Government Clarifies Roles in Telecom Security, Cyber Security, and Cyber Crime In a significant move to bolster India's digital security landscape, the government has outlined the specific responsibilities of various ministries and departments in addressing matters related to telecom network security, cyber security, and cyber crime. The Department of Telecommunication under the Ministry of Communication will now be responsible for overseeing the security of telecom networks. Meanwhile, the Ministry of Electronics and Information Technology will provide support to other central ministries and departments on cyber security. The Department of Internal Security under the Ministry of Home Affairs will handle all issues related to cyber crime. Additionally, the National Security Council Secretariat will provide overall coordination and strategic direction for cyber security. A Draft to Over-Regulate: Critical Infra Rules, 2024 Dept of Telecommunications, India released 4 new draft Rules including the draft Critical Telecommunication Infrastructure Rules, 2024. Ministry of Communications is seeking inputs on them till Sept 28, 2024. Vague much?  These Rules define CTI based on the potential impact of telecom network destruction on national security, economy, public health, & safety.  Overbroad, ambiguous, & potentially arbitrary, this definition could lead to misuse in the absence of precise thresholds & pre-determined assessment factors.  A rehash of the Indian Telegraph Rules, 1951, the Draft CTI Rules add nothing new and are a reiteration of an existing DoT framework, with no mention of sanctions for noncompliance. The draft CTI rules allow the Union Govt to access & inspect telecom entities' hardware, software, & data with a single order, giving the Union Govt nearly complete control over their assets. However, this provision is not supported by principles of due process or transparency. The draft CTI Rules provide the Union govt potential access to user data without any data protection safeguards & with utter contempt for the "privacy by design approach," even if the individual has consented to share their data only with particular telecom entities. Telecom entities must comply with unrealistic & ineffective compliance requirements set forth in the draft CTI Rules. Telecom entities must notify the Union Govt of security incidents within 2 hours of occurring. In addition, before routine CTI upgrades, telecom entities must obtain approval from the Union Govt. The smaller and more recent companies in the telecom sector would be particularly burdened by these costly compliances. The Draft CTI Rules although crucial are lacking in several counts. All the critical infrastructure sectors, including telecom, are heavily interdependent. What is needed is a multi-sectoral, coordinated, & comprehensive approach. It is highly recommended that the Union Govt consider inter-ministerial collaboration & create an umbrella framework to protect all critical infrastructure. October is the designated month for cyber security and we could conduct some hands on workshop on ethical hacking and others. We have also been able to impart functional knowledge as part of the National Education Policy as well, which leads to the awareness that cybersecurity is not for engineering or computer science only, it should be taught and undertaken as a multidisciplinary module for enabling the next generation into securing themselves and their organisation better. Key Points You Should Know: 🔹 Foreign-Operated Cybercrime Networks The gateways are allegedly run by foreign nationals as part of an organized network, using “mule” bank accounts controlled remotely. 🔹 Operations Across India Recent raids in Gujarat and Andhra Pradesh exposed these platforms’ deep connections to cybercrimes, exploiting bank accounts rented from shell companies and individuals sourced via Telegram and Facebook. 🔹 Public Advisory Citizens are urged not to rent or sell their bank accounts or company registration details, as this could lead to serious legal consequences. Banks are also advised to closely monitor accounts for signs of misuse related to these illegal gateways. How You Can Protect Yourself: 1. This move aims to bolster consumer's #DataProtection against #spam and #fraudulent messages, but it has also raised concerns about potential delays in critical communication like One-Time Passwords (#OTP). 🔴WHAT ARE TRAI’S TRACEABILITY GUIDELINES? 👉The traceability guidelines mandate telecom operators and messaging service providers to verify the origin and authenticity of each message. 🔴This is part of the Distributed Ledger Technology (DLT) framework, which was introduced to combat spam and ensure message traceability. 🔴Under this system, businesses must register their headers (sender IDs) and templates with telecom providers. 🔴Any message not matching the pre-registered format or sent from unregistered headers will be flagged or blocked. 🔴WHAT DID TRAI SAY? 👉TRAI, in a recent post on X, said message traceability guidelines would not cause any delays in OTP delivery. 🔴Addressing the misinformation stemming from an article by a news organisation that alleged users might face OTP delays under the new rules, TRAI posted on X, "This is factually incorrect.
