‫‪ ٥-٢‬ﻋﻼﻗﺔ ﺍﻷﺧﻼﻕ ﺑﺎﻟﺩﻳﻥ‪:‬‬
‫ﺗﺧﺗﻠﻑ ﻧﻅﺭﺓ ﺍﻷﻣﻡ ﺇﻟﻰ ﻋﻼﻗﺔ ﺍﻷﺧﻼﻕ ﺑﺎﻟﺩﻳﻥ ﺑﺎﺧﺗﻼﻑ ﻧﻅﺭﺗﻬﺎ‬
‫ﺇﻟﻰ ﺍﻟﺩﻳﻥ ﻧﻔﺳﻪ ﻭ ﺗﻌﺭﻳﻔﻬﺎ ﻟﻪ‪:‬‬
‫• ﻓﻲ ﺃﻭﺭﻭﺑﺎ‪ :‬ﺗﻌﺭﻳﻑ ﺍﻟﻣﻭﺳﻭﻋﺔ ﺍﻟﻔﺭﻧﺳﻳﺔ ﺍﻟﻛﺑﺭﻯ ﻟﻠﻌﻠﻭﻡ ﻭ‬
‫ﺍﻵﺩﺍﺏ ﻭ ﺍﻟﺻﻧﺎﻋﺎﺕ‪:‬‬
‫‪ .١‬ﺟﻭﺑﻠﻳﻪ ﺩﺍﻟﻔﻳﻼ )‪:(Goblet d’alviela‬‬
‫ﺍﻟﺩﻳﻥ ﻫﻭ ﺍﻟﻁﺭﻳﻘﺔ ﺍﻟﺗﻲ ﻳﺣﻘﻖ ﺑﻬﺎ ﺍﻹﻧﺳﺎﻥ ِﺻﻼﺗﻪ ﻣﻊ ﻗﻭﻯ ﺍﻟﻐﻳﺏ ﺍﻟﻌﻠﻭﻳﺔ‬
‫ﻟﺫﻟﻙ ﺍﻷﻣﻡ ﺍﻟﻌﻠﻣﺎﻧﻳﺔ ﺗﻧﻅﺭ ﺇﻟﻰ ﺍﻷﺧﻼﻕ ﺇﻟﻰ ﺃﻧﻬﺎ ﻣﺟﻣﻭﻋﺔ ﻣﻥ‬
‫ﺍﻟﻘﻳﻡ ﺍﻟﻣﺩﻧﻳﺔ )ﺍﻟﻣﺟﺗﻣﻌﻳﺔ( ﺗﻭﺻﻠﺕ ﺇﻟﻳﻬﺎ ﺍﻟﺑﺷﺭﻳﺔ ﻟﺗﺣﻛﻡ ﻋﻼﻗﺎﺗﻬﺎ‬
‫ﺍﻟﺩﺍﺧﻠﻳﺔ ﻓﻲ ﺇﻁﺎﺭ ﻣﻥ ﺍﻟﻣﺻﻠﺣﺔ ﺍﻟﻣﺣﺿﺔ‪ ،‬ﺑﺎﻋﺗﺑﺎﺭ ﻗﻭﺍﻋﺩ ﺍﻟﺳﻠﻭﻙ‬
‫ﻭﺍﻷﺧﻼﻕ ﻫﻲ ﺍﻟﺿﺎﻣﻥ ﻟﺗﻣﺎﺳﻙ ﺍﻟﻣﺟﺗﻣﻊ ﻭﺍﻟﻌﺎﺻﻡ ﻟﻪ ﻣﻥ ﺍﻹﻧﻬﻳﺎﺭ‪،‬‬
‫)ﻭﻫﻲ ﻛﺫﻟﻙ ﺑﺩﻭﻥ ﺷﻙ(‪.‬‬
‫• ﻓﻲ ﺍﻟﺷﺭﻕ‪:‬‬
‫ﺍﻟﺩﻛﺗﻭﺭ ﻣﺣﻣﺩ ﻋﺑﺩ ﷲ ﺩﺭﺍﺯ‪:‬‬
‫ﺍﻟﺩﻳﻥ ﻫﻭ ﻭﺿﻊ ﺇﻟﻬﻲ ﻳﺭﺷﺩ ﺇﻟﻰ ﺍﻟﺣﻖ ﻓﻲ ﺍﻻﻋﺗﻘﺎﺩ ﻭ ﺇﻟﻰ ﺍﻟﺧﻳﺭ ﻓﻲ‬
‫ﺍﻟﺳﻠﻭﻙ ﻭ ﺍﻟﻣﻌﺎﻣﻼﺕ‪.‬‬
‫ﺷﻌَ ْﺏ ﺍﻹﻳﻣﺎﻥ‬
‫ﻟﺫﻟﻙ ﺍﻷﻣﻡ ﺍﻟﻣﺗﺩﻳﻧﺔ ﺗﻧﻅﺭ ﺇﻟﻰ ﺍﻷﺧﻼﻕ ﺑﺎﻋﺗﺑﺎﺭﻫﺎ ﻣﻥ ُ‬
‫ﺣﻳﺙ ﺗﻧﻅﺭ ﺇﻟﻰ ﺍﻟﺩﻳﻥ ﺃﻧﻪ ﻋﻘﺎﺋﺩ ﻭ ﻋﺑﺎﺩﺍﺕ ﻭ ﻣﻌﺎﻣﻼﺕ‪ .‬ﻟﺫﻟﻙ ﺗﺗﻣﻳﺯ‬
‫ﺍﻷﺧﻼﻕ ﺍﻟﺩﻳﻧﻳﺔ ﺃﻧﻬﺎ ﺇﻳﺟﺎﺑﻳﺔ ﻭ ﺗﺟﻣﻊ ﺑﻳﻥ ﺍﻹﻟﺯﺍﻡ ﻛﺿﺎﺑﻁ ﻭ ﺍﻻﻟﺗﺯﺍﻡ‬
‫ﻛﺣﺭﻳﺔ‪.‬‬
‫‪ ٦-٢‬ﻣﺻﺎﺩﺭ ﺍﻹﻟﺯﺍﻡ ﺍﻟ ُﺧﻠُﻘﻲ ﻭﺧﺻﺎﺋﺻﻪ‪:‬‬

‫‪ ٧-٢‬ﺍﻟﻣﺳﺋﻭﻟﻳﺔ ﻭﺍﻟﺟﺯﺍء‪:‬‬
‫ﺍﻟﻣﺳﺋﻭﻟﻳﺔ‪ :‬ﻫﻲ ﺗﺣﻣﻝ ﺍﻟﺷﺧﺹ ﻧﺗﻳﺟﺔ ﺍﻟﺗﺯﺍﻣﺎﺗﻪ ﻭﻗﺭﺍﺭﺍﺗﻪ‬
‫ﻭﺍﺧﺗﻳﺎﺭﺍﺗﻪ‪ ،‬ﺳﻭﺍ ًء ﺍﻹﻳﺟﺎﺑﻳﺔ ﺃﻭ ﺍﻟﺳﻠﺑﻳﺔ‪ ،‬ﺃﻣﺎﻡ ﷲ ﻓﻲ ﺍﻟﻣﻘﺎﻡ‬
‫ﺍﻷﻭﻝ‪ ،‬ﺛﻡ ﺃﻣﺎﻡ ﺿﻣﻳﺭﻩ‪ ،‬ﺛﻡ ﺃﻣﺎﻡ ﺍﻟﻣﺟﺗﻣﻊ‪.‬‬
‫ﻭﺇﺫﺍ ﻛﺎﻧﺕ ﺍﻟﻣﺳﺋﻭﻟﻳﺔ ﻫﻲ ﻧﺗﻳﺟﺔ ﻁﺑﻳﻌﻳﺔ ﻟﻺﻟﺯﺍﻡ‪ ،‬ﻓﺈﻥ ﺍﻟﺟﺯﺍء‬
‫ﻧﺗﻳﺟﺔ ﻁﺑﻳﻌﻳﺔ ﻟﻬﺎ‪.‬‬
‫ﺍﻟﺟﺯﺍء ﺇﻣﺎ ﺃﻥ ﻳﻛﻭﻥ‪:‬‬
‫• ﺇﻟﻬﻳﺎ ً‬
‫• ﻭﺟﺩﺍﻧﻳﺎ‬
‫• ﻁﺑﻳﻌﻳﺎ ً‬
‫• ﺍﺟﺗﻣﺎﻋﻳﺎ ً‬
‫ﻭﻣﻥ ﻣﻅﺎﻫﺭ ﻣﺭﺍﻋﺎﺓ ﺍﻷﻣﺎﻧﺔ ﻓﻲ ﺍﻟﻣﻣﺎﺭﺳﺔ ﺍﻟﻣﻬﻧﻳﺔ ﻟﻠﻣﻬﻧﺩﺱ‪:‬‬
‫• ﺃﻻ ﻳﻘﻭﻡ ﺑﻌﻣﻝ ﻻ ﻳﻣﺗﻠﻙ ﺃﺩﻭﺍﺗﻪ ﻣﻥ ﺍﻟﺧﺑﺭﺓ ﻭﺍﻟﻛﻔﺎءﺓ‪.‬‬
‫•ﺃﻥ ﻳﻭﺍﻅﺏ ﻋﻠﻰ ﺍﻻﺭﺗﻘﺎء ﻋﻠﻣﻳﺎ ً ﻟﻛﻲ ﻳﻅﻝ ﻣﺅﺩﻳﺎ ﻟﻌﻣﻠﻪ ﻋﻠﻰ ﺍﻟﻭﺟﻪ‬
‫ﺍﻷﻛﻣﻝ‪.‬‬
‫• ﺃﻻ ﻳﺳﺗﻐﻝ ﻭﻅﻳﻔﺗﻪ ﻟﺗﺣﻘﻳﻖ ﻣﺻﻠﺣﺔ ﺷﺧﺻﻳﺔ ﻟﻪ ﺃﻭ ﻷﺣﺩ ﺃﻗﺎﺭﺑﻪ‪.‬‬
‫•ﺃﻻ ﻳﺳﺗﺧﺩﻡ ﺃﺩﻭﺍﺕ ﺍﻟﻌﻣﻝ ﺑﺩﻭﻥ ﻭﺟﻪ ﺣﻖ )ﺍﻷﻭﺭﺍﻕ ـ ﺍﻟﺳﻳﺎﺭﺓ ـ‬
‫ﺍﻟﺗﻠﻳﻔﻭﻥ ‪.(.......‬‬
‫•ﺍﻟﺣﻔﺎﻅ ﻋﻠﻰ ﺍﻟﻭﻗﺕ ﻭﺍﻻﺳﺗﻔﺎﺩﺓ ﺑﻪ ﻛﺎﻣﻼً ﻟﻣﺻﻠﺣﺔ ﺍﻟﻌﻣﻝ‪.‬‬
‫•ﻋﺩﻡ ﺇﻓﺷﺎء ﺇﺳﺭﺍﺭ ﺍﻟﻌﻣﻝ‪.‬‬
‫• ﺍﻻﻟﺗﺯﺍﻡ ﻋﻧﺩ ﺍﺳﺗﻼﻡ ﺍﻷﻋﻣﺎﻝ ﺑﺎﻟﻣﻭﺍﺻﻔﺎﺕ ﺍﻟﻬﻧﺩﺳﻳﺔ ﺍﻟﺻﺣﻳﺣﺔ‬
‫ﻭﺍﺷﺗﺭﺍﻁﺎﺕ ﺍﻟﺗﻌﺎﻗﺩ‪.‬‬
‫•ﻣﺭﺍﻋﺎﺓ ﺍﻟﺿﻣﻳﺭ ﻓﻲ ﺇﻋﺩﺍﺩ ﺍﻟﻌﻘﻭﺩ ﻭﺍﻟﻣﻭﺍﺻﻔﺎﺕ ﺑﻣﺎ ﻻ ﻳﻌﻁﻲ‬
‫ﺍﻟﻔﺭﺻﺔ ﻟﻠﺗﻼﻋﺏ ﺑﺎﻷﻟﻔﺎﻅ ﺃﻭ ﺗﺣﻘﻳﻖ ﻣﺻﻠﺣﺔ ﻣﺑﺎﺷﺭﺓ ﺃﻭ ﻏﻳﺭ‬
‫ﻣﺑﺎﺷﺭﺓ ﻟﻪ ﻓﻳﻣﺎ ﺑﻌﺩ‪.‬‬
‫•ﺗﻭﺯﻳﻊ ﺍﻷﻋﺑﺎء ﻋﻠﻰ ﻣﺭءﻭﺳﻳﻪ ﺑﺎﻟﻌﺩﻝ ﻭﺩﻭﻥ ﻣﺣﺎﺑﺎﺓ ﺃﻭ ﻣﺟﺎﻣﻠﺔ‪.‬‬
‫•ﺍﻟﺣﻔﺎﻅ ﻋﻠﻰ ﻣﺷﺎﻋﺭ ﺍﻟﺟﻧﺱ ﺍﻵﺧﺭ ﻣﻥ ﺍﻟﻣﺭءﻭﺳﻳﻥ ﺃﻭ ﺍﻟﺯﻣﻼء‬
‫ﻓﻼ ﻳﺟﺭﺣﻬﻡ ﺑﺎﻟﻘﻭﻝ ﺃﻭ ﺍﻟﻧﻅﺭ ﺃﻭ ﺍﻟﻔﻌﻝ‪.‬‬
‫•ﺃﻥ ﻳﺣﺎﻓﻅ ﻋﻠﻰ ﺗﻛﺎﻟﻳﻑ ﺍﻟﻣﺷﺭﻭﻋﺎﺕ ﻓﻲ ﺍﻟﺣﺩ ﺍﻷﺩﻧﻰ ﺍﻟﺫﻱ ﻳﺿﻣﻥ‬
‫ﺳﻼﻣﺔ ﺍﻷﻋﻣﺎﻝ ﻭﺗﺣﻘﻳﻖ ﻣﺗﻁﻠﺑﺎﺕ ﺍﻟﻌﻣﻳﻝ ﺩﻭﻥ ﺇﻓﺭﺍﻁ ﺃﻭ ﺑﺫﺥ‪.‬‬
‫•ﺃﻥ ﻳﺧﺗﺎﺭ ﺍﻷﺷﺧﺎﺹ ﺍﻟﻣﻧﺎﺳﺑﻳﻥ ﻟﻸﻋﻣﺎﻝ ﺍﻟﺗﻲ ﻳﻘﻭﻣﻭﻥ ﺑﻬﺎ‪.‬‬
‫•ﺃﻥ ﻳﺣﺎﻓﻅ ﻋﻠﻰ ﺍﻟﺑﻳﺋﺔ ﻭﻋﻠﻰ ﺍﻟﻣﻭﺍﺭﺩ ﺍﻟﻁﺑﻳﻌﻳﺔ ﻓﻳﻣﺎ ﻳﻘﻭﻡ ﺑﻪ ﻣﻥ‬
‫ﻣﺷﺭﻭﻋﺎﺕ ﺣﻳﺙ ﻳﻣﻛﻥ ﺃﻥ ﻳﺩﺧﻝ ﻋﺩﻡ ﺍﻟﺣﺭﺹ ﻋﻠﻰ ﺫﻟﻙ ﻓﻲ ﺩﺍﺋﺭﺓ‬
‫ﺍﻹﻓﺳﺎﺩ ﻓﻲ ﺍﻷﺭﺽ ﺍﻟﺗﻲ ﻫﻭ ﻣﺅﺗﻣﻥ ﻋﻠﻳﻬﺎ ﻭﻣﺳﺗﺧﻠﻑ ﻓﻳﻬﺎ‪.‬‬
‫‪ -٣‬ﻣﻔﻬﻮﻡ ﺍﻹﺣﺘﺮﺍﻑ ﻭﺃﺧﻼﻗﻴﺎﺕ ﺍﻟﺘﻘﺪﻡ‬
‫‪ ١-٣‬ﺍﻹﺣﺗﺭﺍﻑ ﺍﻟﻣﻬﻧﻲ‪:‬‬
‫ﻣﻔﻬﻭﻡ ﺧﺻﺎﺋﺹ ﺍﻟﻣﻬﻧﺔ ﺃﻭ ﺍﻟﺣﺭﻓﺔ ﻳﺗﺿﻣﻥ ﺳﺗﺔ ﻋﻧﺎﺻﺭ ﻭﻫﻲ‪:‬‬
‫•ﺍﻟﻧﺷﺎﻁ ﺍﻟﻣﻬﻧﻲ ﻫﻭ ﻧﺷﺎﻁ ﺍﺑﺗﻛﺎﺭﻱ‪.‬‬
‫•ﻳﺗﻣﻳﺯ ﺍﻟﻧﺷﺎﻁ ﺍﻟﻣﻬﻧﻲ ﺑﻣﻧﻬﺟﻳﺗﻪ ﻟﺣﻝ ﺍﻟﻣﺷﻛﻼﺕ ﻭﺍﺗﺧﺎﺫ ﺍﻟﻘﺭﺍﺭﺍﺕ‬
‫)ﺑﺧﻼﻑ ﺍﻷﺳﻠﻭﺏ ﺍﻟﻌﺷﻭﺍﺋﻲ(‪.‬‬
‫•ﺗﺗﺿﻣﻥ ﺍﻟﻣﻬﻧﺔ ﻣﺟﻣﻭﻋﺔ ﻣﻥ ﺍﻟﻣﻌﺎﺭﻑ ﺍﻟﺗﻲ ﻳﺗﻁﻠﺏ ﺗﺣﺻﻳﻠﻬﺎ ﺗﻌﻠﻳﻣﺎ‬
‫ﺧﺎﺻﺎ ً‪.‬‬
‫•ﺍﻟﺗﻌﻠﻳﻡ ﺍﻟﻣﺳﺗﻣﺭ )ﺑﻌﺩ ﺍﻟﺗﺧﺭﺝ( ﺟﺯء ﺭﺋﻳﺱ ﻣﻥ ﺍﻟﻧﺷﺎﻁ ﺍﻟﻣﻬﻧﻲ‪.‬‬
‫•ﺍﻟﻣﻬﻧﺔ ﺗﺗﻌﻠﻖ ﺑﺗﺣﻘﻳﻖ ﻫﺩﻑ ﻭﻟﻳﺱ ﺃﺩﺍء ﻣﻬﻣﺔ‪.‬‬
‫•ﺍﻟﺷﺧﺹ ﺍﻟﻣﻬﻧﻲ ﺍﻟﻣﺣﺗﺭﻑ ﻳﺗﺑﻊ ﻻﺋﺣﺔ ﻵﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ‬
‫‪ .Professional Code of Ethics‬ﻭ ﻻ ﻳﺧﺿﻊ ﻹﻣﻼءﺍﺕ ﺍﻟﻌﻣﻳﻝ‬
‫‪ ٢-٣‬ﻗﻳﻡ ﻭﺃﺧﻼﻗﻳﺎﺕ ﺍﻟﺗﻘﺩﻡ‪:‬‬

