🆕 𝐋𝐞𝐠𝐚𝐥 𝐮𝐩𝐝𝐚𝐭𝐞 Sudden and Major Change in #Hungary’s Renewable Energy Policy 🚨 In an unexpected move, on 31 January, the Hungarian Government abolished the inflation-adjustment of mandatory energy off-take prices (#KÁT) overnight, impacting around 3,100 MW of industrial solar capacity. The regulation, published at 10 PM and enforced by 11 PM the same night, means solar plant owners will face lower revenue growth potential, while industrial energy consumers may benefit from reduced electricity costs. The government justified such urgent amendment under the highly controversial state of emergency linked to the war in #Ukraine, a legal framework that has been in place since 2020 and is set to remain until at least May 2025. 💡The full effects of this sudden regulatory shift will unfold in the coming years, but uncertainty remains about whether solar producers opting for the free market will be subject to the Robin Hood tax, a windfall tax currently imposed on energy producers. ❓Key questions also persist: Will this decision stabilize energy prices and ease industrial costs, or will it slow down Hungary’s renewable energy transition and lead to legal challenges from foreign investors regarding the altered regulatory framework? 🆕 𝐋𝐞𝐠𝐚𝐥 𝐮𝐩𝐝𝐚𝐭𝐞 The Expanding Reach of EU Judicial Oversight: Is #CAS Arbitration Next? ⚽ “For good or bad, few passions are as widely and as profoundly shared around the globe as the passion for sport.” With these words, Advocate General (AG) Tamara Capeta of the Court of Justice of the European Union (CJEU) sets the stage for her Opinion in Case C-600/23, Royal Football Club RFC Seraing v. FIFA, UEFA et al. At the heart of the case lies a pivotal question: Can the CJEU challenge the long-standing autonomy of the Court of Arbitration for Sport (CAS)? The AG’s Opinion suggests yes. She concluded that EU national courts should not be bound by the res judicata effect of CAS awards when EU law is at stake.
