The Data Protection Commission Ireland annual report is always essential reading, but particularly this year with DPC fines now accounting for a whopping 87% of GDPR fines issued across the EU last year. A recent judgment from the Irish Commercial Court has highlighted an important reality: directors can be held personally liable for data protection breaches, even if the misconduct is carried out on company letterhead. This case involved the unauthorised disclosure of clients' personal information by a director, leading to a minimal nominal damage award. However, the real takeaway here is the court's willingness to hold directors personally accountable, cutting through the corporate veil. Early legal advice and a well conducted investigation can reduce the risk of employment tribunal claims, and if there is a claim, they can safeguard your business against potential liabilities.   In the recent case of Leicester City Council v Parmar (Race Discrimination) [2024] EAT 85 (04 June 2024) (bailii.org); Parmar alleged that the following act/omissions amounted to race discrimination. She was (i) temporarily moved from her role, (ii) subjected to a disciplinary investigation, and (iii) the allegations against her were vague. The tribunal found that discrimination was a possible explanation and the Respondent had failed to disprove discrimination, therefore Parmar’s claim succeeded.