‫• ﺃﻥ ﻳﻛﻭﻥ ﺣﺭﻳﺻﺎ ً ﻋﻠﻰ ﺍﻏﺗﻧﺎﻡ ﺍﻟﻔﺭﺹ ﻭﺍﻟﻣﺷﺎﺭﻛﺔ ﻓﻲ ﺍﻟﻣﺷﺭﻭﻋﺎﺕ‬
‫ﺍﻟﻛﺑﻳﺭﺓ ﻭﺍﻟﺗﻘﺩﻡ ﻟﻬﺎ ﻭﺇﻋﺩﺍﺩ ﺍﻟﻌﺩﺓ ﺍﻟﻼﺯﻣﺔ ﻟﻬﺎ ﻣﻥ ﻣﻭﺍﺭﺩ ﻓﻧﻳﺔ ﻭﺑﺷﺭﻳﺔ‬
‫•ﺃﻥ ﻳﺑﺎﺩﺭ ﺑﺎﻟﺗﻌﺎﻭﻥ ﻣﻊ ﺯﻣﻼﺋﻪ ﻓﻲ ﺍﻟﻌﻣﻝ ﺑﺎﺫﻻً ﻛﻝ ﺍﻟﺟﻬﺩ ﻓﻲ ﺫﻟﻙ‪.‬‬
‫• ﺃﻥ ﻳﺑﺎﺩﺭ ﺑﺑﺫﻝ ﺍﻟﺟﻬﺩ ﺍﻟﺫﺍﺗﻲ ﻟﺭﻓﻊ ﻣﺳﺗﻭﺍﻩ ﺍﻟﻌﻠﻣﻲ ﻭﺍﻟﻣﻬﻧﻲ‪ ،‬ﻭﻛﺫﻟﻙ‬
‫ﻟﻠﻣﺭءﻭﺳﻳﻥ ﺍﻟﻌﺎﻣﻠﻳﻥ ﺗﺣﺕ ﺇﻣﺭﺗﻪ‪ ،‬ﺑﺻﻔﺔ ﻣﺳﺗﻣﺭﺓ‪.‬‬
‫•ﺃﻥ ﻳﻣﺗﻧﻊ ﻋﻥ ﺍﻟﻘﻳﺎﻡ ﺑﺄﻱ ﻋﻣﻝ ﻻ ﻳﻘﺗﻧﻊ ﺑﺳﻼﻣﺗﻪ ﻭﺻﺣﺗﻪ ﺍﻟﻔﻧﻳﺔ‪ ،‬ﻣﺗﻰ‬
‫ﺗﻭﻓﺭﺕ ﻟﺩﻳﻪ ﺃﺩﻟﺔ ﻣﻭﺿﻭﻋﻳﺔ ﻋﻠﻰ ﺫﻟﻙ‪ ،‬ﻭﺃﻥ ﻳﻘﻭﻡ ﺑﺈﺑﻼﻍ ﺍﻟﻣﺳﺋﻭﻟﻳﻥ‬
‫ﻓﻲ ﺣﺎﻟﺔ ﺇﺫﺍ ﻛﺎﻥ ﺗﻧﻔﻳﺫﻩ ﻳﺅﺩﻱ ﺇﻟﻰ ﺍﻟﺣﺎﻗﻪ ﺃﻱ ﺿﺭﺭ‪.‬‬
‫• ﺃﻥ ﻳﺑﺎﺩﺭ ﺑﺗﻘﺩﻳﻡ ﺍﻟﻧﺻﺢ ﻟﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﺇﺫﺍ ﺧﺎﻟﻑ ﺍﻟﺭﺃﻱ ﺍﻟﻔﻧﻲ ﻓﻲ ﺃﺣﺩ‬
‫ﺍﻟﻣﺷﺭﻭﻋﺎﺕ ﻣﻣﺎ ﻳﻌﺭﺽ ﺳﻼﻣﺔ ﺍﻟﻣﺷﺭﻭﻉ ﻟﻠﺧﻁﺭ‪ ،‬ﻭﺇﻥ ﺭﻓﺽ ﻓﻌﻠﻳﻪ‬
‫ﺇﺑﻼﻍ ﺍﻟﺟﻬﺎﺕ ﺍﻟﻣﺳﺋﻭﻟﺔ ﺑﺫﻟﻙ‪.‬‬
‫ﻭﻣﻥ ﻣﻅﺎﻫﺭ ﺍﻹﺗﻘﺎﻥ ﺍﻟﻣﻁﻠﻭﺑﺔ ﻣﻥ ﺍﻟﻣﻬﻧﺩﺱ ﻓﻲ ﻣﻣﺎﺭﺳﺎﺗﻪ‬

‫ﻳُﻌَ ِﻅﻡ ﻣﻥ ﺃﻫﻣﻳﺔ ﺑﺙ ﺍﻟﻭﻋﻲ ﺑﻳﻥ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﻋﻠﻰ ﺟﻣﻳﻊ‬
‫ﺍﻟﻣﺳﺗﻭﻳﺎﺕ ﺍﻟﻣﻬﻧﻳﺔ ﺑﻣﻭﺿﻭﻉ ﺍﻻﻟﺗﺯﺍﻡ ﺑﺂﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ ﻭﺩﻭﺭﻩ‬

‫‪ ١-٤‬ﻗَ َ‬

‫ﺗﺷﻳﺭ ﻣﻭﺍﺩ ﺍﻟﻘﺎﻧﻭﻥ ‪ ٦٦‬ﻭﺗﻌﺩﻳﻼﺗﻪ ﺑﺷﺄﻥ ﻧﻘﺎﺑﺔ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺇﻟﻰ‬
‫ﻭﺟﻭﺏ ﺍﻟﺗﺯﺍﻡ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺑﺎﻟﻘﻭﺍﻋﺩ ﺍﻷﺧﻼﻗﻳﺔ ﻭﺩﺳﺗﻭﺭ ﺍﻟﺳﻠﻭﻙ‬
‫ﻭﺃﺻﻭﻝ ﺍﻟﺻﻧﻌﺔ‪ ،‬ﻭﻗﺩ ﺟﺎء ﺑﺎﻟﻣﺎﺩﺓ ‪ ١٣٧‬ﻣﻥ ﻫﺫﺍ ﺍﻟﻘﺎﻧﻭﻥ ﺃﻧﻪ‬
‫ﻳﺗﻌﻳﻥ ﻋﻠﻰ ﻋﺿﻭ ﺍﻟﻧﻘﺎﺑﺔ ﺃﻥ ﻳﺅﺩﻱ ﺍﻟﻳﻣﻳﻥ ﺍﻟﺗﺎﻟﻲ ﺧﻼﻝ ﺛﻼﺛﻳﻥ‬
‫ﻳﻭﻣﺎ ً ﻋﻠﻰ ﺍﻷﻛﺛﺭ ﻣﻥ ﺗﺎﺭﻳﺦ ﻗﻳﺩﻩ‪ ،‬ﻭﺫﻟﻙ ﺃﻣﺎﻡ ﻟﺟﻧﺔ ﻣﻥ ﺛﻼﺛﺔ‬
‫ﺃﻋﺿﺎء ﻳﻧﺗﺧﺑﻬﻡ ﻣﺟﻠﺱ ﺍﻟﻧﻘﺎﺑﺔ ﻣﻥ ﺑﻳﻥ ﺃﻋﺿﺎﺋﻪ‪:‬‬

‫”ﺃﻗﺳﻡ ﺑﺎ ﺍﻟﻌﻅﻳﻡ‪ ،‬ﺃﻥ ﺃﺅﺩﻱ ﺃﻋﻣﺎﻝ ﻣﻬﻧﺗﻲ ﺑﺎﻷﻣﺎﻧﺔ ﻭﺍﻟﺷﺭﻑ‪،‬‬

‫ﺍﻟﻘﻭﺍﻋﺩ ﺍﻷﺧﻼﻗﻳﺔ ﺍﻟﺭﺋﻳﺳﻳﺔ‪:‬‬
‫ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﻳﺩﻋﻣﻭﻥ ﺗﻘﺩﻡ ﻭﻛﻣﺎﻝ ﻭﺷﺭﻑ ﻭﻛﺭﺍﻣﺔ ﺍﻟﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﻳﺔ‬
‫ﺑﺎﻵﺗﻲ‪:‬‬
‫‪ .١‬ﻳﺳﺗﺧﺩﻣﻭﻥ ﻣﻌﻠﻭﻣﺎﺗﻬﻡ ﻭﻣﻬﺎﺭﺗﻬﻡ ﻟﺗﻌﺯﻳﺯ ﺍﻟﻣﺻﺎﻟﺢ ﺍﻟﺑﺷﺭﻳﺔ‪.‬‬
‫‪ .٢‬ﻳﺧﺩﻣﻭﻥ ﻣﻭﻅﻔﻳﻬﻡ ﻭﻋﻣﻼﺋﻬﻡ ﻭ ﺍﻟﺟﻣﻬﻭﺭ ﺑﺷﺭﻑ ﻭﻧﺯﺍﻫﺔ‬
‫ﻭﺇﺧﻼﺹ‪.‬‬
‫‪ .٣‬ﻳﺑﺫﻟﻭﻥ ﻛﻝ ﺍﻟﺟﻬﺩ ﻟﺯﻳﺎﺩﺓ ﻛﻔﺎءﺓ ﻭﻫﻳﺑﺔ ﻭﺍﺣﺗﺭﺍﻡ ﺍﻟﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﻳﺔ‪.‬‬
‫‪ .٤‬ﻳﺩﻋﻣﻭﻥ ﺃﻧﺷﻁﺔ ﺍﻟﺟﻣﻌﻳﺎﺕ ﺍﻟﻣﻬﻧﻳﺔ ﻭﺍﻟﺗﻘﻧﻳﺔ ﺍﻟﺗﻲ ﺗﻌﻣﻝ ﻓﻲ‬
‫ﺍﺧﺗﺻﺎﺻﻬﻡ‪.‬‬
‫ﺍﻟﻘﻭﺍﻧﻳﻥ ﺍﻷﺧﻼﻗﻳﺔ ﺍﻷﺳﺎﺳﻳﺔ‪:‬‬
‫‪ .١‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﺑﺫﻟﻭﻥ ﺃﻗﺻﻰ ﻣﺎ ﻓﻲ ﻭﺳﻌﻬﻡ ﻟﺯﻳﺎﺩﺓ ﺍﻟﺳﻼﻣﺔ‪ ،‬ﻭﺍﻟﺻﺣﺔ‪،‬‬
‫ﻭﻣﺻﻠﺣﺔ ﺍﻟﺟﻣﺎﻫﻳﺭ‪ ،‬ﺃﺛﻧﺎء ﺃﺩﺍﺋﻬﻡ ﻟﻭﺍﺟﺑﺎﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪.‬‬
‫‪ .٢‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﻣﺎﺭﺳﻭﻥ ﺧﺩﻣﺎﺗﻬﻡ ﻁﺑﻘﺎ ً ﻟﺗﺧﺻﺻﻬﻡ ﻭﻛﻔﺎﺋﺗﻬﻡ ﻓﻘﻁ‪.‬‬
‫‪ .٣‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﺻﺩﺭﻭﻥ ﺗﺻﺭﻳﺣﺎﺗﻬﻡ ﻭﻳﻌﺗﻣﺩﻭﻥ ﺷﻬﺎﺩﺍﺗﻬﻡ ﺑﻁﺭﻳﻘﺔ‬
‫ﻣﻭﺿﻭﻋﻳﺔ ﺻﺎﺩﻗﺔ ﻓﻘﻁ‪.‬‬
‫‪ .٤‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﻌﻣﻠﻭﻥ ﻛﻭﻛﻼء ﺃﻭ ﺃﻣﻧﺎء ﻣﺧﻠﺻﻳﻥ ﻓﻲ ﺍﻟﻣﻭﺿﻭﻋﺎﺕ‬
‫ﺍﻟﻣﻬﻧﻳﺔ ﻟﻛﻝ ﻣﻥ ﻣﺳﺗﺧﺩﻣﻳﻬﻡ ﺃﻭ ﻋﻣﻼﺋﻬﻡ‪ ،‬ﻭﺳﻳﺗﺟﻧﺑﻭﻥ ﺗﺿﺎﺭﺏ‬
‫ﺍﻟﻣﺻﺎﻟﺢ‪.‬‬
‫‪ .٥‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﺑﻧﻭﻥ ﺷﻬﺭﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ ﻁﺑﻘﺎ ً ﻟﻣﺅﻫﻼﺗﻬﻡ ﻭﺧﺩﻣﺎﺗﻬﻡ ﻭﻟﻥ‬
‫ﻳﺗﻧﺎﻓﺳﻭﺍ ﺑﺄﺳﻠﻭﺏ ﻏﻳﺭ ﻋﺎﺩﻝ ﻣﻊ ﺍﻵﺧﺭﻳﻥ‪.‬‬
‫‪ .٦‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﻌﻣﻠﻭﻥ ﺑﺄﺳﻠﻭﺏ ﻳﻌﻣﻝ ﻋﻠﻰ ﺩﻋﻡ ﻭﺗﻌﺯﻳﺯ ﺷﺭﻑ ﻭﻛﻣﺎﻝ‬
‫ﻭﺟﻼﻝ ﻭﺳﻣﻭ ﺍﻟﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﻳﺔ‪.‬‬
‫‪ .٧‬ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺳﻳﺳﺗﻣﺭﻭﻥ ﻓﻲ ﺗﻁﻭﻳﺭ ﻣﻬﻧﺗﻬﻡ ﻭﺗﺧﺻﺻﺎﺗﻬﻡ ﻭﺳﻳﺗﻳﺣﻭﻥ‬
‫ﺍﻟﻔﺭﺻﺔ ﻟﻠﺗﻁﻭﻳﺭ ﺍﻟﻣﻬﻧﻲ ﺗﺣﺕ ﺇﺷﺭﺍﻓﻬﻡ‪.‬‬
‫‪ ٣-٤‬ﺍﻷﻁﺭﺍﻑ ﺍﻟﺗﻲ ﻳﻠﺗﺯﻡ ﻧﺣﻭﻫﺎ ﺍﻟﻣﻬﻧﺩﺱ‪:‬‬

‫ﻣﺗﻛﺎﻣﻝ ﻳﺣﺗﺎﺝ ﺑﻌﺽ ﺍﻟﺧﺑﺭﺍﺕ ﺍﻟﻣﺗﺧﺻﺻﺔ ﻏﻳﺭ ﺍﻟﻣﺗﻭﺍﻓﺭﺓ‬
‫ﻟﺩﻯ ﺍﻟﻣﻬﻧﺩﺱ( ﺃﻥ ﻳﺳﺗﻌﻳﻧﻭﺍ ﺑﻣﺳﺗﺷﺎﺭﻳﻥ ﻳﻣﺗﻠﻛﻭﻥ ﺍﻟﺧﺑﺭﺓ‬

‫• ﻳﺟﺏ ﻋﺩﻡ ﺗﻭﺟﻳﻪ ﺳﻳﺭ ﺍﻟﻌﻣﻝ ﺑﻣﺎ ﻳﺣﻘﻖ ﺍﻟﻣﺻﻠﺣﺔ ﺍﻟﺷﺧﺻﻳﺔ‬
‫ﻟﻠﻣﻬﻧﺩﺱ ﻋﻠﻰ ﺣﺳﺎﺏ ﻣﺻﻠﺣﺔ ﺍﻟﻌﻣﻳﻝ‪ ،‬ﻛﺄﻥ ﻳﺭﻓﻊ ﻣﻥ ﺗﻛﻠﻔﺔ‬
‫ﺍﻟﻣﺷﺭﻭﻉ ﺩﻭﻥ ﺩﺍﻉ ﻟﻛﻲ ﻳﺣﺻﻝ ﻋﻠﻰ ﺃﺗﻌﺎﺏ ﻛﺑﻳﺭﺓ ﺇﺫﺍ ﻛﺎﻧﺕ‬
‫ﺃﺗﻌﺎﺑﻪ ﺗﻘﺩﺭ ﻛﻧﺳﺑﺔ ﻣﺋﻭﻳﺔ ﻣﻥ ﺗﻛﺎﻟﻳﻑ ﺍﻟﻣﺷﺭﻭﻉ‪.‬‬
‫• ﻳﺟﺏ ﺗﻘﺩﻳﻡ ﺍﻟﺧﺩﻣﺔ ﻟﻠﻌﻣﻳﻝ ﺑﻣﻧﺗﻬﻰ ﺍﻹﺧﻼﺹ ﻭﺍﻟﺗﻔﺎﻧﻲ ﻁﺎﻟﻣﺎ ﺗﻡ‬
‫ﺍﻻﺗﻔﺎﻕ ﻭﺍﻟﺗﺭﺍﺿﻲ ﺣﻭﻝ ﺍﻷﺗﻌﺎﺏ‪ ،‬ﻭﻳﺟﺏ ﺃﻻ ﻳﻘﻝ ﻣﺳﺗﻭﻯ ﺍﻟﺧﺩﻣﺔ‬
‫ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﻣﻬﻧﺩﺱ ﻳﺷﻌﺭ ﺑﻘﻠﺔ ﺍﻷﺗﻌﺎﺏ‪ ،‬ﺣﻳﺙ ﺃﻥ ﺍﻟﺗﻌﺎﻣﻝ ﺃﺳﺎﺳﺎ ً ﻣﻊ‬
‫ﷲ ﻗﺑﻝ ﺃﻥ ﻳﻛﻭﻥ ﻣﻊ ﺍﻟﻌﻣﻳﻝ )ﻫﻝ ﻳﺿﺣﻲ ﺍﻟﻣﻬﻧﺩﺱ ﺑﻣﺳﺗﻭﻯ ﻣﻌﻳﻥ‬
‫ﻣﻥ ﺍﻟﺳﻼﻣﺔ ﻣﺛﻼً ﺇﺫﺍ ﻟﻡ ﻳﺭﺿﻰ ﻋﻣﺎ ﻳﺳﺩﺩﻩ ﻟﻪ ﺍﻟﻌﻣﻳﻝ ﻣﻥ‬
‫ﺃﺗﻌﺎﺏ؟(‪.‬‬
‫• ﻳﺟﺏ ﺗﻘﺩﻳﻡ ﺍﻟﻣﺷﻭﺭﺓ ﺍﻟﻔﻧﻳﺔ ﺍﻟﺻﺎﺩﻗﺔ ﻟﻠﻌﻣﻳﻝ‪ ،‬ﻭﻟﻳﺱ ﺗﺯﻟﻔﺎ ً ﺇﻟﻳﻪ ﺃﻭ‬
‫ﺇﺭﺿﺎء ﻟﻁﻠﺑﺎﺗﻪ ﺣﺗﻰ ﻟﻭ ﻛﺎﻧﺕ ﺿﺩ ﻣﺻﻠﺣﺗﻪ‪ ،‬ﻓﺎﻟﺣﻔﺎﻅ ﻋﻠﻰ ﻣﺻﺎﻟﺢ‬
‫ﺟﻬﺩ ﻭﻣﺎﻝ ﺍﻟﻌﻣﻳﻝ ﻳﺟﺏ ﺃﻥ ﺗﻛﻭﻥ ﻋﻠﻰ ﺭﺃﺱ ﺃﻭﻟﻭﻳﺎﺕ ﺍﻟﻣﻬﻧﺩﺱ‪.‬‬
‫• ﻳﺟﺏ ﺃﻻ ﻳﻘﺑﻝ ﺍﻟﻣﻬﻧﺩﺱ ﺃﻳﻪ ﺃﻋﻣﺎﻝ ﺗﺣﻣﻝ ﻭﺍﻗﻌﻳﺎً‪ ،‬ﺃﻭ ﺣﺗﻰ ﻣﻥ ﻗﺑﻳﻝ‬
‫ﺍﻟﺷﺑﻬﺔ‪ ،‬ﺗﻌﺎﺭﺿﺎ ً ﻓﻲ ﺍﻟﻣﺻﺎﻟﺢ‪ ،‬ﻣﺛﻝ ﻗﺑﻭﻝ ﺍﻟﻌﻣﻝ ﻛﺎﺳﺗﺷﺎﺭﻱ‬
‫ﻟﻠﻣﺎﻟﻙ ﺃﻭ ﺍﻟﻣﻘﺎﻭﻝ ﺃﻭ ﺃﺣﺩ ﻣﻘﺎﻭﻟﻲ ﺍﻟﺑﺎﻁﻥ ﻟﻣﺷﺭﻭﻉ ﻣﻌﻳﻥ ﻓﻲ ﻧﻔﺱ‬
‫ﺍﻟﻭﻗﺕ ‪ ......‬ﺍﻟﺦ‪ ،‬ﺇﻻ ﻓﻲ ﺑﻌﺽ ﺍﻟﺣﺎﻻﺕ ﺍﻟﺧﺎﺻﺔ ﺍﻟﺗﻲ ﺗﻛﻭﻥ ﻓﻳﻬﺎ‬

