Online platforms have revolutionised how goods and services are bought, sold and advertised. However, determining intermediary liability poses a dilemma for courts while dealing with IP infringement disputes involving marketplaces, listing platforms and search engines. In Indiamart Intermesh vs Puma SE, the Delhi High Court clarified that intermediary liability is not absolute, and there must be an element of shared intent or collusion to establish IP infringement.
