Bird & Bird advises Polestar Capital on the debt financing for Xycle for the construction of a 𝐜𝐨𝐦𝐦𝐞𝐫𝐜𝐢𝐚𝐥-𝐬𝐜𝐚𝐥𝐞 𝐩𝐥𝐚𝐬𝐭𝐢𝐜𝐬 𝐫𝐞𝐜𝐲𝐜𝐥𝐢𝐧𝐠 𝐩𝐥𝐚𝐧𝐭 The Polestar Capital Circular Debt Fund (PCDF) finances the first commercial scale production facility of Xycle, an innovative chemical recycling company that produces pyrolysis oil from otherwise not recycled waste plastics. Xycle is a venture of Dow, Vopak, NoWIT, Teknow, ING Sustainable Investments, and Invest-NL. With the funding raised, Xycle will construct a demonstration facility in the harbour of Rotterdam, consisting of a proven pre-treatment installation, followed by several pyrolysis lines that can process 21 kiloton of mixed plastic waste per annum. In addition, recycling of plastic waste has a significant positive effect on the reduction of CO2 emissions. The finance project was led by Roger van Buuren and the deal team included Paul Waszink, Andrea Chao, Daniel Polderman, Remco D., Sander Wagemakers and Jephta Zantinge. Bird & Bird played an important role in a recent landmark decision by The Hague District Court, which ruled that the Dutch part of the European patent for Biogen's MS drug Tecfidera was invalid. Dutch newspapers NRC and Het Financieele Dagblad have already published articles on the outcome and the importance of this case. A fantastic victory for our client Neuraxpharm, assisted by Marc Van Wijngaarden, Sabrina Lodder and Emma Stok. Het wetsvoorstel voor de implementatie van de EU-richtlijn CSRD is ingediend bij de Tweede Kamer, zes maanden na de implementatiedeadline. Het voorstel wijzigt diverse wetten en legt de basis voor verplichte duurzaamheidsrapportages door beursgenoteerde en grote bedrijven. Daarnaast biedt het duidelijkheid voor accountants over hun rol in de controle van ESG-rapportages.