‫ﻳﺟﺏ ﺃﻻ ﻳﻘﻭﻡ ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺑﺗﺿﻠﻳﻝ ﻋﻣﻼﺋﻬﻡ ﺳﻭﺍ ًء ﻋﻣﺩﺍ ً ﺃﻭ‬ ‫•‬
‫ﺍﺳﺗﻬﺗﺎﺭﺍ ً ﺑﺷﺄﻥ ﺍﻟﻧﺗﺎﺋﺞ ﺍﻟﺗﻲ ﻳﻣﻛﻥ ﺗﺣﻘﻳﻘﻬﺎ ﻣﻥ ﺧﻼﻝ ﺧﺩﻣﺎﺗﻬﻡ‬
‫ﺍﻟﻣﻬﻧﻳﺔ‪.‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺇﻅﻬﺎﺭ ﺃﻳﺔ ﺁﺛﺎﺭ ﺟﺎﻧﺑﻳﺔ ﺃﻭ ﻣﺷﻛﻼﺕ ﺑﻳﺋﻳﺔ‬ ‫•‬
‫ﻓﻲ ﺃﻱ ﻋﻣﻝ ﻫﻧﺩﺳﻲ ﻣﻭﻛﻝ ﺇﻟﻳﻪ‪ ،‬ﻣﻊ ﺑﺫﻝ ﺍﻟﺟﻬﺩ ﻓﻲ ﺇﻳﺟﺎﺩ‬
‫ﺍﻟﺣﻠﻭﻝ ﺍﻟﻔﻧﻳﺔ ﺍﻟﻣﻧﺎﺳﺑﺔ ﻟﻬﺎ‪.‬‬
‫ﻳﺟﺏ ﺍﻟﺣﻔﺎﻅ ﻋﻠﻰ ﺍﻟﺳﺭﻳﺔ ﺍﻟﺗﺎﻣﺔ ﻓﻳﻣﺎ ﻳﺗﻌﻠﻖ ﺑﺎﻟﻣﻌﻠﻭﻣﺎﺕ ﺃﻭ‬ ‫•‬
‫ﺍﻟﺑﻳﺎﻧﺎﺕ ﺍﻟﺗﻲ ﺗﺧﺹ ﺍﻟﻌﻣﻼء ﺍﻟﺣﺎﻟﻳﻳﻥ ﺃﻭ ﺍﻟﻣﺎﺿﻳﻳﻥ ﻟﻠﻣﻬﻧﺩﺱ‪.‬‬
‫ﻳﺟﺏ ﺃﻥ ﻳﻛﻭﻥ ﻋﻣﻝ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺅﻣﻥ ﺗﺭﺟﻣﺔ ﺻﺎﺩﻗﺔ ﻟﻣﺎ‬ ‫•‬
‫ﻳﻌﺗﻘﺩﻩ ﻭﻳﺩﻋﻭ ﺇﻟﻳﻪ ﻣﻥ ﺇﻳﻣﺎﻥ ﻭﻋﻘﻳﺩﺓ ﺗﻣﻠﻲ ﻋﻠﻳﻪ ﺍﺗﻘﺎﻥ ﺍﻟﻌﻣﻝ‪،‬‬
‫ﻭﻫﻭ ﺑﺫﻟﻙ ﻳﻘﻭﻡ ﺑﺩﻭﺭ ﺍﻟﺩﺍﻋﻳﺔ ﺇﻟﻰ ﷲ )ﻋﻥ ﻁﺭﻳﻖ ﺗﻘﺩﻳﻡ‬
‫ﺍﻟﻘﺩﻭﺓ ﺍﻟﺻﺎﻟﺣﺔ( ﻗﺑﻝ ﺃﻥ ﻳﻘﻭﻡ ﺑﺩﻭﺭﻩ ﺍﻟﻣﻬﻧﻲ ﺍﻟﻣﻁﻠﻭﺏ‪.‬‬
‫ﻭﻣﻥ ﺍﻟﻣﻭﺍﻗﻑ ﺍﻟﺳﻠﻭﻛﻳﺔ ﻓﻲ ﻣﺟﺎﻝ ﻣﺳﺋﻭﻟﻳﺎﺕ ﺍﻟﻣﻬﻧﺩﺱ ﺗﺟﺎﻩ ﺍﻟﻌﻣﻳﻝ‪:‬‬
‫• ﻫﻝ ﻳﺟﻭﺯ ﻟﻣﻬﻧﺩﺱ ﻳﻌﻣﻝ ﻟﺻﺎﻟﺢ ﻣﺎﻟﻙ ﺍﻟﻣﺷﺭﻭﻉ ﻭﻳﺷﺭﻑ ﻋﻠﻰ ﺍﻟﺗﻧﻔﻳﺫ‬
‫ﻣﻥ ﻗﺑﻝ ﺍﻟﻣﻘﺎﻭﻝ ﺃﻥ ﻳﻘﺑﻝ ﻣﺑﺎﺷﺭﺓ ﺃﻋﻣﺎﻝ ﻳﻛﻠﻔﻪ ﺑﻬﺎ ﻫﺫﺍ ﺍﻟﻣﻘﺎﻭﻝ ﻓﻲ‬
‫ﻣﺷﺭﻭﻋﺎﺕ ﺃﺧﺭﻯ ﺑﻘﺻﺩ ﺃﻥ ﻳﺗﻬﺎﻭﻥ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺷﺭﻑ ﻓﻲ ﺃﺩﺍء ﻭﺍﺟﺑﻪ‬
‫ﻓﻲ ﺍﻹﺷﺭﺍﻑ ﻋﻠﻳﻪ؟ ﻭﻣﺎﺫﺍ ﺇﺫﺍ ﻟﻡ ﻳﻛﻥ ﻫﺫﺍ ﻫﻭ ﻣﻘﺻﺩ ﺍﻟﻣﻘﺎﻭﻝ‪ ،‬ﻛﻳﻑ ﻳﻣﻛﻥ‬
‫ﺃﻥ ﻳﻛﻭﻥ ﺍﻟﺗﺻﺭﻑ؟‬
‫• ﻫﻝ ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺃﻥ ﻳﺿﻊ ﻓﻲ ﻣﻭﺍﺻﻔﺎﺕ ﺍﻟﻣﺷﺭﻭﻉ ﺷﺭﻭﻁﺎ ً ﺃﻭ ﺑﻧﻭﺩﺍ‬
‫ﺗﺣﻘﻖ ﻣﺻﻠﺣﺔ ﻟﻪ ﺃﻭ ﻷﺣﺩ ﻋﻣﻼﺋﻪ ﺍﻵﺧﺭﻳﻥ‪ ،‬ﺩﻭﻥ ﺃﻥ ﻳﻛﻭﻥ ﻟﻬﺫﻩ ﺍﻟﺷﺭﻭﻁ‬
‫ﺿﺭﻭﺭﺓ‪ ،‬ﺃﻭ ﻣﻊ ﻭﺟﻭﺩ ﺑﺩﺍﺋﻝ ﺃﻛﺛﺭ ﻣﻼءﻣﺔ ﻟﻣﺎ ﻭﺿﻌﻪ ﻓﻲ ﻫﺫﻩ ﺍﻟﺷﺭﻭﻁ؟‬
‫• ﻫﻝ ﻳﺟﻭﺯ ﻟﻣﻬﻧﺩﺱ ﻗﺑﻭﻝ ﺃﻋﻣﺎﻝ ﺍﺳﺗﺷﺎﺭﻳﺔ ﺗﺧﺭﺝ ﻋﻥ ﺩﺍﺋﺭﺓ ﺗﺧﺻﺻﻪ‪،‬‬
‫ﻋﻠﻰ ﺃﻥ ﻳﻌﻳﻥ ﻟﻠﻘﻳﺎﻡ ﺑﻬﺫﻩ ﺍﻷﻋﻣﺎﻝ ﻣﻬﻧﺩﺳﻳﻥ ﻗﻠﻳﻠﻲ ﺍﻟﺧﺑﺭﺓ ﺩﻭﻥ ﺗﻭﺍﺟﺩ‬
‫ﺇﺷﺭﺍﻑ ﻣﻧﺎﺳﺏ ﻋﻠﻳﻬﻡ ﻣﻥ ﺧﺑﻳﺭ ﻫﻧﺩﺳﻲ ﺫﻭ ﺧﺑﺭﺓ ﻣﻼﺋﻣﺔ؟‬
‫• ﻫﻝ ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺃﻥ ﻳﺗﻣﺎﺷﻰ ﻣﻊ ﺟﻣﻳﻊ ﻁﻠﺑﺎﺕ ﺍﻟﻌﻣﻳﻝ‪ ،‬ﺣﺗﻰ ﻭﻟﻭ‬
‫ﺣﻣﻠﺕ ﻗﺩﺭﺍ ً ﻣﻥ ﺗﺟﺎﻭﺯ ﻣﺗﻁﻠﺑﺎﺕ ﺍﻟﺳﻼﻣﺔ ﺃﻭ ﻗﻭﺍﻧﻳﻥ ﺍﻟﺗﺭﺍﺧﻳﺹ ﺍﻟﺳﺎﺋﺩﺓ‬
‫ﺃﻭ ﺍﻟﻬﺑﻭﻁ ﺑﻣﺳﺗﻭﻯ ﺍﻟﺧﺩﻣﺔ ﻟﺗﺣﻘﻳﻖ ﺍﻟﻭﻓﺭ ﻟﻠﻌﻣﻳﻝ ﻋﻠﻰ ﺣﺳﺎﺏ ﺍﻟﻣﺳﺗﺧﺩﻡ‬
‫ﺍﻟﻧﻬﺎﺋﻲ ﻟﻠﻌﻣﻝ )ﺷﻘﺔ ﺳﻛﻧﻳﺔ ﻣﺛﻼً(‪ ،‬ﺃﻭ ﻏﻳﺭ ﺫﻟﻙ ﻣﻥ ﻁﻠﺑﺎﺕ؟‬

