Author vs. Editor: Who owns the copyright? The German Federal Supreme Court (BGH) just decided on a dispute worthy of a Shakespearean drama (minus the tights). An author's right to recognition of authorship is protected even if the denial or claim of authorship is only expressed to the author themselves. This means that an author can take legal action against someone who disputes their authorship, even if the dispute is not made public. 🟪The decision is based on the principle that an author's personality right is infringed by any denial or claim of authorship. This right is protected by Section 13 Satz 1 of the German Copyright Act (Urheberrechtsgesetz, UrhG). 🟧The decision is significant because it clarifies the scope of an author's right to recognition of authorship. It means that authors can now take legal action to protect their rights even if the dispute is not made public. Moral of the story? Virtual share option programs (VSOPs) have long been the go-to choice for German employee participation schemes in exit-driven startups. In contrast, equity-based programs have often been sidelined due to governance challenges prescribed by statutory law and onboarding costs faced by the startups, founders, and investors. This market practice is prevailing despite the tax advantages they would offer, such as lower taxation and a possible wage tax deferral upon share issuance under the revised section 19a of the German Income Tax Act (Einkommensteuergesetz – EStG). But change is on the horizon! The dominance of VSOPs may finally be waning as a new approach is emerging in the slipstream of section 19a EStG: (Employee) Profit Participation Rights (Genussrechte). UPC presidents Klaus Grabinski and Florence Butin take stock after the first year.👇 The interview starts with the highlights for both the President of the Court of Appeal and the President of the Court of First Instance of the Unified Patent Court. While for Klaus Grabinski the personal highlight was being judge rapporteur and presiding judge in the first appeal proceedings of a PI case, Florence Butin's one was the oath-taking ceremony. Ms Butin and Mr Grabinski then identify different challenges for the judges: - the new framework, - balancing national and UPC work for the part-time judges, - managing schedules and travels for multi-panel judges, - upholding the quality in divisions with heavy caseload (Munich is certainly meant here, the creation of the 2nd panel, with the double Voß panel, will certainly ease the burden for a moment) - implementing the process for technical field assessment and conflict-of-interest checks for the technically qualified judges - developing a body of case law providing clarity and certainty Asked about the disparity of the number of cases of the different local divisions (Munich with the highest number, Lisbon and Ljubljana having none so far), the presidents point out to the respective pre-UPC case load of the different fora, but are confident that claimants will choose divisions with a lower case load. A further topic was the language of proceedings, with Ms Butin expecting a more widespread use of English. Mr Grabinski points out that the decision to designate English as alternative language was taken in some Member States only a few days before the start of operations (as was the case of Germany, with claimants filing in German to be on the safe side). Finally, both presidents were asked about their hopes and aspirations for the UPC. For Florence Butin, this means: - building a complete administrative framework (this should certainly include a better functioning CMS) - the UPC as (one) international court and not composed of "national" divisions - other Member States joining (Romania will be on 1 September 2024; Ireland deferred the date for their UPC referendum) Klaus Grabinski "expect[s] the court to develop a body of case law that will aim at providing greater clarity and certainty in the field of patent law in the years to come" and mentions the further harmonization of the patent law in Europe.
