Lawtech will drive legal innovation Lawtech, the use of technology in the legal sector, is gaining momentum in the UK. With the acceleration of generative AI, legal tech companies are revolutionising the profession. In the past six months, there has been a surge in legal tech M&A activity, indicating the growing interest in this field. Big Tech giants like Microsoft and Google are investing in legal tech companies, while the UK's top law firms are embracing legal tech and running accelerator programmes such as Slaughter and May's Collaborate and A&O Shearman's Fuse. They are also investing in chatbots for their work. It has been suggested that as more work gets automated, the billable hours system may become obsolete. Government numbers show that of the 356 legal tech companies operating in Britain, 254 are UK-founded and they have secured investment of more than £1.38bn. UK GDPR / GDPR allows for the use of 'legal obligation' as a lawful basis for processing. Just for clarity: this relates to an obligation the organisation has under legislation, e.g. the requirement to conduct Right to Work checks for new employees. It doesn't apply to obligations which arise to fulfill the terms of a commercial contract. Those might well be 'legal obligations' in the plain English sense, but not what is meant by the term in UK GDPR. 'Performance of a contract' (if the contract is with the individual personally) or 'legitimate interest' (where it's with their organisation) would be the right bases to use instead. The right question to ask if an organisation claims 'legal obligation' for processing is "what legislation mandates this?".

It is nearly 6 years since the General Data Protection Regulation (GDPR) was introduced on 25 May 2018. In that time, we have seen a number of trends emerging on where the UK’s privacy regulator, the Information Commissioner’s Office (ICO), has focused its enforcement attention, and how it has delivered its enforcement actions. At URM’s webinar on 22 May at 11am, we will be examining those trends, whilst also assessing the significance of the new ICO schedule of fines, and updated guidance on monitoring employees at work. We will also be providing our thoughts on the increasing prevalence of artificial intelligence (AI) technology, and the upcoming Data Protection and Digital Information (DPDI) Bill and how they may shape and impact data protection compliance in 2024. The webinar will conclude with URM sharing its experiences on common areas of noncompliance and how you can embed good practice data protection into business-as-usual activities and meet the GDPR Accountability principle.
