Insolvency Litigation   Judgement Alert: Manolete Partners Plc v Bell [2024] EWHC 1636 (Ch)   The High Court granted the claimant company's Part 7 claim against the fourth defendant director (B) and an application under section 238 of the Insolvency Act 1986 (the IA Application). B was a director of BSS, a company that had entered into creditors' voluntary liquidation due to insolvency. The claimant had acquired the causes of action from BSS's liquidator. The claim alleged that B breached his duties as a director to act in the best interests of BSS's creditors. The court found that BSS had sold certain equipment to the company at an undervalue while insolvent, violating B's duty to the creditors. B was held liable to compensate for the loss from the undervalued sale. Additionally, other transactions cited by the claimant were also found to breach B's duty to the creditors, making B liable to pay full compensation for those payments. Review petition dismissed regarding the fraudulent I.T.C. claim as new evidence presented could have been submitted earlier.: The High Court dismissed a review petition regarding a fraudulent Input Tax Credit (I.T.C.) claim for inward supplies. The petitioner had obtained I.T.C. based on invoices from non-existent firms. Special Investigation Branch found the firms to be bogus with no actual supply of goods. Appellate authority's decision was upheld as it considered the evidence on record. The review petition was rejected as new evidence presented could have been submitted earlier and did not refute the findings. The court found no reason to review the earlier order and dismissed the petition.
