This is a useful summary of the new Practice Direction 19B which came into force on 1 April 2024. It's interesting to note that, for remuneration periods ending on or after 1 April 2024, Professional Deputies are no longer restricted to taking interim payments quarterly. They may now take proportionate and reasonable payments whenever they wish, provided that the total payments taken do not exceed 75% of the work in progress, or 75% of the estimate provided to the Office of the Public Guardian (OPG), whichever is the lower. Another important reason to keep an eye on your work in progress and to update the OPG if your costs are going to exceed the figure provided previously!

The deadline for responses in respect of the consultation on the application of zero-hours contracts measures to agency workers is 23:59 2nd December. The proposed changes to zero-hours contracts could severely impact the flexibility and sustainability of the temporary labour market if left unamended. Without collective action, proposed legislative risks include increased costs, operational complexities, and disruptions to the entire supply chain. The volume of responses is what matters to Government. We are therefore urging all agencies and clients to respond in order to have your voice heard and to shape the forthcoming legislation. Within that there is a link to respond, or you can submit your responses to [email protected] Why does responding matter? ▪️ Guaranteed hours after 12 weeks: This provision creates financial risk, particularly in the event demand decreases and those guaranteed hours are no longer necessary. ▪️ Permanent contracts after 12 weeks: The suggestion that clients should offer a permanent contract to agency workers unless inherently temporary causes legal uncertainty, erodes the flexibility of the contingent workforce, and increases costs and financial risk for agencies and clients. ▪️ Reasonable notice of shifts and curtailment/cancellation fees: This poses a significant costs burden for clients and agencies alike. ▪️ Administrative and legal complexity: Managing these new rules would increase operational burdens and when things break down, the risk of litigation. 🚨 New Code of Practice on 'Fire and Rehire' Now in Force – But for How Long? 🚨 As of July 18th, a new statutory Code of Practice on Dismissal and Re-engagement is in place. Introduced by the previous Conservative government, this Code sets out how employers should approach the controversial 'fire and rehire' tactics, but its days might be numbered. With the new Labour government promising to ban 'fire and rehire' altogether, this Code could be short-lived. 🕒 Here's what employers need to know: 🔹 Last Resort: Dismissal and re-engagement should only be used as a final option. 🔹 Meaningful Consultation: Engage with employees, consider their feedback, and explore alternatives. 🔹 ACAS Involvement: Contact ACAS early in the process. While it may not be around for long, the Code is in effect now, and employment tribunals will consider it in relevant cases. Employers, don’t get caught out!