‫‪ ٤-٤‬ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﺔ ﻓﻲ ﻣﺻﺭ‪:‬‬
‫ﻻﺋﺣﺔ ﺗﻘﺎﻟﻳﺩ ﻣﺯﺍﻭﻟﺔ ﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﺔ ﺍﻟﻣﺩﻧﻳﺔ‪:‬‬
‫• ﻳﺧﺿﻊ ﺟﻣﻳﻊ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﻣﺩﻧﻳﻳﻥ ﻟﻬﺫﻩ ﺍﻟﻼﺋﺣﺔ ﻓﺿﻼً ﻋﻥ‬
‫ﻗﺎﻧﻭﻥ ﺍﻟﻧﻘﺎﺑﺔ ﻭﻟﻭﺍﺋﺣﻬﺎ ﺍﻟﺩﺍﺧﻠﻳﺔ ﻭﻛﻝ ﻣﺧﺎﻟﻔﺔ ﺗﻣﺱ ﻛﺭﺍﻣﺔ‬
‫ﺍﻟﻣﻬﻧﺔ ﺃﻭ ﺗﻘﺎﻟﻳﺩﻫﺎ ﺃﻭ ﻭﺍﺟﺑﺎﺗﻬﺎ ﺍﻷﺳﺎﺳﻳﺔ ﺗﻌﺭﺽ ﻣﺭﺗﻛﺑﻬﺎ‬
‫ﻟﻠﻣﺅﺍﺧﺫﺓ ﺍﻟـﺗﺄﺩﻳﺑﻳﺔ‪.‬‬
‫• ﻻ ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺇﺫﺍ ﻛﺎﻥ ﻣﻘﺎﻭﻻً ﻷﺣﺩ ﺍﻟﻌﻣﻠﻳﺎﺕ ﺃﻥ ﻳﺭﺷﺢ‬
‫ﻧﻔﺳﻪ ﻛﻣﻬﻧﺩﺱ ﻣﺷﺭﻑ ﻟﻠﻌﻣﻠﻳﺔ‪.‬‬
‫• ﻳﺗﻘﺎﺿﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺩﻧﻲ ﻛﺄﺟﺭ ﻟﻪ ﺍﻷﺗﻌﺎﺏ ﺍﻟﻣﺣﺩﺩﺓ ﻓﻲ ﻫﺫﻩ‬
‫ﺍﻟﻼﺋﺣﺔ ﻭﺍﻟﺗﻲ ﻳﺗﻌﻳﻥ ﻋﻠﻳﻪ ﺍﻟﺗﻣﺳﻙ ﺑﻬﺎ ﻭﻳﺣﺭﻡ ﻋﻠﻳﻪ ﻗﺑﻭﻝ ﺃﻱ‬
‫ﺃﺟﺭ ﺁﺧﺭ ﻣﻥ ﺟﻬﺔ ﺃﺧﺭﻯ ﺧﻼﻑ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﻋﻥ ﻧﻔﺱ ﻫﺫﻩ‬
‫ﺍﻷﻋﻣﺎﻝ ﻛﻣﺎ ﻳﻣﺗﻧﻊ ﻋﻠﻳﻪ ﻗﺑﻭﻝ ﺃﻱ ﻋﻣﻝ ﻫﻧﺩﺳﻲ ﻋﻠﻰ ﺃﺳﺎﺱ‬
‫ﺍﻟﻌﻣﻭﻟﺔ‪.‬‬
‫•ﻟﻠﻣﻬﻧﺩﺱ ﺍﻟﻣﺩﻧﻲ ﺃﻥ ﻳﻌﻣﻝ ﻛﺧﺑﻳﺭ ﺃﻭ ﻣﺳﺗﺷﺎﺭ ﻣﻊ ﺃﺻﺣﺎﺏ ﺍﻷﻋﻣﺎﻝ‬
‫ﻭﺍﻟﺷﺭﻛﺎﺕ ﺍﻟﻬﻧﺩﺳﻳﺔ ﺳﻭﺍء ﻛﺎﻥ ﺫﻟﻙ ﻛﻝ ﺍﻟﻭﻗﺕ ﺃﻭ ﺑﻌﺿﻪ ﺑﺎﻟﺷﺭﻭﻁ‬
‫ﺍﻵﺗﻳﺔ‪:‬‬
‫–ﺃﻥ ﻳﺗﻘﺎﺿﻰ ﺃﺟﺭﻩ ﻓﻲ ﺣﺎﻟﺔ "ﺑﻌﺽ ﺍﻟﻭﻗﺕ" ﻋﻠﻰ ﺃﺳﺎﺱ ﺍﻟﻣﺎﻫﻳﺔ ﺃﻭ ﺍﻷﺗﻌﺎﺏ ﻻ‬
‫ﻋﻠﻰ ﺃﺳﺎﺱ ﺍﻟﻌﻣﻭﻟﺔ‪.‬‬
‫–ﺃﻻ ﺗﻛﻭﻥ ﻟﻪ ﺳﻠﻁﺔ ﺍﻟﺗﻌﺎﻣﻝ ﺑﺎﺳﻡ ﺍﻟﻣﺅﺳﺳﺔ ﺃﻭ ﺍﻟﺷﺭﻛﺔ ﻭﻫﺫﺍ ﻻ ﻳﻣﻧﻊ ﻣﻥ‬
‫ﺗﻭﻗﻳﻌﻪ ﻋﻠﻰ ﻣﺳﺗﻧﺩﺍﺕ ﺍﻷﻋﻣﺎﻝ ﺍﻟﺗﻲ ﻗﺎﻡ ﺑﻬﺎ ﺑﺻﻔﺗﻪ ﺧﺑﻳﺭﺍ ً ﻣﺩﻧﻳﺎ ً ﻭﻟﻠﻣﻬﻧﺩﺱ‬
‫ﻓﻲ ﺣﺎﻟﺔ ﻋﻣﻠﻪ ﻛﺧﺑﻳﺭ ﺃﻭ ﻣﺳﺗﺷﺎﺭ ﺃﻥ ﻳﺳﻣﺢ ﻟﻠﻣﺅﺳﺳﺔ ﺃﻭ ﺍﻟﺷﺭﻛﺔ ﺑﻧﺷﺭ‬
‫ﺍﺳﻣﻪ ﻓﻲ ﺍﻹﻋﻼﻧﺎﺕ ﺑﻁﺭﻳﻘﺔ ﺗﺗﻔﻖ ﻣﻊ ﻛﺭﺍﻣﺔ ﺍﻟﻣﻬﻧﺔ ﻭﺑﻌﻳﺩﺓ ﻋﻥ ﺍﻟﻣﺑﺎﻟﻐﺔ‪.‬‬
‫• ﻻ ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺃﻥ ﻳﻌﺭﺽ ﺧﺩﻣﺎﺗﻪ ﺃﻭ ﻳﻘﻭﻡ ﺑﺎﻟﺩﻋﺎﻳﺔ ﻟﻧﻔﺳﺔ‬
‫ﺑﻁﺭﻳﻖ ﺍﻹﻋﻼﻧﺎﺕ ﺃﻭ ﺍﻟﻧﺷﺭ ﺃﻭ ﻣﺎ ﺷﺎﺑﻬﻬﺎ ﺇﻻ ﺃﻧﻪ ﻳﺟﻭﺯ ﻟﻪ ﻓﻲ ﺣﺎﻟﺔ‬
‫ﺗﻐﻳﻳﺭ ﻋﻧﻭﺍﻧﻪ ﺃﻭ ﻁﻠﺑﻪ ﻋﻣﺎﻻً ﺃﻭ ﻣﻭﻅﻔﻳﻥ ﺃﻥ ﻳﻌﻠﻥ ﻋﻥ ﺫﻟﻙ ﻓﻲ‬
‫ﺍﻟﺻﺣﻑ‪.‬‬
‫•ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺃﻥ ﻳﺿﻊ ﻟﻭﺣﺔ ﺗﺣﻣﻝ ﺍﺳﻣﻪ ﻋﻠﻰ ﻣﺑﺎﻧﻳﻪ ﺃﻭ‬
‫ﺧﺎﺭﺝ ﻣﻛﺗﺑﻪ ﺃﻭ ﻋﻠﻰ ﺍﻷﻋﻣﺎﻝ ﺍﻟﺗﻲ ﻳﻘﻭﻡ ﺑﺈﻧﺷﺎﺋﻬﺎ ﺃﻭ ﺗﻌﺩﻳﻠﻬﺎ‬
‫ﺑﺷﺭﻁ ﺃﻻ ﻳﺯﻳﺩ ﺍﺭﺗﻔﺎﻉ ﺍﻟﺣﺭﻭﻑ ﺍﻟﻣﻛﺗﻭﺑﺔ ﺑﻬﺎ ﻋﻥ ‪ ١٠‬ﺳﻡ ﻭﺃﻥ‬
‫ﺗﻛﻭﻥ ﻣﻛﺗﻭﺑﺔ ﺑﻁﺭﻳﻘﺔ ﺑﻌﻳﺩﺓ ﻋﻥ ﺍﻟﻣﺑﺎﻟﻐﺔ ﻭﻳﺟﻭﺯ ﻟﻪ ﺇﺫﺍ ﻭﺍﻓﻖ‬
‫ﺻﺎﺣﺏ ﺍﻟﻌﻣﻠﻳﺔ ﺃﻥ ﻳﺑﻘﻲ ﻫﺫﻩ ﺍﻟﻠﻭﺣﺔ ﻣﺩﺓ ﻻ ﺗﺯﻳﺩ ﻋﻠﻰ ﺍﺛﻧﺎ‬
‫ﻋﺷﺭ ﺷﻬﺭﺍ ﺑﻌﺩ ﻧﻬﻭ ﺍﻟﻌﻣﻠﻳﺔ ﺩﻭﻥ ﺃﻥ ﺗﺿﺎﻑ ﺇﻟﻳﻬﺎ ﺃﻳﺔ ﻋﺑﺎﺭﺍﺕ‬
‫ﺃﻭ ﻛﻠﻣﺎﺕ ﺃﺧﺭﻯ ﻣﺛﻝ ﻛﻠﻣﺗﻲ "ﻟﻠﺑﻳﻊ" ﺃﻭ "ﻟﻺﻳﺟﺎﺭ" ﻋﻠﻰ ﺃﻧﻪ‬
‫ﻳﻣﻛﻧﻪ ﻭﺿﻊ ﻟﻭﺣﺔ ﺗﺷﻳﺭ ﻋﻠﻰ ﺃﻥ ﺍﻟﺗﺻﻣﻳﻣﺎﺕ ﺍﻟﺧﺎﺻﺔ ﺑﻬﺫﺍ‬
‫ﺍﻟﻌﻣﻝ ﻣﻭﺟﻭﺩﺓ ﺑﻣﻛﺗﺏ ﺍﻟﻣﻬﻧﺩﺱ ﻭﻣﺻﺭﺡ ﺑﺎﻹﻁﻼﻉ ﻋﻠﻳﻬﺎ‪.‬‬
‫• ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺩﻧﻲ ﺃﻥ ﻳﺗﺟﻧﺏ ﺍﻟﻘﻳﺎﻡ ﺑﻌﻣﻝ ﻳﺗﻧﺎﻓﻰ ﻭﻁﺑﻳﻌﺔ‬
‫ﻋﻣﻠﻪ ﻭﻛﺭﺍﻣﺔ ﻣﻬﻧﺗﻪ ﻛﺎﻟﻘﻳﺎﻡ ﺑﺄﻋﻣﺎﻝ ﺍﻟﻣﺯﺍﻳﺩﺍﺕ ﻭﺍﻟﺳﻣﺳﺭﺓ‬
‫ﻭﻣﺎ ﺇﻟﻰ ﺫﻟﻙ‪.‬‬
‫• ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺩﻧﻲ ﻗﺑﻝ ﺍﻟﺑﺩء ﻓﻲ ﺩﺭﺍﺳﺔ ﺃﻱ ﻋﻣﻝ ﻳﻭﻛﻝ‬
‫ﺇﻟﻳﻪ ﺃﻥ ﻳﺣﺻﻝ ﻣﻥ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﺗﻌﻬﺩ ﻛﺗﺎﺑﻲ ﺑﺄﻧﻪ ﻟﻡ‬
‫ﻳﺳﺑﻖ ﻟﻪ ﺃﻥ ﻋﺭﺽ ﻧﻔﺱ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﻣﻬﻧﺩﺱ ﺁﺧﺭ ﻓﺈﺫﺍ ﺗﺑﻳﻥ‬
‫ﻟﻪ ﺃﻧﻪ ﺳﺑﻖ ﺍﻟﺗﻌﺎﻗﺩ ﻣﻊ ﻣﻬﻧﺩﺱ ﺁﺧﺭ ﻭﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ‬
‫ﺍﻟﺛﺎﻧﻲ ﺇﺧﻁﺎﺭ ﺯﻣﻳﻠﻪ ﻭﺷﻌﺑﺔ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﻣﺩﻧﻳﻳﻥ ﺑﺧﻁﺎﺏ‬
‫ﻣﻭﺻﻰ ﻋﻠﻳﻪ‪ ،‬ﻭﻋﻠﻳﻪ ﺃﻻ ﻳﺑﺩﺃ ﻣﺑﺎﺷﺭﺓ ﻋﻣﻠﻪ ﺇﻻ ﺑﻌﺩ ﻣﺿﻲ‬
‫ﺳﺑﻌﺔ ﺃﻳﺎﻡ ﻣﻥ ﻫﺫﺍ ﺍﻹﺧﻁﺎﺭ ﻟﻠﺗﺄﻛﺩ ﻣﻥ ﺗﺻﻔﻳﺔ ﺯﻣﻳﻠﻪ ﻷﺗﻌﺎﺑﻪ‬
‫ﻣﻊ ﺍﻟﻌﻣﻳﻝ‪ .‬ﻋﻠﻰ ﺃﻧﻪ ﻳﺟﻭﺯ ﻓﻲ ﺣﺎﻟﺔ ﺍﻻﺳﺗﻌﺟﺎﻝ ﺍﻟﺑﺩء ﻣﺑﺎﺷﺭﺓ‬
‫ﻓﻲ ﺍﻟﻌﻣﻝ ﺑﻌﺩ ﺍﺳﺗﺋﺫﺍﻥ ﺭﺋﻳﺱ ﺍﻟﺷﻌﺑﺔ‪.‬‬
‫• ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻣﺩﻧﻲ ﺃﻥ ﻳﻣﺗﻧﻊ ﻋﻥ ﻣﺣﺎﻭﻟﺔ ﺍﻟﺣﻠﻭﻝ ﻣﺣﻝ ﺯﻣﻳﻝ ﻟﻪ‬
‫ﻓﻲ ﻋﻣﻠﻪ ﺑﻭﺳﺎﺋﻝ ﻏﻳﺭ ﻻﺋﻘﺔ ﺑﻛﺭﺍﻣﺔ ﺍﻟﻣﻬﻧﺔ ﻭﺗﻘﺎﻟﻳﺩﻫﺎ‪.‬‬
‫• ﻻ ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺍﻟﻣﺩﻧﻲ ﺃﻥ ﻳﺿﻣﻥ ﺷﺭﻭﻁ ﺍﻟﻌﻁﺎء ﺃﻭ ﻛﺷﻭﻑ‬
‫ﺍﻟﻛﻣﻳﺎﺕ ﺃﻭ ﻣﺳﺗﻧﺩﺍﺕ ﺍﻟﻌﻘﻭﺩ ﺃﻱ ﺷﺭﻁ ﻳﻘﻳﺩ ﺇﻟﺯﺍﻡ ﺍﻟﻣﻘﺎﻭﻝ ﺩﻓﻊ ﺃﻱ‬
‫ﻣﺑﻠﻎ ﻟﻪ ﻣﻬﻣﺎ ﻛﺎﻧﺕ ﺍﻻﻋﺗﺑﺎﺭﺍﺕ‪.‬‬
‫• ﺇﻥ ﺭﻏﺏ ﺃﺣﺩ ﺃﺻﺣﺎﺏ ﺍﻷﻋﻣﺎﻝ ﺃﻥ ﻳﻭﻛﻝ ﻟﻌﺿﻭ ﺍﻟﻧﻘﺎﺑﺔ ﻣﻥ ﺍﻟﺷﻌﺑﺔ‬
‫ﺍﻟﻣﺩﻧﻳﺔ ﺑﺄﺣﺩ ﺍﻷﻋﻣﺎﻝ ﺍﻟﺗﻲ ﻳﺗﺩﺍﺧﻝ ﺟﺯء ﻣﻧﻬﺎ ﻓﻲ ﺍﺧﺗﺻﺎﺹ ﺷﻌﺑﺔ‬
‫ﺃﺧﺭﻯ ﻣﻥ ﺷﻌﺏ ﺍﻟﻣﻬﻥ ﺍﻟﻬﻧﺩﺳﻳﺔ ﻓﻌﻠﻰ ﻋﺿﻭ ﺍﻟﺷﻌﺑﺔ ﺍﻟﻣﺩﻧﻳﺔ ﺃﻥ‬
‫ﻳﻭﻛﻝ ﻫﺫﺍ ﺍﻟﺟﺯء ﻟﻠﻌﺿﻭ ﺍﻟﻣﺧﺗﺹ ﺑﻳﻥ ﺯﻣﻼﺋﻪ ﻓﻲ ﺍﻟﺷﻌﺏ ﺍﻷﺧﺭﻯ‬
‫ﻟﻭﺿﻊ ﺗﺻﻣﻳﻣﺎﺕ ﺑﺄﺟﺭ ﻳﺗﻘﺎﺿﺎﻩ ﻣﻥ ﻋﺿﻭ ﺍﻟﺷﻌﺑﺔ ﺍﻟﻣﺩﻧﻳﺔ ﺑﺎﺗﻔﺎﻕ‬
‫ﻓﻳﻬﺎ ﺑﻳﻧﻬﻡ ﻭﻳﻛﻭﻥ ﻫﺫﺍ ﺍﻻﺗﻔﺎﻕ ﻗﺑﻝ ﺍﻟﺷﺭﻭﻉ ﻓﻲ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﺃﻥ‬
‫ﻳﻛﻭﻥ ﻋﺿﻭ ﺍﻟﺷﻌﺑﺔ ﺍﻟﻣﺩﻧﻳﺔ ﺍﻷﺻﻠﻲ ﻫﻭ ﺍﻟﻣﺳﺋﻭﻝ ﺃﻣﺎﻡ ﺻﺎﺣﺏ‬
‫ﺍﻟﻌﻣﻝ‪.‬‬
‫ﻣﺴﻮﺩﺓ ﺍﻟﻨﺺ ﺍﻟﻤﻘﺘﺮﺡ ﻟﻼﺋﺤﺔ ﺁﺩﺍﺏ ﻣﻬﻨﺔ ﺍﻟﻬﻨﺪﺳﺔ‬

‫ﻭﺍﻟﻣﻬﺎﺭﺓ ﺍﻟﻣﻬﻧﻳﺔ‪ ،‬ﻭﺍﻟﻣﺑﺎﺩﺉ ﺍﻷﺧﻼﻗﻳﺔ ﻳﺟﺏ ﺗﻁﺑﻳﻘﻬﺎ ﻓﻲ ﺟﻣﻳﻊ‬
‫ﺃﻧﺷﻁﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪ .‬ﻭﻫﺫﻩ ﺍﻟﻼﺋﺣﺔ ﺗﺣﺩﺩ ﺍﻟﻣﺳﺋﻭﻟﻳﺎﺕ ﺗﺟﺎﻩ ﺍﻟﻭﻁﻥ‬
‫ﻭﺍﻟﺟﻣﻬﻭﺭ ﺍﻟﺫﻱ ﺗﺧﺩﻣﻪ ﺍﻟﻣﻬﻧﺔ‪ ،‬ﻭﺗﺟﺎﻩ ﺍﻟﻌﻣﻼء ﻭﻣﺳﺗﺧﺩﻣﻲ‬
‫ﺍﻟﺧﺑﺭﺍﺕ ﺍﻟﻬﻧﺩﺳﻳﺔ ﻭﻛﺫﻟﻙ ﺗﺟﺎﻩ ﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﺔ‪ .‬ﻭﻫﺫﻩ ﺍﻟﻼﺋﺣﺔ‬
‫ﻭﻗﻭﺍﻋﺩﻫﺎ ﻣﺳﺗﻣﺩﺓ ﻣﻥ ﺍﻟﻘﻳﻡ ﺍﻟﻌﻠﻳﺎ ﻟﻠﺣﺿﺎﺭﺓ ﺑﻣﺎ ﻓﻳﻬﺎ ﻣﻥ ﺗﺭﺍﺙ‬
‫ﻓﻛﺭﻱ ﻭﺗﺭﺍﻛﻣﺎﺕ ﻣﻌﺭﻓﻳﺔ ﻭﺇﺑﺩﺍﻋﻳﺔ ﻅﻬﺭﺕ ﻓﻲ ﺍﻟﻣﺟﺗﻣﻊ ﺍﻟﻣﺻﺭﻱ‪.‬‬
‫ﻭﺍﻟﻬﺩﻑ ﻣﻥ ﻫﺫﻩ ﺍﻟﻼﺋﺣﺔ ﻫﻭ ﺃﻥ ﻳﻠﺗﺯﻡ ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺑﺄﺻﻭﻝ ﺍﻟﻌﻣﻝ‬
‫ﺍﻟﺟﺎﺩ ﺣﺗﻰ ﺗﻛﻭﻥ ﺇﺳﻬﺎﻣﺎﺗﻬﻡ ﻓﻲ ﺗﻌﻣﻳﺭ ﺍﻷﺭﺽ ﻭﺣﺳﻥ ﺍﻟﺧﻼﻓﺔ‬
‫ﻓﻳﻬﺎ ﻣﺅﺛﺭﺓ ﻭﺑﻧﺎءﺓ‪.‬‬
‫ﻭﺗﺗﻛﻭﻥ ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ ﻣﻥ ﺛﻼﺙ ﻣﺳﺗﻭﻳﺎﺕ ﻣﺗﺩﺭﺟﺔ ﻫﻲ ‪:‬‬

‫ﻗﻭﺍﻋﺩ ﺍﻟﺳﻠﻭﻙ‪:‬ﻫﻲ ﻗﻭﺍﻋﺩﺇﻟﺯﺍﻣﻳﺔ ﺗﻌﺭﺽ ﻣﻥ ﻳﺧﺎﻟﻔﻬﺎ ﺇﻟﻰ ﺇﺟﺭﺍء‬


‫ﺗﺄﺩﻳﺑﻲ ﻣﻥ ﺟﺎﻧﺏ ﺍﻟﻧﻘﺎﺑﺔ‪.‬‬
‫ﺍﻟﻘﺎﻋﺩﺓ ﺍﻷﻭﻟﻰ ‪ :‬ﺃﺣﻛﺎﻡ ﻋﺎﻣﺔ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻥ ﻳﺣﺎﻓﻅﻭﺍ ﻋﻠﻰ ﻣﻌﺭﻓﺗﻬﻡ ﻭﺧﺑﺭﺍﺗﻬﻡ ﺍﻟﻬﻧﺩﺳﻳﺔ ﻭﺃﻥ ﻳﺭﺗﻘﻭﺍ‬
‫ﺑﻬﺎ‪ ،‬ﻭﺃﻥ ﻳﺣﺗﺭﻣﻭﺍ ﺍﻵﺭﺍء ﺍﻟﻣﻭﺿﻭﻋﻳﺔ ﺍﻟﺗﻲ ﺗﺻﺩﺭ ﻋﻥ ﻋﻠﻡ ﻭﻣﻣﻥ ﻳﻣﺎﺭﺳﻭﻥ‬
‫ﺍﻟﻣﻬﻧﺔ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(١/١‬ﺍﻟﻣﻌﺭﻓﺔ ﻭﺍﻟﺧﺑﺭﺓ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻥ ﻳﺳﻌﻭﺍ ﺇﻟﻰ ﺍﻻﺭﺗﻘﺎء ﺑﻣﻌﺭﻓﺗﻬﻡ ﻭﻣﻬﺎﺭﺍﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ ﻭﺭﻓﻊ‬
‫ﻣﺳﺗﻭﻯ ﺍﻟﻣﻬﻧﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(١/١/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﻋﻧﺩ ﻣﻣﺎﺭﺳﺗﻬﻡ ﻟﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﺔ‪،‬‬


