Very large online platforms have been 'diligently' audited under the Digital Services Act (#DSA), a Commission official told MLex. This first round of audits was very intrusive and marked the transition to a regulated sector subject to third-party scrutiny. The Commission is still analyzing the reports, of which a redacted version will be published later this month. While the official noted no platform has a clean sheet, many are already self-correcting. The case serves as an important reminder, not only of the rights of individuals to personal data protection but also of the powers that the Commissioner for Personal Data Protection has to initiate investigations into a potential breach of data protection regulations. The Commissioner has the power to independently initiate investigations, even in the absence of a formal complaint. ⏰The EU AI Act was published in the Official Journal of the European Union 2 weeks ago and this is what the time line for implementation looks like: Entry into force across all EU Member States - August 1, 2024. Enforcement of most provisions - August 2, 2026. Ban on prohibited risk AI systems ❌ - February 2, 2026. Obligations relating to general purpose AI systems - August 2, 2025 (NOTE: Additional two-year grace period 🙏🏼for AI systems already on the EU market at that time: compliance required by August 2, 2027). Obligations relating to high-risk systems - August 2, 2026 (NOTE: Additional 2 year grace period 🙏🏼 for AI systems which are part of a product subject to EU health and safety laws: compliance required by August 2, 2027). (ALSO NOTE: obligations relating to high-risk AI systems will NOT apply for most high-risk AI systems already on EU market or in service in EU before August 2, 2026 unless their design and scope has significantly changed since then). Non-compliance liability: Fines of up to €35 million or 7 percent of total worldwide annual turnover, whichever is higher 🤑😬.

💡 The ICO (UK's data protection authority) prioritized technologies that will create new challenges to the legal framework for personal data processing: https://lnkd.in/echgQRHf. 🆕 The challenges to data privacy can render new gray areas in regulation and require new insights from both regulators and data privacy pros: 🔸 Collecting and processing new types of personal data, including those of special categories. 🔸 The collection and processing of vast amounts of personal data. 🔸 Rapid technological development, which creates a permanent lag between regulation and industry practice. 🔸 Large number of parties involved in personal data processing, which makes it tricky to correctly assign roles (controllers, joint controllers, processors, sub-processors, etc.). 🔸 Misuse of technology requires additional protection for vulnerable groups. These are excellent examples for additional analysis of data processing in any technology: there's always a need to consider what will happen to personal data processing if the technology scales and evolves. 🚨🚨 Major development in France as PM Michel Barnier's government introduces an amendment to regulate online casino. If passed, the country could have regulated and licensed online casino operators by the middle of 2025. Importantly, the format that has been put forward would provide an open market, rather than the 3-year exclusive period that had been called for by the Casinos de France trade body representing the country's 200 land-based resorts. This would mean French operators like Betclic Group, WINAMAX or FDJ - La Française des Jeux-Kindred Group plc being able to operate in a regulated French market from day one. The news has been strongly criticised by CdF, with its president Grégory RABUEL telling Les Echos the move was “a totally ill-considered decision" that was “tantamount to signing the death warrant for land-based casinos.” Read the full story on SBC News 👇👇👇

Are we locking people out of essential services with outdated verification methods? “If agencies make verification too hard relative to the risk of the transaction,” argues Michael Mandel of the Progressive Policy Institute, “then it becomes more difficult for constituents to prove their identity, unnecessarily locking them out of services and data that they are entitled to.” Biometric verification is key to making vital services accessible to everyone. Not everyone has the documents they need to prove who they are. So biometric verification must not be conflated with biometrics for law-enforcement and surveillance, says Mandel. Matching a selfie to a photo ID is easier than ever. It’s not nearly the same as looking for one face in a database of millions. It’s time to close what Mandel calls the digital verification divide. Biometric verification like Vouchsafe’s is an essential way to get there.
