We are happy to announce the establishment of a new coalition the purpose of which is to assist everyone who is truly committed to comply with anti-crime and anti-sanctions evasion regulations as well as prevent the penetration of such vice into the cyber-space. Baltic Compliance Association of Latvia has recently signed a memorandum of cooperation with the Ukrainian Modern Digital Science organisation. As the heads of both organizations have stressed in their respective accolades - the evolving landscape of technology and the digital economy presents us with new compliance challenges therefore collaboration is very important to help us navigate the digital space effectively. In this regard the expertise of the Ukrainian Modern Digital Science organization can be a game changer in our endeavours. Both organizations are committed to helping make the digital world less attractive for criminals, terrorist states and international sanctions evaders, particularly, taking into account the fact that the traditional prevention methods have proved to be somewhat unsuccessful since the flow of goods, vital for the functioning of terrorist states, has not been seriously hampered let alone stopped.  Our tools are cooperation, cyber-space expertise, training and awareness raising actions. We are confident that the new coalition will be a cornerstone in the fabric of our common anti-crime and anti-sanctions evasion effort which will be joined by other partners who understand that much more needs to be done to keep us safe from crime and sanctions evasion as well as preserve our democratic values.

Do VASPs need to be independently assessed? Since VASPs are now regulated under the European crypto-assets regulation (MiCA) they must establish a comprehensive and proportionate technology governance and risk assessment framework taking into account the nature, operations and complexity of the business. Moreover, the framework must cover all the relevant technologies and activities as well as clearly state the VASP’s cybersecurity objectives, including requirements for staff, end users, clients. What would an assessment of VASP include? In view of the new regulations an independent VASP audit must be carried out to assess each VASPs compliance with the regulators’ expectations. Such and audit covers the assessment of technology governance which should align with international standards and industry best practices to determine the necessary processes and controls for mitigating the identified risks. Šajā sankciju auditora piezīmju epizodē aplūkosim to, kā un kā ir iespējams mērīt procesu efektivitāti, lai noskaidrotu, vai tas, ko mēs darām, ļauj sasniegt uzņēmuma mērķus (outcome). Jā, jūs nekļūdījāties – arī sankciju kontroli un citas jomas var mērīt tieši tāpat kā visu pārējo biznesa procesu efektivitāti, lai ar maksimāli maziem resursiem sasniegtu maksimālu rezultātu. Veicot auditu, reizēm pamanām, ka ieviestie procesi ir “smagnēji” un rezultāts tiek sasniegts ar nesamērīgu resursu patēriņu. Šajā epizodē paplašināsim darbības lauku un pieskarsimies arī “naudas atmazgāšanas” novēršanas procesiem, kuros nereti tiek integrēta arī sankciju pārbaude. (!) Ļoti svarīgi ir atcerēties vienu atziņu. Automatizācija ne vienmēr ir panaceja vai visu problēmu risinājums.