‫ﺃﻥ ﻳﻌﻣﻠﻭﺍ ﺑﻧﻣﻁ ﺛﺎﺑﺕ ﻭﻣﺗﻣﻳﺯ ﻓﻳﻪ ﻋﻧﺎﻳﺔ ﻛﺎﻣﻠﺔ ﺑﺎﻟﻌﻣﻝ ﻭﺍﻗﺗﺩﺍﺭ‪ ،‬ﻛﻣﺎ ﻳﺟﺏ ﻋﻠﻳﻬﻡ‬
‫ﺃﻥ ﻳﺳﺗﺧﺩﻣﻭﺍ ﻣﺳﺗﻭﻯ ﺍﻟﺧﺑﺭﺓ ﻭﺍﻟﻣﻬﺎﺭﺓ ﺍﻟﻔﻧﻳﺔ ﺍﻟﺗﻲ ﻳﺳﺗﺧﺩﻣﻬﺎ ﻋﺎﺩﺓ‬
‫ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﻓﻲ ﻣﺟﺎﻟﻬﻡ‪ .‬ﻭﺇﺫﺍ ﻟﻡ ﻳﻠﺗﺯﻡ ﺍﻟﻣﻬﻧﺩﺱ ﺑﻬﺫﺍ ﺍﻟﻣﺳﺗﻭﻯ ﺍﻟﻣﻁﻠﻭﺏ‬
‫ﺑﺻﻭﺭﺓ ﻣﺗﻛﺭﺭﺓ ﻳﻌﺭﺽ ﻧﻔﺳﻪ ﻟﻠﻣﺳﺎءﻟﺔ ﺍﻟﺗﺄﺩﻳﺑﻳﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(١/١/٢‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻻ ﻳﻘﻭﻣﻭﺍ ﺑﺗﻘﺩﻳﻡ ﺧﺩﻣﺎﺕ ﻣﻬﻧﻳﺔ‬


‫ﺇﺫﺍ ﻛﺎﻧﺕ ﻫﻧﺎﻙ ﺃﺳﺑﺎﺏ ﻭﺟﻳﻬﺔ ﺗﻣﻧﻌﻬﻡ ﻣﻥ ﺃﺩﺍء ﻭﺍﺟﺑﺎﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ ﺑﻛﻔﺎءﺓ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(١/٢‬ﻣﻌﺎﻳﻳﺭ ﺍﻟﺗﻣﻳﺯ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺟﻣﻳﻊ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﺳﻌﻭﺍ ﺑﺻﻭﺭﺓ ﻣﺳﺗﻣﺭﺓ ﺇﻟﻰ ﺍﻻﺭﺗﻘﺎء‬
‫ﺑﻣﺳﺗﻭﻯ ﺍﻟﺗﻣﻳﺯ ﺍﻟﻬﻧﺩﺳﻲ ﻭﻣﺳﺋﻭﻟﻳﺎﺕ ﻭﺣﺩﻭﺩ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﻋﻠﻰ‬
‫ﺍﺧﺗﻼﻑ ﺗﺧﺻﺻﺎﺗﻬﻡ‪.‬‬

‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻥ ﻳﻌﻣﻠﻭﺍ ﻋﻠﻰ ﺍﻻﺭﺗﻘﺎء ﺑﺗﺫﻭﻕ ﺍﻟﺟﻣﻬﻭﺭ ﻭﺗﻔﻬﻣﻪ‬
‫ﻟﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﺔ‪ ،‬ﻭﻛﺫﻟﻙ ﻭﻅﺎﺋﻑ ﻭﻣﺳﺋﻭﻟﻳﺎﺕ ﻭﺣﺩﻭﺩ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﻋﻠﻰ‬

‫ﺍﻟﺻﺎﻟﺢ ﺍﻟﻌﺎﻡ ﻭﺳﻼﻣﺔ ﺍﻟﻣﺟﺗﻣﻊ ﻭﺣﺳﻥ ﺍﺳﺗﻐﻼﻝ ﺍﻟﺛﺭﻭﺓ ﺍﻟﻘﻭﻣﻳﺔ‪ .‬ﻭﺃﻥ‬
‫ﻳﻘﺩﻡ ﻣﺻﻠﺣﺔ ﺍﻟﻭﻁﻥ ﻭﺍﻟﻣﺟﺗﻣﻊ ﻋﻠﻰ ﺃﻳﺔ ﻣﺻﻠﺣﺔ ﺃﺧﺭﻯ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪:(٢/٢‬ﺍﻟﺣﻔﺎﻅ ﻋﻠﻰ ﺍﻟﺗﺭﺍﺙ ﺍﻟﻭﻁﻧﻲ ﻭﺍﻟﺛﻘﺎﻓﻲ ﻭﺍﻟﺩﻳﻧﻲ‪:‬‬


‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﺣﺗﺭﻣﻭﺍ ﺗﺭﺍﺛﻬﻡ ﺍﻟﻭﻁﻧﻲ ﻭﺍﻟﺩﻳﻧﻲ ﻭﺍﻟﺛﻘﺎﻓﻲ‬

‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻋﺿﺎء ﺍﻟﻧﻘﺎﺑﺔ ﺍﻻﺷﺗﺭﺍﻙ ﻓﻲ ﺍﻷﻧﺷﻁﺔ ﺍﻟﻌﺎﻣﺔ‬
‫ﻛﻣﻭﺍﻁﻧﻳﻥ ﻣﺯﺍﻭﻟﻳﻥ ﻟﻠﻣﻬﻧﺔ ﻭﺍﻟﻌﻣﻝ ﻋﻠﻰ ﻧﺷﺭ ﺍﻟﻭﻋﻲ ﺍﻟﻬﻧﺩﺳﻲ ﺑﻳﻥ‬
‫ﺍﻟﺟﻣﻬﻭﺭ‪.‬‬

‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺗﺷﺟﻳﻊ ﺍﻟﻌﻣﻝ ﺍﻟﺫﻱ ﻳﺩﻓﻊ ﺇﻟﻰ ﺍﻻﺑﺗﻛﺎﺭ ﻭﺍﻟﺗﺟﺩﻳﺩ‬
‫ﺩﻭﻥ ﺗﻘﻳﻳﺩ ﺣﺭﻳﺔ ﺗﻌﺑﻳﺭﻫﻡ ﺍﻟﻣﻬﻧﻲ ﻭﺍﻟﻔﻧﻲ ﻭﺩﻭﻥ ﺍﻹﺧﻼﻝ ﺑﺎﻟﻣﺑﺎﺩﺉ‬
‫ﺍﻟﻌﺎﻣﺔ ﺃﻭ ﺍﻟﻘﻭﺍﻧﻳﻥ ﺃﻭ ﺍﻟﻠﻭﺍﺋﺢ ﺃﻭﺍﻟﻘﻳﻡ ﺍﻟﺻﺣﻳﺣﺔ ﺍﻟﺳﺎﺋﺩﺓ ﻓﻲ ﺍﻟﻣﺟﺗﻣﻊ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٢/٥‬ﺍﻟﺧﺩﻣﺎﺕ ﻣﻥ ﺃﺟﻝ ﺍﻟﻣﺻﻠﺣﺔ ﺍﻟﻌﺎﻣﺔ‪:‬‬


‫ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻋﺿﺎء ﺍﻟﻧﻘﺎﺑﺔ ﺃﻥ ﻳﻘﺩﻣﻭﺍ ﺧﺩﻣﺎﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ ﻣﻥ ﺃﺟﻝ‬
‫ﺍﻟﻣﺻﻠﺣﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻸﻣﺔ ﻭﺃﻥ ﻳﺷﺟﻌﻭﺍ ﺯﻣﻼءﻫﻡ ﻋﻠﻰ ﺗﻘﺩﻳﻡ ﻣﺛﻝ ﻫﺫﻩ‬
‫ﺍﻟﺧﺩﻣﺎﺕ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٢/٦‬ﺣﻘﻭﻕ ﺍﻹﻧﺳﺎﻥ‪:‬‬
‫ﻳﺟﺏ ﺃﻥ ﻳﺗﺳﻡ ﺍﻟﺳﻠﻭﻙ ﺍﻟﻣﻬﻧﻲ ﻟﻠﻣﻬﻧﺩﺳﻳﻥ ﺃﻋﺿﺎء ﺍﻟﻧﻘﺎﺑﺔ ﻓﻲ ﻣﺟﻣﻠﻪ ﺑﺈﻋﻼء ﺷﺄﻥ‬
‫ﺣﻘﻭﻕ ﺍﻹﻧﺳﺎﻥ ﻭﺃﻻ ﻳﻔﺭﻗﻭﺍ ﺑﻳﻥ ﺍﻟﻣﺗﻌﺎﻣﻠﻳﻥ ﻣﻌﻬﻡ ﻋﻠﻰ ﺃﺳﺎﺱ ﺍﻷﺻﻝ ﻭﺍﻟﺩﻳﻥ ﻭﺍﻟﺟﻧﺱ‬
‫ﺃﻭ ﺍﻟﺳﻥ ﺃﻭ ﺍﻹﻋﺎﻗﺔ ﺍﻟﺑﺩﻧﻳﺔ ﺃﻭ ﺍﻟﻌﻘﻠﻳﺔ ﻭﻫﺫﻩ ﺍﻟﻘﺎﻋﺩﺓ ﺗﺷﻣﻝ ﻛﺎﻓﺔ ﺍﻷﻧﺷﻁﺔ ﺍﻟﻣﻬﻧﻳﺔ‪،‬‬
‫ﻭﻣﻥ ﺑﻳﻧﻬﺎ ﺍﻟﺗﻌﺎﻣﻝ ﻣﻊ ﺍﻟﻌﻣﻼء ﻭﺍﻟﺯﻣﻼء ﻭﺍﻟﻣﻭﻅﻔﻳﻥ ﻟﺩﻯ ﺍﻟﻣﻬﻧﺩﺱ ﻭﺍﻟﺗﻌﺎﻣﻝ ﻣﻊ‬
‫ﺍﻟﻛﺎﻓﺔ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٢/٧‬ﺍﻟﺳﻠﻭﻙ‪:‬‬


‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻻﻟﺗﺯﺍﻡ ﺑﺭﻭﺡ ﻭﻧﺹ ﻗﺎﻧﻭﻥ ﺍﻟﻧﻘﺎﺑﺔ ﻭﻻﺋﺣﺔ ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ‪،‬‬
‫ﻭﻳﺟﺏ ﻋﻠﻳﻬﻡ ﻣﺭﺍﻋﺎﺓ ﺍﻵﺛﺎﺭ ﺍﻻﺟﺗﻣﺎﻋﻳﺔ ﻭﺍﻟﺑﻳﺋﻳﺔ ﺍﻟﻣﺗﺭﺗﺑﺔ ﻋﻠﻰ ﻣﺯﺍﻭﻟﺗﻬﻡ ﻟﻣﻬﻧﺗﻬﻡ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٢/٧/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﻠﺗﺯﻣﻭﺍ ﺑﺎﻟﻘﺎﻧﻭﻥ ﻓﻲ ﺃﺛﻧﺎء‬


‫ﻣﺯﺍﻭﻟﺔ ﺃﻧﺷﻁﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪ .‬ﻭﺇﻥ ﺍﻧﺗﻬﺎﻙ ﺃﻱ ﻗﺎﻧﻭﻥ ﻓﻲ ﺃﺛﻧﺎء ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺩﺱ ﻟﻠﻣﻬﻧﺔ‪،‬‬
‫ﺳﻭﺍء ﻛﺎﻥ ﻫﺫﺍ ﺍﻟﻘﺎﻧﻭﻥ ﻋﺎﻣﺎ ً ﺃﻭ ﻗﺎﻧﻭﻥ ﺍﻟﻧﻘﺎﺑﺔ ﺳﻳﻌﺭﺽ ﺍﻟﻣﻬﻧﺩﺱ ﻟﻠﻣﺳﺎءﻟﺔ ﺍﻟﺗﺄﺩﻳﺑﻳﺔ‬
‫ﺑﻣﻘﺗﺿﻰ ﻫﺫﻩ ﺍﻟﻘﺎﻋﺩﺓ‪ ،‬ﻭﺍﻹﺩﻋﺎء ﺑﻣﺧﺎﻟﻔﺔ ﻫﺫﻩ ﺍﻟﻘﻭﺍﻋﺩ ﻳﺟﺏ ﺃﻥ ﻳﺳﺗﻧﺩ ﻋﻠﻰ ﻗﺭﺍﺭ‬
‫ﻣﺳﺗﻘﻝ ﺗﺻﺩﺭﻩ ﺍﻟﻣﺣﻛﻣﺔ ﺫﺍﺕ ﺍﻻﺧﺗﺻﺎﺹ ﺃﻭ ﺍﻟﺟﻬﺔ ﺍﻹﺩﺍﺭﻳﺔ ﺃﻭ ﺍﻟﺗﻧﻅﻳﻣﻳﺔ ﺗﺛﺑﺕ ﻓﻳﻪ‬
‫ﻭﻗﻭﻉ ﻣﺧﺎﻟﻔﺔ ﺍﻟﻘﺎﻧﻭﻥ ﺃﻭ ﻟﻭﺍﺋﺣﻪ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٢/٧/٢‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﻘﺩﻣﻭﺍ ﺃﻭ‬
‫ﻳﻌﺭﺿﻭﺍ ﺗﻘﺩﻳﻡ ﺃﻱ ﻣﺑﻠﻎ ﻣﺎﻟﻲ ﺃﻭ ﻫﺩﻳﺔ ﺇﻟﻰ ﺃﻱ ﻣﺳﺋﻭﻝ ﻋﻠﻰ ﺃﻱ‬
‫ﻣﺳﺗﻭﻯ ﺑﻧﻳﺔ ﺍﻟﺗﺄﺛﻳﺭ ﻋﻠﻰ ﻗﺭﺍﺭ ﺍﻟﻣﺳﺋﻭﻝ ﺑﺷﺄﻥ ﺃﻱ ﻣﺷﺭﻭﻉ ﻟﻬﻡ ﻓﻳﻪ‬
‫ﻣﺻﻠﺣﺔ‪ ،‬ﺳﻭﺍء ﻛﺎﻥ ﻫﺫﺍ ﺍﻟﻣﺷﺭﻭﻉ ﻗﺎﺋﻣﺎ ً ﺑﺎﻟﻔﻌﻝ ﺃﻭ ﻳﻧﺗﻅﺭ ﺇﻗﺎﻣﺗﻪ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٢/٧/٣‬ﻳﺣﻅﺭ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﺫﻳﻥ ﻳﺯﺍﻭﻟﻭﻥ‬


‫ﺍﻟﻣﻬﻧﺔ ﺑﺻﻔﺗﻬﻡ ﺍﻟﻌﺎﻣﺔ ﻗﺑﻭﻝ ﺃﻱ ﻣﺑﺎﻟﻎ ﺃﻭ ﻫﺩﺍﻳﺎ ﻳﻘﺻﺩ ﺑﻬﺎ ﺍﻟﺗﺄﺛﻳﺭ ﻋﻠﻰ‬
‫ﻗﺭﺍﺭﺍﺗﻬﻡ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٢/٧/٤‬ﻳﺣﻅﺭ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺇﻧﺗﻬﺎﺝ ﻣﺳﻠﻙ ﺃﻭ‬


‫ﺃﺳﻠﻭﺏ ﻳﻧﻁﻭﻱ ﻋﻠﻰ ﺗﺩﻟﻳﺱ ﺃﻭ ﺇﺳﺎءﺓ ﻣﺗﻌﻣﺩﺓ ﻟﻠﻐﻳﺭ‪ ،‬ﻭﺇﻥ ﺃﻱ ﺗﺻﺭﻑ‬
‫ﻟﻠﻣﻬﻧﺩﺱ ﻳﺣﻭﻝ ﺩﻭﻥ ﻗﻳﺎﻣﻪ ﺑﺎﻟﻣﻬﺎﻡ ﺍﻟﺗﻲ ﺍﺅﺗﻣﻥ ﻋﻠﻳﻬﺎ ﻳﻌﺭﺿﻪ‬
‫ﻟﻠﻣﺳﺎءﻟﺔ ﺣﺗﻰ ﻭﻟﻭ ﻟﻡ ﻳﺻﺩﺭ ﻫﺫﺍ ﺍﻟﺗﺻﺭﻑ ﻓﻲ ﺃﺛﻧﺎء ﻗﻳﺎﻣﻪ ﺑﻣﺯﺍﻭﻟﺔ‬
‫ﺍﻟﻣﻬﻧﺔ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٢/٧/٥‬ﺇﺫﺍ ﻋﻠﻡ ﺃﺣﺩ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﺛﻧﺎء ﻣﺯﺍﻭﻟﺗﻪ ﻟﻠﻣﻬﻧﺔ‬
‫ﻓﻲ ﺃﺣﺩ ﺍﻟﻣﺷﺭﻭﻋﺎﺕ ﺃﻥ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﻗﺩ ﺃﺗﺧﺫ ﻗﺭﺍﺭﺍ ً ﻣﺧﺎﻟﻔﺎ ً ﻟﻠﺭﺃﻱ ﺍﻟﻔﻧﻲ‬
‫ﻭﻳﻌﺭﺽ ﺳﻼﻣﺔ ﺍﻟﻣﺷﺭﻭﻉ ﻟﻠﺧﻁﺭ ﻓﺈﻥ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺃﻥ ﻳﻧﺻﺢ ﺻﺎﺣﺏ‬
‫ﺍﻟﻌﻣﻝ ﺑﺎﻟﻌﺩﻭﻝ ﻋﻥ ﻫﺫﺍ ﺍﻟﻘﺭﺍﺭ ﻓﺈﻥ ﻟﻡ ﻳﻘﺑﻝ ﻓﻌﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺃﻥ ﻳﺭﻓﺽ‬
‫ﺍﻹﻧﺻﻳﺎﻉ ﻟﻠﻘﺭﺍﺭ‪ ،‬ﻭﺃﻥ ﻳﺑﻠﻎ ﺍﻟﻣﺳﺋﻭﻝ ﺍﻟﺫﻱ ﻳﺗﻭﻟﻰ ﺗﻁﺑﻳﻖ ﺍﻟﻘﻭﺍﻧﻳﻥ ﻭﺍﻟﻠﻭﺍﺋﺢ‬
‫ﺍﻟﻣﻌﻣﻭﻝ ﺑﻬﺎ ﻭﺍﻟﻧﻘﺎﺑﺔ ﺑﺫﻟﻙ ﺣﺗﻰ ﻳﻧﻔﻲ ﻣﺳﺋﻭﻟﻳﺗﻪ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٢/٧/٦‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩ ﺳﻳﻥ ﺃﻻ ﻳﻘﺩﻣﻭﺍ ﺍﺳﺗﺷﺎﺭﺗﻬﻡ‬


