High Court awards Ken Bates £150,000 in libel damages against Tom Rubython and Business F1 magazine Ken Bates, the former owner and Chairman of Chelsea Football Club, has today been awarded £150,000 in damages by the High Court in London in respect of a May 2023 article published by Tom Rubython and Business F1 magazine. The article made extremely serious, yet entirely false, allegations against Mr Bates, including the absurd suggestion that he had almost certainly had business rivals murdered. The Judge described the article as a ‘comprehensive character assassination’ of Mr Bates. The allegations were not put to Mr Bates in advance of publication and the Defendants did not seek to defend the allegations as being in any way true or rely on any other substantive defence. The Defendants attempted to argue that the allegations had not caused serious harm to Mr Bates’ reputation – an argument that the Judge wholly dismissed. As well as awarding very substantial damages, the Judge granted an injunction against the repetition of the libels. The Judge also ordered the Defendants to publish a summary of the judgment in their magazine, and pay Mr Bates’ legal costs. Mr Bates said ‘I am very pleased with the decision of the court today. This is an article that should never have been published, and the judgment makes that clear’. Carter-Ruck client Vladimir Plahotniuc wins sanctions challenge in European Court of Justice Moldovan politician and businessman Vladimir Gheorghe Plahotniuc has been successful in challenging the 2023 restrictive measures imposed upon him by the EU Council. The General Court of the European Union held on 23 October 2024 that the Council of the European Union, in making its decision to impose restrictive measures upon our client in 2023, had failed to verify that the domestic proceedings underlying the designation had been conducted in accordance with his rights of defence and right to effective judicial protection. In making its decision to annul the 2023 restrictive measures, the General Court relied upon principles of EU sanctions law which had been developed in the EU litigation brought by this firm on behalf of the late ex-President of Egypt Hosni Mubarak and members of his family (Saleh Thabet and Others v Council (C-72/19 P and C-145/19 P, not published, EU:C:2020:992). High Court dismisses statutory reporting defence advanced by OCCRP in a libel claim brought by Dr Ashti Hawrami Antonia Foster and Caitlin Harris of Carter-Ruck, and Adrienne Page KC and Tom Blackburn of 5RB representing Dr Ashti Hawrami, formerly the Minister of Natural Resources and later, the Assistant Prime Minister for Energy Affairs in the Kurdistan Regional Government in his #libel claim. The claim relates to an article published online by Journalism Development Network Inc (through their website OCCRP) and two of its journalists. The article contains several references to Dr Hawrami which have led to his bringing proceedings against the Defendants in libel. The Defendants denied that the article was defamatory of Dr Hawrami. They also submitted that the article was a fair and accurate report of the judgment and proceedings in a separate legal case (to which Dr Hawrami was not a party) and that parts of the article should be protected by a qualified privilege pursuant to s.15 of the Defamation Act 1996. In her judgment dated 23 August 2024, Mrs Justice Steyn held that the article was defamatory of Dr Hawrami at common law. She also found that the article did not constitute a fair and accurate report of the other legal proceedings and that the Defendants’ defence of statutory qualified privilege failed. The Judge found that the OCCRP Article is a ‘critically different text’ from the material contained in that judgment, such that the ‘quality of fairness required for reporting privilege has been entirely lost’. https://lnkd.in/ehT3u8gF
