𝐋𝐚𝐧𝐝𝐦𝐚𝐫𝐤 𝐃𝐞𝐜𝐢𝐬𝐢𝐨𝐧 – 𝐀𝐮𝐬𝐭𝐫𝐢𝐚𝐧 𝐣𝐮𝐝𝐠𝐞𝐦𝐞𝐧𝐭𝐬 𝐚𝐰𝐚𝐫𝐝𝐢𝐧𝐠 𝐫𝐞𝐟𝐮𝐧𝐝𝐬 𝐨𝐟 𝐠𝐚𝐦𝐛𝐥𝐢𝐧𝐠 𝐥𝐨𝐬𝐬𝐞𝐬 𝐧𝐨𝐭 𝐞𝐧𝐟𝐨𝐫𝐜𝐞𝐚𝐛𝐥𝐞 𝐢𝐧 𝐌𝐚𝐥𝐭𝐚 Earlier today, the Maltese Superior Court issued a landmark decision by refusing to enforce two Austrian judgments which awarded a refund of gambling losses to Austrians playing on Malta-licenced gaming websites. The argument made by the operators was that the GSpG's violation of Article 56 TFEU, a cornerstone of EU law, also represented a clear breach of Maltese public policy. The freedom to provide services, protected under EU law, is a crucial aspect of Maltese law, therefore, breaching Article 56 TFEU was "inconsistent to an unacceptable degree with the EU legal order" resulting in Maltese public policy being likewise infringed. The Maltese Court deemed that the enforcement of these judgements was manifestly contrary the public policy (ordre public) of Malta. Davinia Cutajar and Jonathan Muscat represented MGA licenced operators in repelling the enforcement of these judgements. In the Casino de Spa SA case, the European Court of Justice (“ECJ”) analysed the principle of fiscal neutrality in light of Belgium's differential tax treatment of various types of gambling, including online vs offline gambling and online lotteries vs other forms of online gambling. The distinctions were considered significant enough to justify different VAT treatments.
