𝙆𝙚𝙮 𝙏𝙖𝙠𝙚𝙖𝙬𝙖𝙮𝙨 𝙄𝙣𝙘𝙡𝙪𝙙𝙚: ✅ technology and AI provide a huge opportunity to speed up access to justice and resolve disputes quickly for parties ✅ case mangement platforms and tech tools can (and should) enable privacy and cybersecurity by design to safeguard the confidentiality of documents and parties ✅ to facilitate the adoption of technology by institutions and solo neutrals, the tools need to be reliable, cost effective, and secure ✅ institutions play a vital role in safeguarding the legitimacy and reliability of the private dispute resolution process with a good set of rules and high quality panel list ✅ independence and impartiality of neutrals AND instutions themselves are both vital to the dispute resolution process ✅ no appointments yet? No problem. High quality training and qualifications, like Chartered Institute of Arbitrators (CIArb) Fellowship, can also be good indicators of neutral's ability to resolve disputes and be added to panel lists ✅ collaboration is KEY and institutional cooperation and infomation sharing is essential to build and maintain trust in the global ADR ecosystem ✅ 𝖺̶𝗅̶𝗍̶𝖾̶𝗋̶𝗇̶𝖺̶𝗍̶𝗂̶𝗏̶𝖾̶ dispute resolution is a thing of the past. 𝐂𝐑𝐂𝐈𝐂𝐀 𝐚𝐭 the 5th World Conference on International Arbitration in Doha Qatar International Center for Conciliation and Arbitration On Tuesday, 19 November 2024, the Cairo Regional Centre for International Commercial Arbitration (CRCICA) participated in the 5th World Conference on International Arbitration, held under the patronage of H.E. Sheikh Mohammed bin Abdulrahman Al Thani, Prime Minister and Minister of Foreign Affairs. Focused on the theme “Arbitration in the MENA Region – Present and Future,” the event took place on 19- 20 November 2024 at the prestigious Waldorf Astoria Lusail Hotel in Doha, Qatar. Representing CRCICA, Dr. Ismail Selim, the Centre’s Director and President of The International Federation of Commercial Arbitration Institutions (IFCAI), joined a distinguished panel alongside esteemed arbitration experts, including Prof. Dr. Nayla Comair-Obeid (Lebanese University, ICCA International Council for Commercial Arbitration), Ms. Catherine Dixon (Chartered Institute of Arbitrators (CIArb), Ms. Judith Knepper (UNCITRAL: United Nations Commission on International Trade Law), and Dr. Hamed Merah (SCCA Saudi Center for Commercial Arbitration). Moderated by Mr. Sultan Al-Abdullah, Managing Partner of Sultan Al-Abdulla & Partners, the session spanned 90 minutes and featured impactful presentations and dynamic discussions on the evolving arbitration landscape in the MENA region. In his presentation, Dr. Selim highlighted CRCICA’s rich legacy and pioneering role in shaping arbitration practices in the region. He introduced the Centre’s newly launched 2024 Arbitration Rules, which incorporate transformative advancements such as Provisions for expedited proceedings and emergency arbitrators, as well as Integration of technology, enabling online filings and hybrid hearings. Dr. Selim also emphasized CRCICA’s growing diversity in caseloads, its reputation for delivering cost-effective, high-quality services, and its steadfast commitment to aligning with global arbitration standards. He underlined the Centre’s neutrality and its trusted handling of complex disputes, including those involving public entities and international organizations, supported by endorsements from leading arbitration authorities. His insightful contribution reaffirmed CRCICA’s pivotal role as a trailblazer in arbitration practices, both regionally and globally, further solidifying its reputation as a leading institution in the MENA arbitration landscape. In a historic and groundbreaking moment for diversity and representation, the Freshfields Arbitration Lecture, after 39 years, welcomed its first lecturer from Africa - marking a significant milestone for the global arbitration community. The lecture was delivered by none other than Prof. Dr. Mohamed Abdel Wahab C.Arb, FCIArb, a Global Elite Thought Leader and the esteemed Dean of the Africa Arbitration Academy. Prof. Abdel Wahab presented an exceptional and thought-provoking discussion on the iura novit arbiter principle, blending deep legal scholarship with innovative proposals. His lecture revolved around a proposed Six-Point Protocol to address the challenges surrounding the principle and to harmonize its application in arbitration proceedings. Tracing the roots of iura novit arbiter to Aristotle’s principle of iura novit curia - "the court knows the law" - Prof. Abdel Wahab highlighted its evolution into a framework allowing arbitrators, subject to governing laws, to apply legal provisions they find relevant, even if not pleaded by the parties. He delved into the complexities and cultural divergences that arise from applying the principle, particularly the varying approaches between common law and civil law arbitrators. Prof. Abdel Wahab emphasized that arbitrators operate within “three Ds”: duties, discretion, and delimitations. His Six-Point Protocol, to be included in Procedural Order No. 1, aims to foster fairness, legitimacy, and consistency in arbitral proceedings, addressing the principle’s challenges while minimizing enforcement risks. This visionary proposal promises to strengthen confidence in arbitration, ensuring a fair treatment for all parties and reducing the risk of arbitral awards being challenged or unenforced. It is hoped that the “Abdel Wahab Protocol” will become as integral to arbitration as the ubiquitous Redfern Schedule!
