*Treatment of Trusts on Divorce: Analysis of HO v TL [2023]*   HO v TL: Lessons for Trusts Cases, an article by FLiP Senior Associate Grace Lawrence who is a member of the Society of Trust and Estate Practitioners, was first published in HNW Divorce ‘Entrusting the Future to the Next Generation’ magazine (ThoughtLeaders4 HNW Divorce • JUNE 2024) and is reproduced via the link below, by kind permission. Financial remedy practitioners in the HNW/UHNW space will often be instructed in cases where either their client or their client’s spouse has substantial trust interests. In such cases, there is an obvious tension between traditional trust concepts (including the trustees’ duties to act in the interests of the beneficiaries as a whole and to safeguard trust assets) and the desire of the English court to achieve a fair outcome as between the divorcing couple. HO v TL [2023] EWFC 215 is one such case. Amongst other issues, Mr Justice Peel had to grapple with the extent to which the Husband’s interests in two family discretionary trusts were accessible and therefore “financial resources” available to him. One of my and my colleagues', Gretchen Scott, Glynn Barwick, James Taylor and Matt Dixon-Ward, favourite subjects - AI and financial services regulation - and our thoughts on a recent speech from the Bank of England. Our view is and remains that, while it is still unclear that AI will introduce new risks in the world of finance, it will amplify existing risks: regulators will expect financial institutions looking to use (and technology firms looking to provide) AI solutions to take this amplifying effect into account in managing risk in their businesses. The BoE speech doesn't challenge this view BUT it does point to, if question the current orthodoxy on "technology-agnostic" financial regulation. Financial regulators would prefer to regulate finance and not regulate technology. Does AI, however, offer a special challenge that makes it increasingly difficult to separate finance and technology and the regulation of the one separately from the other? Even if the speech does not ask this expressly, it does at least cause one to ponder the question... This is something that we will pick up during our webinar scheduled for next Wednesday, November the 13th which will also include discussion of EU matters with our colleague. Celine Moille.

There were no great tax surprises in the Autumn Budget - most of the changes had been flagged in advance. What was interesting was the way in which the main tax rises were slightly lower than had been expected. Employers' NICs increasing by 1.2% (as against 2%), tax on fund manager carried interests falling half way between capital gains and income tax rates (as against all the way), capital gains tax rates increasing (but not as much as expected), the tax effects of the withdrawal of "non-dom" status being slightly softener on moving to the UK (compared to the original proposals). The approach seems to have been to threaten doom, gloom and catastrophe in the hope that, when merely doom and gloom materialise people will be left feeling happy that things weren't quite as bad as expected. Partner Anna Shadbolt, instructing Fiona Stewart of Queen Elizabeth Building, recently acted for the respondent in JL v NN [2024] EWHC 1489 (Fam), on a pro bono basis, as did counsel.