‫ﺍﻟﻔﻧﻳﺔ ﺃﻭ ﻳﺳﺎﻋﺩﻭﺍ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﺑﺄﻱ ﺷﻛﻝ ﻋﻠﻰ ﺗﺻﺭﻑ ﻳﻌﻠﻣﻭﻥ ﺑﺻﻔﺗﻬﻡ‬
‫ﻣﻬﻧﺩﺳﻳﻥ ﺃﻧﻪ ﻏﻳﺭ ﻣﺷﺭﻭﻉ ﺃﻭ ﻳﻧﻁﻭﻱ ﻋﻠﻰ ﺗﺩﻟﻳﺱ‪.‬‬

‫ﺑﺈﻟﻘﺎء ﺃﺣﺎﺩﻳﺙ ﻋﻠﻰ ﺍﻟﺟﻣﻬﻭﺭ ﺗﺗﻧﺎﻭﻝ ﻣﻭﺿﻭﻋﺎﺕ ﻫﻧﺩﺳﻳﺔ ﺃﻥ ﻳﻭﺿﺣﻭﺍ ﻣﺎ‬
‫ﺇﺫﺍ ﻛﺎﻧﻭﺍ ﻳﺗﻘﺎﺿﻭﻥ ﻋﻠﻳﻪ ﻣﻘﺎﺑﻼً ﻣﺎﺩﻳﺎ ً ﺃﻭ ﻣﺎ ﺇﺫﺍ ﻛﺎﻥ ﻟﺩﻳﻬﻡ ﻣﺻﻠﺣﺔ‬
‫ﺷﺧﺻﻳﺔ ﻓﻳﻬﺎ‪.‬‬
‫ﺍﻟﻘﺎﻋﺩﺓ ﺍﻟﺛﺎﻟﺛﺔ ‪ :‬ﺍﻻﻟﺗﺯﺍﻣﺎﺕ ﺗﺟﺎﻩ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﻭﺍﻟﻣﻬﻧﺔ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻥ ﻳﻠﺗﺯﻣﻭﺍ ﺑﺎﻟﻧﺯﺍﻫﺔ ﺍﻟﻣﻁﻠﻭﺑﺔ ﻓﻲ ﺍﻟﻣﻬﻧﺔ ﻭﺃﻥ ﻳﺣﺎﻓﻅﻭﺍ ﻋﻠﻰ‬
‫ﻛﺭﺍﻣﺗﻬﺎ‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/١‬ﺍﻟﻧﺯﺍﻫﺔ ﻭﺍﻟﻌﺩﺍﻟﺔ‪:‬‬


‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﺗﻭﺧﻭﺍ ﺍﻟﻧﺯﺍﻫﺔ ﻭﺍﻟﻌﺩﺍﻟﺔ ﻓﻲ ﻣﻣﺎﺭﺳﺗﻬﻡ ﻷﻧﺷﻁﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﻠﺗﺯﻣﻭﺍ ﺑﻘﻭﺍﻧﻳﻥ ﺍﻟﺗﺳﺟﻳﻝ ﻭﺍﻟﻠﻭﺍﺋﺢ‬


‫ﺍﻟﺗﻲ ﺗﺣﻛﻡ ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/٢‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﺩﻟﻭﺍ ﺑﺑﻳﺎﻧﺎﺕ ﻛﺎﺫﺑﺔ ﺃﻭ ﻳﻐﻔﻠﻭﺍ‬


‫ﺍﻹﻓﺻﺎﺡ ﻋﻥ ﺣﻘﺎﺋﻖ ﺗﺗﻌﻠﻖ ﺑﺗﻘﺩﻣﻬﻡ ﻟﻠﺗﺳﺟﻳﻝ ﻟﻌﺿﻭﻳﺔ ﺍﻟﻧﻘﺎﺑﺔ ﺃﻭ ﺍﻟﺣﺻﻭﻝ ﻋﻠﻰ ﻗﻳﺩ‬
‫ﻣﻬﻧﺩﺱ ﺍﺳﺗﺷﺎﺭﻱ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/٣‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﺳﺎﻋﺩﻭﺍ ﺃﺣﺩﺍ ً ﻓﻲ ﺍﻟﺗﻘﺩﻡ ﻟﻠﺗﺳﺟﻳﻝ‬


‫ﻟﻌﺿﻭﻳﺔ ﺍﻟﻧﻘﺎﺑﺔ ﺃﻭ ﺍﻟﺣﺻﻭﻝ ﻋﻠﻰ ﻗﻳﺩ ﻣﻬﻧﺩﺱ ﺍﺳﺗﺷﺎﺭﻱ ﻭﻫﻡ ﻳﻌﻠﻣﻭﻥ ﺃﻥ ﻫﺫﺍ ﺍﻟﺷﺧﺹ‬
‫ﻏﻳﺭ ﻣﺅﻫﻝ ﻟﺫﻟﻙ ﻣﻥ ﺣﻳﺙ ﺍﻟﺩﺭﺟﺔ ﺍﻟﻌﻠﻣﻳﺔ ﺃﻭ ﺍﻟﺗﺩﺭﻳﺏ ﺃﻭ ﺍﻟﺧﺑﺭﺓ‪.‬‬

‫ﺃﻛﻳﺩﺓ ﺃﻥ ﺃﺣﺩ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﻗﺩ ﺍﺭﺗﻛﺏ ﻣﺧﺎﻟﻔﺔ ﻟﻬﺫﻩ ﺍﻟﻼﺋﺣﺔ ﺃﻭ ﻣﺎ ﻳﺛﻳﺭ ﺍﻟﺷﻙ‬
‫ﺑﺷﺄﻥ ﻧﺯﺍﻫﺗﻪ ﺃﻭ ﺍﻟﺗﺯﺍﻣﺎﺗﻪ ﺑﻘﺎﻧﻭﻥ ﺍﻟﻧﻘﺎﺑﺔ ﺃﻥ ﻳﺑﻠﻐﻭﺍ ﻟﺟﻧﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ ﻭﻫﻲ‬
‫ﺍﻟﺟﻬﺔ ﺍﻟﻣﻛﻠﻔﺔ ﺑﺗﻁﺑﻳﻖ ﻫﺫﻩ ﺍﻟﻼﺋﺣﺔ ﻓﻲ ﺍﻟﻧﻘﺎﺑﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/٥‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﻘﺑﻠﻭﺍ ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ ﻓﻲ‬


‫ﻋﻣﻝ ﻓﻳﻪ ﻣﺧﺎﻟﻔﺔ ﻟﻠﻣﻭﺍﺻﻔﺎﺕ ﺍﻟﻘﻳﺎﺳﻳﺔ ﻭﺍﻟﻘﻭﺍﻧﻳﻥ ﻭﺍﻷﻧﻅﻣﺔ ﺍﻟﻣﻌﻣﻭﻝ ﺑﻬﺎ‬
‫ﻭﻋﻠﻳﻬﻡ ﺍﻹﻣﺗﻧﺎﻉ ﻋﻥ ﺃﻱ ﺃﻋﻣﺎﻝ ﻻ ﻳﻘﺗﻧﻌﻭﻥ ﺑﺳﻼﻣﺗﻬﺎ ﺃﻭ ﺻﺣﺗﻬﺎ ﺍﻟﻔﻧﻳﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/٦‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﻭﻗﻌﻭﺍ ﺃﻭ ﻳﺧﺗﻣﻭﺍ‬


‫ﺭﺳﻭﻣﺎﺕ ﺃﻭ ﻣﻭﺍﺻﻔﺎﺕ ﺃﻭ ﺗﻘﺎﺭﻳﺭ ﺃﻭ ﺃﻱ ﻭﺛﺎﺋﻖ ﺃﺧﺭﻯ ﺧﺎﺻﺔ ﺑﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ‬
‫ﻻ ﺗﺧﺿﻊ ﻟﺭﻗﺎﺑﺗﻬﻡ ﺍﻹﺷﺭﺍﻓﻳﺔ ﺍﻟﻣﺑﺎﺷﺭﺓ‪ .‬ﻭﻓﻲ ﺣﺎﻟﺔ ﻗﻳﺎﻡ ﺍﻻﺳﺗﺷﺎﺭﻳﻳﻥ ﺑﻣﺳﺎﻋﺩﺓ‬
‫ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺑﺈﻋﺩﺍﺩ ﺃﺟﺯﺍء ﻣﻥ ﺍﻟﻣﺷﺭﻭﻉ ﺃﻭ ﻣﺳﺗﻧﺩﺍﺗﻪ ﻓﻳﺟﺏ ﻋﻠﻳﻬﻡ ﺃﻥ ﻳﻭﻗﻌﻭﺍ‬
‫ﺃﻭ ﻳﺿﻌﻭﺍ ﺧﺗﻣﻬﻡ ﻋﻠﻰ ﻫﺫﻩ ﺍﻷﺟﺯﺍء ﻣﻘﺭﻭﻧﺔ ﺑﺗﻭﻗﻳﻊ ﺃﻭ ﺧﺗﻡ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻷﺻﻠﻲ‪،‬‬
‫ﻭﺑﺫﻟﻙ ﻳﻛﻭﻧﻭﻥ ﻣﺗﺿﺎﻣﻧﻳﻥ ﻓﻲ ﺍﻟﻣﺳﺋﻭﻟﻳﺔ ﻋﻥ ﺳﻼﻣﺔ ﺍﻟﻣﺷﺭﻭﻉ‪ ،‬ﻭﻁﺑﻘﺎ ً ﻟﻬﺫﻩ‬
‫ﺍﻟﻘﺎﻋﺩﺓ ﻓﻼ ﻳﺟﻭﺯ ﻟﻠﻣﻬﻧﺩﺱ ﺃﻥ ﻳﺿﻊ ﺗﻭﻗﻳﻌﻪ ﺃﻭ ﺧﺗﻣﻪ ﻋﻠﻰ ﺃﻱ ﻣﺳﺗﻧﺩ ﺧﺎﺹ‬
‫ﺑﺎﻟﻣﻬﻧﺔ ﻣﺎ ﻟﻡ ﻳﻛﻥ ﻗﺎﺻﺩﺍ ً ﻗﺑﻭﻝ ﺍﻟﻣﺳﺋﻭﻟﻳﺔ ﺍﻟﻣﻬﻧﻳﺔ ﻋﻥ ﺳﻼﻣﺗﻪ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/٨‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺃﻥ ﻳﻘﺩﻡ ﺑﺻﻭﺭﺓ ﺩﻗﻳﻘﺔ‬
‫ﻣﺅﻫﻼﺗﻪ ﻭﻧﻁﺎﻕ ﻣﺳﺋﻭﻟﻳﺎﺗﻪ ﻭﻁﺑﻳﻌﺗﻬﺎ ﻓﻳﻣﺎ ﻳﺗﻌﻠﻖ ﺑﺎﻟﻌﻣﻝ ﺍﻟﺫﻱ ﻳﻧﺳﺑﻪ‬
‫ﻟﻧﻔﺳﻪ ﻭﺃﻻ ﻳﻧﻛﺭ ﺍﻟﻔﺿﻝ ﺍﻟﻣﺳﺗﺣﻖ ﻟﻶﺧﺭﻳﻥ ﺍﻟﺫﻱ ﺷﺎﺭﻛﻭﻩ ﻓﻲ ﺃﻱ‬
‫ﻣﺷﺭﻭﻉ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/١/٩‬ﻻ ﻳﺣﻖ ﻷﻱ ﻣﻬﻧﺩﺱ ﺃﻥ ﻳﺻﻭﺭ ﺃﻭ ﻳﺳﺗﻧﺳﺦ‬


‫ﺃﻋﻣﺎﻻً ﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﺧﺭﻳﻥ ﺑﺩﻭﻥ ﺇﺫﻥ ﻛﺗﺎﺑﻲ ﻣﻧﻬﻡ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/٢‬ﺍﻟﻧﺯﺍﻫﺔ ﻭﺍﻟﺷﺭﻑ‪:‬‬


‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﺳﻌﻭﺍ ﻣﻥ ﺧﻼﻝ ﺃﻋﻣﺎﻟﻬﻡ ﺇﻟﻰ ﺍﻟﺣﻔﺎﻅ ﻋﻠﻰ‬
‫ﺷﺭﻑ ﺍﻟﻣﻬﻧﺔ ﻭﻧﺯﺍﻫﺗﻬﺎ‪ ،‬ﻭﻋﻠﻰ ﺍﻟﺗﺄﻛﺩ ﻣﻥ ﺃﻥ ﻣﻥ ﻳﻣﺛﻠﻭﻧﻬﻡ ﺃﻭ ﻣﻥ‬
‫ﻳﻌﻣﻠﻭﻥ ﻟﺩﻳﻬﻡ ﻳﺄﺗﻲ ﺳﻠﻭﻛﻬﻡ ﻣﺗﻔﻘﺎ ً ﻣﻊ ﻗﻭﺍﻋﺩ "ﻻﺋﺣﺔ ﺃﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ"‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٢/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﺻﺩﺭ ﻋﻧﻬﻡ‬
‫ﻣﻌﻠﻭﻣﺎﺕ ﺑﺷﺄﻥ ﻣﺅﻫﻼﺗﻬﻡ ﺃﻭ ﺧﺑﺭﺍﺗﻬﻡ ﺃﻭ ﺃﺩﺍﺋﻬﻡ ﻣﻥ ﺷﺄﻧﻬﺎ ﺗﺿﻠﻳﻝ‬
‫ﺍﻵﺧﺭﻳﻥ ﺃﻭ ﺧﺩﺍﻋﻬﻡ ﺃﻭ ﺍﻟﻛﺫﺏ ﻋﻠﻳﻬﻡ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٢/٢‬ﻻ ﻳﺟﻭﺯ ﺍﻹﻋﻼﻡ ﻋﻥ ﺍﻟﻧﺷﺎﻁ ﺍﻟﻬﻧﺩﺳﻲ ﺇﻻ‬


‫ﻓﻲ ﺍﻟﺣﺩﻭﺩ ﺍﻟﻣﺗﻌﺎﺭﻑ ﻋﻠﻳﻬﺎ ﻣﻥ ﺗﻘﻭﻳﻡ ﺍﻟﻌﻣﻝ ﺑﻧﺎء ﻋﻠﻰ ﺍﻹﻧﺟﺎﺯﺍﺕ ﻓﻲ‬
‫ﻣﺟﺎﻝ ﺍﻟﻌﻠﻡ ﺍﻟﻬﻧﺩﺳﻲ ﻭﺍﻟﺧﺩﻣﺔ ﻭﺍﻷﺩﺍء ﺍﻟﻣﻬﻧﻲ ﺑﺩﻭﻥ ﺩﻋﺎﻳﺔ ﺃﻭ ﺇﻋﻼﻥ‬
‫ﺃﻭ ﺗﻣﺟﻳﺩ ﺷﺧﺻﻲ ﻳﺿﺭ ﺑﻬﻳﺑﺔ ﺍﻟﻣﻬﻧﺔ ﻭﻛﺭﺍﻣﺗﻬﺎ ﺃﻭ ﻳﺿﺭ ﺑﺎﻟﻐﻳﺭ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٢/٣‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﻘﻭﻣﻭﺍ ﺑﺄﻋﻣﺎﻝ‬


‫ﺗﺗﻧﺎﻓﻰ ﻣﻊ ﻛﺭﺍﻣﺔ ﺍﻟﻌﻣﻝ ﺍﻟﻬﻧﺩﺳﻲ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٢/٤‬ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﺗﺄﻛﺩﻭﺍ ﺃﻥ ﺍﻟﺫﻳﻥ‬


‫ﻳﺧﺿﻌﻭﻥ ﻟﺳﻠﻁﺗﻬﻡ ﺍﻹﺷﺭﺍﻓﻳﺔ ﻳﺗﻔﻖ ﺳﻠﻭﻛﻬﻡ ﻣﻊ "ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ"‬
‫ﻭﺃﻥ ﻳﻠﻔﺗﻭﺍ ﻧﻅﺭﻫﻡ ﺣﺎﻟﺔ ﺣﺩﻭﺙ ﺃﺣﺩ ﺍﻟﻣﻭﺍﻗﻑ ﺍﻟﺗﻲ ﻣﻥ ﺷﺄﻧﻬﺎ ﺃﻥ ﺗﺅﺩﻱ‬
‫ﺇﻟﻰ ﻭﻗﻭﻉ ﻣﺧﺎﻟﻔﺔ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/٣‬ﺩﻋﻡ ﺍﻟﻣﻧﻅﻣﺎﺕ ﻭﺍﻟﺟﻣﻌﻳﺎﺕ ﺍﻟﻬﻧﺩﺳﻳﺔ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﺩﻋﻡ ﻛﺎﻓﺔ ﺍﻟﻣﻧﻅﻣﺎﺕ‬
‫ﻭﺍﻟﺟﻣﻌﻳﺎﺕ ﺍﻟﻌﻠﻣﻳﺔ ﺍﻟﻬﻧﺩﺳﻳﺔ ﺑﻁﺭﻳﻖ ﺍﻻﺷﺗﺭﺍﻙ ﺍﻹﻳﺟﺎﺑﻲ ﻓﻳﻬﺎ‬
‫ﻭﺍﻟﻣﺷﺎﺭﻛﺔ ﻓﻲ ﻟﺟﺎﻧﻬﺎ ﻭﻧﺩﻭﺍﺗﻬﺎ ﻭﻣﺅﺗﻣﺭﺍﺗﻬﺎ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/٤‬ﻅﺭﻭﻑ ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ‪:‬‬


