Croatia's legal framework for employment transfers is witnessing a subtle yet significant shift. A recent Supreme Court decision has drawn a clear line between transfers where the original employer continues operations and those where it does not - raising questions about employee rights under TUPE regulations. This points to a new direction in European labour law, potentially redefining employment transfers in Croatia and across the EU. Read the recently published article by partner Mia Kalajdzic and attorney-at-law Antonio Sabljić: https://lnkd.in/dWtd95qq #CMSLaw #Employmentlaw Jana Črnjević, Ana Čosić
In case you missed it back in November, CMS Partner Mia Kalajdzic and Attorney at Law Antonio Sabljić wrote an Experts Review article on Croatia for Issue 11.10 of the CEE Legal Matters magazine titled “TUPE Regulations in Light of Supreme Court of the Republic of Croatia’s Recent Practice.” Check out the piece below: The article: https://lnkd.in/dJPG3YRS The complete issue: https://lnkd.in/dmFWR4H2 Don’t miss any future articles, subscribe today: https://lnkd.in/e9UmmUyn #CEELegalMatters #magazine #CEE

Green bonds just got a major upgrade! On January 24, the Croatian Parliament enacted legislation to implement the European Green Bond Regulation (Regulation (EU) 2023/2631) - a significant step in aligning Croatia’s #sustainable finance framework with the European Green Bond Standard (EU GBS). Key Highlights of the EU Green Bond Standard: 💡 Allocation of Proceeds: Issuers are required to allocate the proceeds from European Green Bonds to economic activities that are environmentally sustainable, as defined by the EU Taxonomy Regulation. This includes sectors such as renewable energy, sustainable transport, energy efficiency, and ecosystem protection. 💡 Transparency and External Verification: Issuers must develop a Green Bond Framework detailing the intended use of proceeds and provide regular reports on the allocation of funds and the environmental impact of financed projects. Independent external reviewers are mandated to verify compliance, thereby mitigating the risk of greenwashing. 💡 Voluntary Adoption with Enhanced Credibility: While adherence to the EU GBS is voluntary, issuers who comply benefit from increased credibility, making their bonds more attractive to responsible investors. The EU GBS complements existing market frameworks, such as the ICMA Green Bond Principles and the Climate Bonds Standard, by providing a robust regulatory structure. 👉 What does that mean? This regulation gives investors greater confidence that their money is truly supporting sustainable projects, while issuers gain credibility and access to responsible capital. By setting clear standards and requiring transparency, it reduces the risk of greenwashing and helps drive real environmental impact, making green bonds a more reliable tool for financing the transition to a low-carbon economy. #CMSLaw #GreenBonds Jelena Nushol Fijačko, Relja Rajković, Ronald Filipčić
