic network activity information, including information regarding a consumer’s interaction with an internet web site, application, or advertisement.

  • We collect internet activity information in order to facilitate the operation of our Sites.
  • We collect this information from you when you visit our sites.
  • We may share this information with the service providers associated with the operation of our Sites, including with Google Analytics. 

(D) Geolocation data.

  • We collect internet activity information in order to facilitate the operation of our Sites.
  • We collect this information from you when you visit our sites.
  • We may share this information with the service providers associated with the operation of our Sites.  

(E) Professional or employment-related information.

  • We collect this information in order to facilitate your possible employment with Khosla Ventures, or with one of our portfolio companies through Khosla Ventures Talent Network.
  • We may collect this information directly from you through your interaction with our “Contact Us” page, through your use of the Khosla Ventures Talent Network site, or from public-facing third party sources. 
  • We may share this information with our service providers or with our portfolio companies.

4. California Privacy Rights

California residents may have the right: 

  • to request disclosure of the categories and specific pieces of information collected about them;
  • to request the disclosure of the business purpose for collecting or selling Personal Information, the categories of third parties with whom it is shared, and the categories of sources from which Personal Information is collected;
  • to request the deletion of Personal Information collected, subject to the limitations set forth in California Civil Code Section 1798.105(d);
  • not to be discriminated against for exercising the rights guaranteed by California Civil Code Section 1798.100 et seq.

You may have the right to request that we disclose:

Requests to Delete

You may have the right to request that businesses delete Personal Information collected from and about you. If applicable, upon receiving a verified request to delete your Personal Information, we will do so unless otherwise authorized by law.

Verifiable Requests

We will acknowledge the receipt of requests to know or requests to delete your information free of charge, within 10 business days. You may submit requests via the mechanisms listed below under Methods for Submitting Consumer Requests. 

In order to protect your privacy and the security of your information, we verify consumer requests. We may ask you to provide certain Personal Information that we can match against the information in our possession to verify your identity. Any information we request to verify your identity will be used only for this purpose. 

We will respond to your request within 45 calendar days of receipt, after we have successfully verified your identity. We may request additional information from you in order to verify your request.  

No Sale of Personal Information

Khosla Ventures does not sell consumers’ Personal Information.

You have a right not to receive discriminatory treatment for the exercise of your California privacy rights.

Authorized Agents

You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent written permission to submit a request on your behalf, and we may require that you verify your identity directly with us. Alternatively, an authorized agent that has been provided with a power of attorney pursuant to Probate Code sections 4000-4465 may submit a request on your behalf.

5. Legal Basis for Our Processing of Your Personal Information

We rely on our legitimate business interests in maintaining business relationships and communicating about Khosla Ventures’ business. For Personal Information collected via cookies, we rely on affirmative consent. 

6. No Requirement to Submit Personal Information

You are not required to submit information to us through this website, however, if you visit our Site we may collect cookies after obtaining your consent. 

7. Sharing Your Personal Information

We will not share your Personal Information with third parties except in the context of those third parties acting as data processors/service providers and as otherwise described in this Privacy Policy. The categories of third parties with whom we may share your Personal Information are detailed in Section 3, Notice of Information Collected About You. For example, we may use a customer relationship manager software platform to organize our business contacts, and your Personal Information may reside on that software. Where relevant, we will ensure that contractual safeguards are implemented with these third-party data processors to ensure the protection of your Personal Information.

8. Retaining Your Personal Information?

Your Personal Information will be retained for as long as you are a business contact to us, or longer as required by applicable law. Your Personal Information may be deleted when it is no longer relevant or when you withdraw consent (see below), again within the parameters of applicable law. You may unsubscribe at any time from communications from us, and we will cease sending you further communications.

9. Your Rights With Respect to Your Personal Information

You have the right to know what Personal Information we process about you and have the right to obtain specific information about such Personal Information and to request a copy of your Personal Information, free of charge. You are also entitled to correct or supplement inaccurate Personal Information without delay, unless the request is excessive or unfounded. You have the right to request that your Personal Information be deleted if it is no longer necessary for the purposes it was originally collected or processed, subject to applicable law. You have the right to restrict processing of your Personal Information in some circumstances, subject to any legal obligations of Khosla Ventures. You have the right to receive your Personal Information in a machine-readable format and request a transfer of the Personal Information to another party responsible for data processing to the extent that the processing was carried out by automated means. You have the right to object to processing your Personal Information for marketing purposes and the right to opt out of such marketing. You also have the right to lodge a complaint with the relevant data protection authority.

10. Data Security for Personal Information

Khosla Ventures has implemented appropriate technical security measures to help protect your Personal Information against loss and to safeguard your Personal Information against access by unauthorized persons. We consider the protection of sensitive information to be a sound business practice, and to that end we employ physical, electronic and procedural safeguards to protect your Personal Information obtained through use on our Sites.

11. Procedures to Address a Breach of Your Personal Information

In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Information, we will notify the applicable supervisory authority in the European Union within 72 hours of discovering the breach, unless the breach is unlikely to result in a risk to the rights and freedoms of natural persons. We will also notify each affected subject of a breach without undue delay if the breach is likely to result in a high risk to the rights and freedoms of natural persons. We are not required to notify you of a breach if the breached data is encrypted, if we have taken measures, such as wiping the data remotely, and such breach is unlikely to result in a material adverse effect, or if providing notice requires disproportionate efforts, in which case a public communication should be made, rather than notice to each person.

This Privacy Policy was updated October 1, 2020.  We may amend this Privacy Policy from time to time to reflect changes in our practices with respect to the processing of Personal Information or changes in applicable law.