‫ﻳﺟﺏ ﺃﻥ ﻳﻭﻓﺭ ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﻟﺯﻣﻼﺋﻬﻡ ﻭﺍﻟﻣﻭﻅﻔﻳﻥ ﺍﻟﺫﻳﻥ ﻳﻌﻣﻠﻭﻥ‬
‫ﻟﺩﻳﻬﻡ ﺍﻟﻅﺭﻭﻑ ﺍﻟﻣﻼﺋﻣﺔ ﻟﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ‪ ،‬ﻭﺃﻥ ﻳﺩﻓﻌﻭﺍ ﻟﻬﻡ ﺃﺟﻭﺭﺍ ً‬
‫ﻣﺟﺯﻳﺔ‪ ،‬ﻭﺃﻥ ﻳﺳﺎﻋﺩﻭﻫﻡ ﻋﻠﻰ ﺍﻻﺭﺗﻘﺎء ﺑﻣﺳﺗﻭﺍﻫﻡ ﻓﻲ ﻣﻣﺎﺭﺳﺔ‬
‫ﺍﻟﻣﻬﻧﺔ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/٥‬ﺍﻻﻋﺗﺭﺍﻑ ﺍﻟﻣﻬﻧﻲ ﺍﻟﻣﺗﺑﺎﺩﻝ‪:‬‬
‫ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﻧﺷﺋﻭﺍ ﺳﻣﻌﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ ﻋﻠﻰ ﻣﺎ ﻗﺩﻣﻭﻩ ﻣﻥ‬
‫ﺇﻧﺟﺎﺯﺍﺕ ﻓﻲ ﻣﺟﺎﻝ ﻋﻣﻠﻬﻡ ﻭﺧﺩﻣﺎﺗﻬﻡ ﻭﺃﺩﺍﺋﻬﻡ ﺍﻟﻣﻬﻧﻲ‪ ،‬ﻛﻣﺎ ﻳﺟﺏ‬
‫ﻋﻠﻳﻬﻡ ﺃﻥ ﻳﻌﺗﺭﻓﻭﺍ ﺑﺎﻹﻧﺟﺎﺯﺍﺕ ﺍﻟﺗﻲ ﻗﺩﻣﻬﺎ ﺍﻵﺧﺭﻭﻥ ﻓﻲ ﻣﺟﺎﻝ‬
‫ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ ﻭﻳﻧﺳﺑﻭﻫﺎ ﺇﻟﻳﻬﻡ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٥/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﻌﺗﺭﻓﻭﺍ‬


‫ﺑﺎﻹﺳﻬﺎﻣﺎﺕ ﺍﻟﻣﻬﻧﻳﺔ ﻟﻣﺭءﻭﺳﻳﻬﻡ ﻭﺭﺅﺳﺎﺋﻬﻡ ﻭﺯﻣﻼﺋﻬﻡ ﻓﻲ‬
‫ﺍﻟﻣﻬﻧﺔ ﻭﺃﻥ ﻳﺣﺗﺭﻣﻭﻫﺎ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٥/٢‬ﻻ ﻳﺟﻭﺯ ﺃﻥ ﻳﻠﺟﺄ ﺃﻱ ﻣﻬﻧﺩﺱ ﺇﻟﻰ‬


‫ﺍﻹﺿﺭﺍﺭ ﺑﻧﺷﺎﻁ ﺃﻭ ﻋﻣﻝ ﺃﻭ ﺳﻣﻌﺔ ﺃﻱ ﺯﻣﻳﻝ ﺁﺧﺭ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٥/٣‬ﻻ ﻳﺳﻣﺢ ﻟﻠﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﺫﻳﻥ ﻳﺗﺭﻛﻭﻥ ﺃﺣﺩ‬
‫ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﺻﺣﺎﺏ ﺍﻟﻌﻣﻝ ﺃﻥ ﻳﺄﺧﺫﻭﺍ ﺩﻭﻥ ﺇﺫﻥ ﺗﺻﻣﻳﻣﺎﺕ ﺃﻭ‬
‫ﺭﺳﻭﻣﺎﺕ ﺃﻭ ﻣﻌﻠﻭﻣﺎﺕ‪ ،‬ﺃﻭ ﺃﻱ ﻣﻭﺍﺩ ﺃﺧﺭﻯ ﺗﺗﻌﻠﻖ ﺑﺎﻟﻌﻣﻝ ﺍﻟﺫﻱ‬
‫ﻛﺎﻧﻭﺍ ﻳﺅﺩﻭﻧﻪ ﻓﻲ ﺧﺩﻣﺔ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٥/٤‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﺃﻻ‬


‫ﻳﻣﺗﻧﻊ )ﺩﻭﻥ ﺳﺑﺏ ﻣﻘﺑﻭﻝ( ﻋﻥ ﻣﻧﺢ ﺍﻟﻣﻭﻅﻔﻳﻥ ﺍﻟﺫﻳﻥ ﺍﻧﺗﻬﺕ ﻣﺩﺓ‬
‫ﺧﺩﻣﺗﻬﻡ ﻟﺩﻳﻪ ﺧﻁﺎﺑﺎ ً "ﻳﻔﻳﺩ ﻣﺎ ﻗﺎﻣﻭﺍ ﺑﻪ ﻣﻥ ﻋﻣﻝ ﻟﺩﻳﻪ" ﺃﻭ ﺇﺫﻧﺎ‬
‫ﻟﻠﺣﺻﻭﻝ ﻋﻠﻰ ﻧﺳﺧﺔ ﻣﻥ ﺍﻟﺗﺻﻣﻳﻣﺎﺕ ﺃﻭ ﺍﻟﺭﺳﻭﻣﺎﺕ ﺃﻭ ﺍﻟﻣﻌﻠﻭﻣﺎﺕ‬
‫ﺃﻭ ﺍﻟﺗﻘﺎﺭﻳﺭ ﺃﻭ ﺃﻱ ﻣﻭﺍﺩ ﺃﺧﺭﻯ ﺗﺗﻌﻠﻖ ﺑﺎﻟﻌﻣﻝ ﺍﻟﺫﻱ ﺷﺎﺭﻛﻭﺍ ﻓﻲ‬
‫ﺃﺩﺍﺋﻪ ﻟﻠﺗﻘﺩﻡ ﺑﻬﺎ ﻟﻠﺣﺻﻭﻝ ﻋﻠﻰ ﻋﻣﻝ ﺁﺧﺭ ﺃﻭ ﻟﻠﺣﺻﻭﻝ ﻋﻠﻰ ﻗﻳﺩ‬
‫ﻣﻬﻧﺩﺱ ﺍﺳﺗﺷﺎﺭﻱ ﻁﺎﻟﻣﺎ ﻛﺎﻥ ﻫﺫﺍ ﺍﻟﻌﻣﻝ ﻻ ﻳﺣﻣﻝ ﻁﺎﺑﻊ ﺍﻟﺳﺭﻳﺔ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/٦‬ﺍﻟﺗﻌﺎﻭﻥ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺃﻥ ﻳﻌﻣﻠﻭﺍ ﻋﻠﻰ ﺍﻟﺗﻛﺎﻣﻝ ﻣﻊ ﺯﻣﻼﺋﻬﻡ ﻣﻥ ﺫﻭﻱ‬
‫ﺍﻟﺗﺧﺻﺻﺎﺕ ﺍﻟﻣﺧﺗﻠﻔﺔ ﻭﺍﻟﺗﻧﺳﻳﻖ ﺍﻟﺟﺩﻱ ﻹﻧﺟﺎﺯ ﻋﻣﻝ ﻫﻧﺩﺳﻲ ﻧﺎﺟﺢ‬
‫ﻭﻣﺗﻛﺎﻣﻝ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٦/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺃﻻ ﻳﺗﻌﺎﻭﻥ ﻣﻊ ﻣﻥ‬


‫ﺗﺛﺑﺕ ﻋﻠﻳﻪ ﻣﺧﺎﻟﻔﺔ ﻗﻭﺍﻧﻳﻥ ﺍﻟﻧﻘﺎﺑﺔ ﻭﻟﻭﺍﺋﺣﻬﺎ ﺃﻭ ﺗﻡ ﺇﻳﻘﺎﻓﻪ ﻋﻥ ﺍﻟﻌﻣﻝ‬
‫ﺍﻟﻬﻧﺩﺳﻲ ﺃﻭ ﺷﻁﺑﻪ ﺑﻣﻌﺭﻓﺔ ﺍﻟﻧﻘﺎﺑﺔ ﻭﻟﺟﺎﻧﻬﺎ‪.‬‬

‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﺳﺎﻋﺩﻭﺍ ﻋﻠﻰ ﺯﻳﺎﺩﺓ ﻓﺎﻋﻠﻳﺔ ﺍﻟﻣﻬﻧﺔ ﻭﺫﻟﻙ‬
‫ﺑﺗﺑﺎﺩﻝ ﺍﻟﻣﻌﻠﻭﻣﺎﺕ ﻭﺍﻟﺧﺑﺭﺍﺕ ﻣﻊ ﺯﻣﻼﺋﻬﻡ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﻣﻥ ﺫﺍﺕ‬
‫ﺍﻟﺗﺧﺻﺹ ﺃﻭ ﻣﻥ ﺍﻟﺗﺧﺻﺻﺎﺕ ﺍﻟﻣﺧﺗﻠﻔﺔ‪ ،‬ﻭﻛﺫﻟﻙ ﻣﻊ ﺍﻟﻬﻳﺋﺎﺕ ﺍﻟﻌﻠﻣﻳﺔ‬
‫ﻭﺍﻟﺻﻧﺎﻋﻳﺔ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٣/٨‬ﺍﺣﺗﺭﺍﻡ ﺍﻟﺯﻣﻼء ﻭﺍﻟﻣﻬﻧﺔ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﺇﻅﻬﺎﺭ ﺍﺣﺗﺭﺍﻣﻬﻡ ﻟﺯﻣﻼﺋﻬﻡ‬
‫ﻭﺍﻟﻣﺣﺎﻓﻅﺔ ﻋﻠﻰ ﻛﺭﺍﻣﺔ ﺍﻟﻣﻬﻧﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٨/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺃﻻ ﻳﻘﺑﻝ ﺃﺗﻌﺎﺑﺎ ً ﺩﻭﻥ‬


‫ﺍﻟﺣﺩ ﺍﻷﺩﻧﻰ ﺍﻟﻣﻘﺭﺭ ﻓﻲ ﻻﺋﺣﺔ ﺗﻘﺩﻳﺭ ﺍﻷﺗﻌﺎﺏ ﺍﻟﻣﻌﺗﻣﺩﺓ ﻣﻥ ﺍﻟﻧﻘﺎﺑﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٨/٢‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﻋﺩﻡ ﺗﻘﺩﻳﻡ ﻋﺭﺽ‬


‫ﻋﻥ ﻋﻣﻝ ﺗﻡ ﺇﺳﻧﺎﺩﻩ ﻟﺯﻣﻳﻝ ﺁﺧﺭ ﺃﻭ ﻓﻲ ﺃﺛﻧﺎء ﺇﺟﺭﺍء ﺍﻟﺗﻌﺎﻗﺩ ﺃﻭ‬
‫ﺍﻟﺗﻔﺎﻭﺽ ﻋﻠﻰ ﺍﻟﺗﻌﺎﻗﺩ ﻣﻌﻪ‪.‬‬

‫ﻗﺩ ﺳﺑﻖ ﻟﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﺍﻟﺗﻌﺎﻗﺩ ﻣﻊ ﻣﻬﻧﺩﺱ ﺁﺧﺭ ﻭﺟﺏ ﺇﺧﻁﺎﺭﻩ‬
‫ﻭﺇﺧﻁﺎﺭ ﺷﻌﺑﺗﻪ ﺑﺎﻟﻧﻘﺎﺑﺔ ﺑﺧﻁﺎﺏ ﻣﻭﺻﻰ ﻋﻠﻳﻪ ﺑﻌﻠﻡ ﺍﻟﻭﺻﻭﻝ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٨/٤‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﺫﻱ ﻳﻁﻠﺏ ﻣﻧﻪ‬
‫ﻣﺭﺍﺟﻌﺔ ﺃﻭ ﻛﺗﺎﺑﺔ ﺗﻘﺭﻳﺭ ﻋﻠﻰ ﺃﻋﻣﺎﻝ ﻟﺯﻣﻳﻝ ﻟﻪ ﺃﻥ ﻳﺧﻁﺭﻩ ﻭﺃﻥ‬
‫ﻳﺧﻁﺭ ﺷﻌﺑﺗﻪ ﺑﺎﻟﻧﻘﺎﺑﺔ ﺑﺧﻁﺎﺏ ﻣﻭﺻﻰ ﻋﻠﻳﻪ ﺑﻌﻠﻡ ﺍﻟﻭﺻﻭﻝ‪.‬‬

‫ﻳﻌﺗﺑﺭ ﺗﻌﺩﻳﻼً ﺃﻭ ﺗﻁﻭﻳﺭﺍ ً ﻛﻠﻳﺎ ﺃﻭ ﺟﺯﺋﻳﺎ ً ﻣﻥ ﻋﻣﻝ ﺯﻣﻳﻝ ﺁﺧﺭ ﻓﻌﻠﻳﻪ‬
‫ﺃﻻ ﻳﻐﻔﻝ ﺩﻭﺭ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻷﺻﻠﻲ ﻭﺃﻥ ﻳﻅﻬﺭﻩ ﺑﺷﻛﻝ ﻻﺋﻖ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٣/٨/٦‬ﻋﻧﺩ ﺣﺩﻭﺙ ﻧﺯﺍﻉ ﻗﺿﺎﺋﻲ ﺣﻭﻝ ﺍﻟﻣﻬﻧﺔ‬


‫ﻳﺟﺏ ﻋﺭﺿﺔ ﺃﻭﻻً ﻋﻠﻰ ﺍﻟﻧﻘﺎﺑﺔ ﻗﺑﻝ ﺍﺗﺧﺎﺫ ﺃﻳﺔ ﺇﺟﺭﺍءﺍﺕ ﻗﺎﻧﻭﻧﻳﺔ‬
‫ﺃﺧﺭﻯ‪.‬‬
‫ﺍﻟﻘﺎﻋﺩﺓ ﺍﻟﺭﺍﺑﻌﺔ‪ :‬ﺍﻟﺗﺯﺍﻣﺎﺕ ﺍﻟﻣﻬﻧﺩﺱ ﺗﺟﺎﻩ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ )ﺍﻟﻌﻣﻳﻝ(‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻥ ﻳﺧﺩﻣﻭﺍ ﻋﻣﻼءﻫﻡ ﺑﻛﻔﺎءﺓ ﻭﻣﻬﺎﺭﺓ‪ ،‬ﻛﻣﺎ ﻳﺟﺏ ﻋﻠﻳﻬﻡ‬
‫ﺃﻥ ﻳﺻﺩﺭﻭﺍ ﻗﺭﺍﺭﺍﺕ ﻏﻳﺭ ﻣﺗﺣﻳﺯﺓ ﻭﻏﻳﺭ ﻣﺗﺣﺎﻣﻠﺔ ﻓﻲ ﺃﺛﻧﺎء ﺃﺩﺍﺋﻬﻡ ﻟﺧﺩﻣﺎﺗﻬﻡ‬
‫ﺍﻟﻣﻬﻧﻳﺔ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٤/١‬ﺍﻟﻛﻔﺎءﺓ‪:‬‬


‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﻘﺩﻣﻭﺍ ﺧﺩﻣﺎﺗﻬﻡ ﺇﻟﻰ ﺃﺻﺣﺎﺏ ﺍﻟﻌﻣﻝ ﻓﻲ ﺍﻟﻣﻭﻋﺩ‬
‫ﺍﻟﻣﺣﺩﺩ ﻭﺑﺄﺳﻠﻭﺏ ﻛﻑء‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/١/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻻ ﻳﺗﻭﻟﻭﺍ ﺗﻘﺩﻡ ﺧﺩﻣﺎﺗﻬﻡ‬


‫ﺍﻟﻣﻬﻧﻳﺔ ﺇﻻ ﺇﺫﺍ ﻛﺎﻧﻭﺍ ﻣﺅﻫﻠﻳﻥ ﺗﻌﻠﻳﻣﻳﺎ ً ﻭﺗﺩﺭﻳﺑﻳﺎ ً ﻭﺫﻭﻱ ﺧﺑﺭﺓ ﻓﻲ ﺍﻟﻣﺟﺎﻻﺕ‬
‫ﺍﻟﻔﻧﻳﺔ ﺍﻟﻣﻁﻠﻭﺏ ﺇﺑﺩﺍء ﺍﻟﺭﺃﻱ ﺍﻟﻔﻧﻲ ﺑﺷﺄﻧﻬﺎ‪ .‬ﻭﺑﺫﻟﻙ ﻻ ﻳﺗﻭﻟﻰ ﺍﻟﻣﻬﻧﺩﺱ ﺍﻟﻘﻳﺎﻡ‬
‫ﺑﻣﺷﺭﻭﻋﺎﺕ ﺗﺗﺟﺎﻭﺯ ﺣﺩﻭﺩ ﺧﺑﺭﺗﻪ ﺍﻟﻣﻬﻧﻳﺔ‪ ،‬ﻭﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺍﻟﺫﻳﻥ ﻳﺭﻏﺑﻭﻥ ﻓﻲ‬
‫ﺍﻟﺩﺧﻭﻝ ﻓﻲ ﻣﺟﺎﻻﺕ ﺗﺗﻁﻠﺏ ﺧﺑﺭﺍﺕ ﻟﻳﺳﺕ ﻟﺩﻳﻬﻡ ﻋﻠﻳﻬﻡ ﺃﻥ ﻳﺣﺻﻠﻭﺍ ﻋﻠﻰ ﻫﺫﻩ‬
‫ﺍﻟﺧﺑﺭﺍﺕ ﻋﻥ ﻁﺭﻳﻖ ﻣﺯﻳﺩ ﻣﻥ ﺍﻟﺗﻌﻠﻳﻡ ﻭﺍﻟﺗﺩﺭﻳﺏ ﺃﻭ ﺍﻻﺳﺗﻌﺎﻧﺔ ﺑﻣﺳﺗﺷﺎﺭﻳﻥ‬
‫ﻟﺩﻳﻬﻡ ﺍﻟﺧﺑﺭﺓ ﺍﻟﻣﻁﻠﻭﺑﺔ‪.‬‬

‫ﺃﺩﺍﺋﻬﻡ ﻟﺧﺩﻣﺎﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ ﺑﻛﺎﻓﺔ ﺍﻟﻘﻭﺍﻧﻳﻥ ﻭﺍﻟﻠﻭﺍﺋﺢ ﺍﻟﺳﺎﺭﻳﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/١/٣‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻷﻋﺿﺎء ﺃﻻ ﻳﻐﻳﺭﻭﺍ ﺑﺻﻭﺭﺓ‬


‫ﻣﺎﺩﻳﺔ ﺃﻫﺩﺍﻑ ﺃﻭ ﺣﺟﻡ ﺍﻟﻣﺷﺭﻭﻉ ﺩﻭﻥ ﻣﻭﺍﻓﻘﺔ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ‪.‬‬

‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٤/٢‬ﺗﻌﺎﺭﺽ ﺍﻟﻣﺻﺎﻟﺢ‪:‬‬


‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻥ ﻳﻁﻠﻌﻭﺍ ﺃﺻﺣﺎﺏ ﺍﻟﻌﻣﻝ ﺃﻭ ﺍﻟﻣﻘﺎﻭﻟﻳﻥ ﺃﻭ‬
‫ﺍﻟﻣﻭﺭﺩﻳﻥ ﻋﻠﻰ ﺃﻳﺔ ﻅﺭﻭﻑ ﻟﺩﻳﻬﻡ ﻳﻣﻛﻥ ﺗﻔﺳﻳﺭﻫﺎ ﻋﻠﻰ ﺃﻧﻬﺎ ﺗﺣﺩﺙ‬
‫ﺗﻌﺎﺭﺿﺎ ً ﻓﻲ ﺍﻟﻣﺻﺎﻟﺢ‪ ،‬ﻛﻣﺎ ﻳﺟﺏ ﻋﻠﻳﻬﻡ ﺃﻥ ﻳﺗﺣﻘﻘﻭﺍ ﻣﻥ ﺃﻥ ﻣﺛﻝ‬
‫ﻫﺫﺍ ﺍﻟﺗﻌﺎﺭﺽ ﻻ ﻳﻌﻭﻕ ﺃﺩﺍء ﻭﺍﺟﺑﻬﻡ ﺍﻟﻣﻬﻧﻲ ﻋﻠﻰ ﺃﻛﻣﻝ ﻭﺟﻪ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/٢/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﺗﻠﻘﻭﺍ ﻣﻘﺎﺑﻼً ﻋﻥ‬
‫ﺧﺩﻣﺎﺗﻬﻡ ﻣﻥ ﺃﻛﺛﺭ ﻣﻥ ﻁﺭﻑ ﻭﺍﺣﺩ ﻓﻲ ﺍﻟﻣﺷﺭﻭﻉ ﻣﺎ ﻟﻡ ﺗﻛﻥ ﻛﻝ ﻫﺫﻩ‬
‫ﺍﻟﻣﻼﺑﺳﺎﺕ ﻣﻌﻠﻧﺔ ﺗﻣﺎﻣﺎ ً ﻭﻣﺗﻔﻖ ﻋﻠﻳﻬﺎ ﻣﻥ ﺟﻣﻳﻊ ﺍﻷﻁﺭﺍﻑ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/٢/٢‬ﺇﺫﺍ ﻛﺎﻥ ﻟﻣﻬﻧﺩﺱ ﻋﻼﻗﺔ ﻋﻣﻝ ﺃﻭ ﻣﺻﻠﺣﺔ‬


‫ﻣﺎﻟﻳﺔ ﻣﺑﺎﺷﺭﺓ )ﺃﻭ ﻏﻳﺭ ﻣﺑﺎﺷﺭﺓ( ﻗﺩ ﺗﺅﺛﺭ ﻋﻠﻰ ﻗﺭﺍﺭﻩ ﺍﻟﻣﻬﻧﻲ ﻓﺈﻥ‬
‫ﻋﻠﻳﻪ ﻓﻲ ﻣﺛﻝ ﻫﺫﻩ ﺍﻟﺣﺎﻟﺔ ﺃﻥ ﻳﻁﻠﻊ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﻁﺑﻳﻌﺔ ﻫﺫﻩ‬
‫ﺍﻟﻌﻼﻗﺔ‪ ،‬ﻭﻓﻲ ﺣﺎﻟﺔ ﺍﻋﺗﺭﺍﺽ ﺻﺎﺣﺏ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﻫﺫﻩ ﺍﻟﻌﻼﻗﺔ ﻓﻌﻠﻰ‬
‫ﺍﻟﻣﻬﻧﺩﺱ ﺃﻥ ﻳﻧﻬﻲ ﺍﻟﻌﻼﻗﺔ ﺃﻭ ﻳﺗﻧﺎﺯﻝ ﻋﻥ ﺗﻛﻠﻳﻔﻪ ﺑﺄﺩﺍء ﺍﻟﻌﻣﻝ‬
‫ﺍﻟﻣﻁﻠﻭﺏ‪.‬‬
‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/٢/٣‬ﻋﻧﺩﻣﺎ ﻳﻛﻭﻥ ﺍﻟﻣﻬﻧﺩﺱ ﻫﻭ ﺍﻟﻣﻔﺳﺭ ﺍﻟﻭﺣﻳﺩ‬
‫)ﻛﺎﺳﺗﺷﺎﺭﻱ ﺃﻭ ﻣﺣﻛﻡ( ﻻﺗﻔﺎﻕ ﺃﻭ ﺗﻌﺎﻗﺩ ﻓﻌﻠﻳﻪ ﺃﻥ ﻳﺻﺩﺭ ﻗﺭﺍﺭﺍﺗﻪ ﻏﻳﺭ‬
‫ﻣﺗﺣﻳﺯﺓ‪ ،‬ﻭﻻ ﺗﻣﻳﻝ ﺇﻟﻰ ﺃﺣﺩ ﺍﻷﻁﺭﺍﻑ‪ ،‬ﻭﺗﺷﻣﻝ ﻫﺫﻩ ﺍﻟﻘﺎﻋﺩﺓ ﺃﺩﺍء‬
‫ﺍﻟﻣﻬﻧﺩﺱ ﻟﻣﺳﺋﻭﻟﻳﺎﺗﻪ ﺍﻟﻣﻬﻧﻳﺔ ﺑﺻﻭﺭﺓ ﻏﻳﺭ ﻣﺗﺣﻳﺯﺓ ﺭﻏﻡ ﺗﻘﺎﺿﻳﻪ‬
‫ﺃﺟﺭﻩ ﻣﻥ ﻣﺎﻟﻙ ﺍﻟﻣﺷﺭﻭﻉ ﻭﻭﻻﺋﻪ ﻟﻪ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٤/٣‬ﺍﻟﺻﺭﺍﺣﺔ ﻭﺍﻟﺻﺩﻕ‪:‬‬
‫ﻳﺟﺏ ﺃﻥ ﻳﺗﺳﻡ ﺍﻟﻣﻬﻧﺩﺳﻭﻥ ﺃﻋﺿﺎء ﺍﻟﻧﻘﺎﺑﺔ ﺍﻟﺻﺭﺍﺣﺔ ﻭﺍﻟﺻﺩﻕ ﻓﻲ ﻛﺎﻓﺔ‬
‫ﻋﻼﻗﺎﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/٣/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﺿﻠﻠﻭﺍ ﺳﻭﺍء‬


‫ﻋﻣﺩﺍ ً ﺃﻭ ﺍﺳﺗﻬﺗﺎﺭﺍ ً ﻋﻣﻼءﻫﻡ ﺍﻟﺣﺎﻟﻳﻳﻥ ﺃﻭ ﺍﻟﻣﻧﺗﻅﺭﻳﻥ ﺑﺷﺄﻥ ﺍﻟﻧﺗﺎﺋﺞ ﺍﻟﺗﻲ‬
‫ﻳﻣﻛﻥ ﺗﺣﻘﻳﻘﻬﺎ ﻣﻥ ﺧﻼﻝ ﺧﺩﻣﺎﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪ ،‬ﻛﻣﺎ ﻳﺟﺏ ﻋﻠﻳﻬﻡ ﺃﻻ ﻳﻌﻠﻧﻭﺍ‬
‫ﺃﻧﻬﻡ ﻳﺳﺗﻁﻳﻌﻭﻥ ﺗﺣﻘﻳﻖ ﻧﺗﺎﺋﺞ ﺑﻭﺳﺎﺋﻝ ﻣﺧﺎﻟﻔﺔ ﻟﻠﻘﻭﺍﻧﻳﻥ ﺍﻟﻣﻌﻣﻭﻝ ﺑﻬﺎ‬
‫ﺃﻭ ﻻﺋﺣﺔ ﻣﺯﺍﻭﻟﺔ ﺍﻟﻣﻬﻧﺔ‪.‬‬

‫ﻣﺷﺎﻛﻝ ﺑﻳﺋﻳﺔ ﻓﻲ ﺃﻱ ﻋﻣﻝ ﻫﻧﺩﺳﻲ ﻣﻭﻛﻝ ﺇﻟﻳﻬﻡ ﺑﻭﺿﻭﺡ ﻭﺻﺭﺍﺣﺔ‬
‫ﻭﺇﺧﻁﺎﺭ ﺍﻟﺟﻬﺎﺕ ﺍﻟﻣﺳﺋﻭﻟﺔ ﺑﺫﻟﻙ ﻭﻋﻠﻳﻬﻡ ﺍﻟﻌﻣﻝ ﻋﻠﻰ ﺇﻳﺟﺎﺩ ﺍﻟﺣﻠﻭﻝ‬
‫ﺍﻟﻔﻧﻳﺔ ﺍﻟﻣﻧﺎﺳﺑﺔ ﻟﻬﺎ‪.‬‬
‫ﺍﻟﻣﻌﻳﺎﺭ ﺍﻷﺧﻼﻗﻲ )‪ :(٤/٤‬ﺍﻟﺳﺭﻳﺔ‪:‬‬
‫ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﺣﺗﺭﺍﻡ ﺳﺭﻳﺔ ﺃﻱ ﻣﻌﻠﻭﻣﺎﺕ ﺧﺎﺻﺔ ﺑﺎﻟﻐﻳﺭ‬
‫ﻳﺣﺻﻠﻭﻥ ﻋﻠﻳﻬﺎ ﻓﻲ ﺃﺛﻧﺎء ﻣﻣﺎﺭﺳﺗﻬﻡ ﻷﻧﺷﻁﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪.‬‬

‫ﻗﺎﻋﺩﺓ ﺍﻟﺳﻠﻭﻙ )‪ :(٤/٤/١‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻻ ﻳﻔﺷﻭﺍ‬


‫ﻣﻌﻠﻭﻣﺎﺕ ﻁﻠﺏ ﻣﻧﻬﻡ ﺍﻻﺣﺗﻔﺎﻅ ﺑﻬﺎ ﺳﺭﺍ‪ ً،‬ﻭﻗﺩ ﺣﺻﻠﻭﺍ ﻋﻠﻳﻬﺎ ﺃﺛﻧﺎء‬
‫ﻣﻣﺎﺭﺳﺗﻬﻡ ﻷﻧﺷﻁﺗﻬﻡ ﺍﻟﻣﻬﻧﻳﺔ‪ ،‬ﺃﻭ ﻳﻌﻠﻣﻭﻥ ﺃﻥ ﺇﻓﺷﺎءﻫﺎ ﻗﺩ ﻳﺅﺛﺭ‬
‫ﻋﻠﻰ ﻣﺻﺎﻟﺢ ﺍﻵﺧﺭﻳﻥ‪ ،‬ﺇﻻ ﻓﻲ ﺍﻟﺣﺎﻻﺕ ﺍﻟﺿﺭﻭﺭﻳﺔ ﺍﻵﺗﻳﺔ‪:‬‬
‫ﺃ‪ -‬ﻭﻗﻑ ﺃﻱ ﺇﺟﺭﺍء ﻣﻥ ﺷﺄﻧﻪ ﺃﻥ ﻳﻧﻁﻭﻱ ﻋﻠﻰ ﺧﻁﺭ ﻣﻠﻣﻭﺱ ﻳﺿﺭ‬
‫ﺑﺻﺣﺔ ﺃﻭ ﺳﻼﻣﺔ ﺍﻵﺧﺭﻳﻥ ﺃﻭ ﻣﻣﺗﻠﻛﺎﺗﻬﻡ‪.‬‬
‫ﺏ‪ -‬ﺇﻗﺎﻣﺔ ﺍﻟﺩﻋﺎﻭﻯ ﻧﻳﺎﺑﺔ ﻋﻥ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻭ ﺍﻟﺩﻓﺎﻉ ﻋﻧﻬﻡ‪.‬‬
‫ﺝ‪ -‬ﺍﻻﻟﺗﺯﺍﻡ ﺑﺎﻟﻘﻭﺍﻧﻳﻥ ﺍﻟﻌﺎﻣﺔ ﻭﻗﻭﺍﻧﻳﻥ ﺍﻟﻧﻘﺎﺑﺔ ﻭﻟﻭﺍﺋﺣﻬﺎ‪.‬‬
‫ﺍﻟﻘﻮﺍﻋﺪ ﺍﻟﺨﺎﺻﺔ ﺑﻮﺿﻊ ﻻﺋﺤﺔ ﺁﺩﺍﺏ ﺍﻟﻤﻬﻨﺔ‬
‫ﻭﻣﺠﺎﻝ ﺍﺧﺘﺼﺎﺻﻬﺎ ﻭﺗﻄﺒﻴﻘﻬﺎ ﻭﺗﻌﺪﻳﻠﻬﺎ‬
‫ﺍﻟﻣﺎﺩﺓ ﺍﻷﻭﻟﻰ‪ :‬ﺇﻥ ﺍﻟﻘﻭﺍﻋﺩ ﺍﻟﻌﺎﻣﺔ ﻟﻸﺧﻼﻕ ﻭﺍﻟﻣﻌﺎﻳﻳﺭ ﺍﻷﺧﻼﻗﻳﺔ‬
‫ﻭﻗﻭﺍﻋﺩ ﺍﻟﺳﻠﻭﻙ ﺍﻟﻣﺷﺎﺭ ﺇﻟﻳﻬﺎ ﻓﻲ "ﻣﻠﺣﻖ ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ" ﻳﺑﺩﺃ‬
‫ﺍﻟﻌﻣﻝ ﺑﻬﺎ ﻓﻭﺭ ﺍﻋﺗﻣﺎﺩ ﻻﺋﺣﺔ ﻣﺯﺍﻭﻟﺔ ﻣﻬﻧﺔ ﺍﻟﻬﻧﺩﺳﺔ‪.‬‬

‫ﺍﻟﻣﺎﺩﺓ ﺍﻟﺛﺎﻧﻳﺔ‪ :‬ﺇﻥ ﻧﻁﺎﻕ "ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ" ﻫﻭ ﺍﻷﻧﺷﻁﺔ ﺍﻟﻣﻬﻧﻳﺔ‬


‫ﻟﺟﻣﻳﻊ ﺃﻋﺿﺎء ﻧﻘﺎﺑﺔ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ‪.‬‬

‫ﺍﻟﻣﺎﺩﺓ ﺍﻟﺛﺎﻟﺛﺔ‪ :‬ﻳﺧﺿﻊ ﺟﻣﻳﻊ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺍﻟﻣﻘﻳﺩﻳﻥ ﺑﻧﻘﺎﺑﺔ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ‬


‫ﻟﻬﺫﻩ ﺍﻟﻼﺋﺣﺔ ﻓﺿﻼً ﻋﻥ ﻗﺎﻧﻭﻥ ﺍﻟﻧﻘﺎﺑﺔ ﻭﻻﺋﺣﺗﻬﺎ ﺍﻟﺩﺍﺧﻠﻳﺔ ﻭﺃﻱ‬
‫ﻣﺧﺎﻟﻔﺔ ﻟﺫﻟﻙ ﺗﻌﺭﺽ ﻣﺭﺗﻛﺑﻬﺎ ﻟﻠﻣﺳﺎءﻟﺔ ﺍﻟﺗﺄﺩﻳﺑﻳﺔ‪.‬‬
‫ﺍﻟﻣﺎﺩﺓ ﺍﻟﺭﺍﺑﻌﺔ‪ :‬ﻳﺿﻊ ﻣﺟﻠﺱ ﺍﻟﻧﻘﺎﺑﺔ ﺍﻹﺟﺭﺍءﺍﺕ ﺍﻟﺧﺎﺻﺔ ﺑﺗﻁﺑﻳﻖ‬
‫"ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ" ﻓﻲ ﻗﻭﺍﻧﻳﻧﻪ ﺍﻟﺩﺍﺧﻠﻳﺔ ﻭﻫﺫﻩ ﺍﻹﺟﺭﺍءﺍﺕ‬
‫ﺗﺣﺗﻭﻱ ﺑﺩﻭﺭﻫﺎ ﻋﻠﻰ‪:‬‬

‫‪ .١‬ﻳﺗﻡ ﺗﻁﺑﻳﻖ "ﻻﺋﺣﺔ ﺁﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ" ﻣﻥ ﺧﻼﻝ ﺍﻟﻠﺟﻧﺔ ﺍﻟﻌﻠﻳﺎ‬


‫ﻵﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ ﻭﺍﻟﻠﺟﺎﻥ ﺍﻟﻣﻣﺎﺛﻠﺔ ﻓﻲ ﺍﻟﺷﻌﺏ ﺍﻟﻣﺧﺗﻠﻔﺔ‪.‬‬
‫‪ .٢‬ﺃﻥ ﻳﺗﻡ ﺗﻭﺟﻳﻪ ﺍﻻﺗﻬﺎﻣﺎﺕ ﺑﺻﻭﺭﺓ ﺭﺳﻣﻳﺔ ﻣﻥ ﺟﺎﻧﺏ‬
‫ﺍﻟﻣﻬﻧﺩﺳﻳﻥ ﺃﻭ ﺍﻟﻧﻘﺎﺑﺔ ﺃﻭ ﻣﻣﻥ ﺃﺿﻳﺭﻭﺍ ﺑﺻﻭﺭﺓ ﻣﺑﺎﺷﺭﺓ ﻣﻥ‬
‫ﺟﺭﺍء ﺳﻠﻭﻙ ﺃﺣﺩ ﺍﻟﻣﻬﻧﺩﺳﻳﻥ‪.‬‬
‫‪ .٣‬ﻳﺟﺏ ﻋﻠﻰ ﺍﻟﻠﺟﺎﻥ ﺃﻥ ﺗﻌﻣﻝ ﻋﻠﻰ ﺇﺗﺎﺣﺔ ﺍﻟﻔﺭﺻﺔ ﻟﺗﺳﻭﻳﺔ‬
‫ﺍﻷﻣﺭ ﺑﺻﻭﺭﺓ ﻭﺩﻳﺔ‪.‬‬
‫‪ .٤‬ﺍﻟﺟﺯﺍءﺍﺕ ﺍﻟﺗﻲ ﻗﺩ ﺗﻔﺭﺿﻬﺎ ﺍﻟﻠﺟﻧﺔ ﺍﻟﻌﻠﻳﺎ ﻵﺩﺍﺏ ﺍﻟﻣﻬﻧﺔ‬
‫ﻭﺍﻟﻠﺟﺎﻥ ﺍﻟﻣﻣﺎﺛﻠﺔ ﻓﻲ ﺍﻟﺷﻌﺏ‪:‬‬

‫ﺃ‪ -‬ﻟﻔﺕ ﺍﻟﻧﻅﺭ‪.‬‬


‫ﺏ‪ -‬ﺗﻭﺟﻳﻪ ﺍﻟﻠﻭﻡ‪.‬‬
