New partner at gbf   We are pleased to announce that Roger Thalmann has become a new partner in our firm, taking up his new position on 1 September 2024. Roger graduated from the University of Zurich and wrote his doctoral thesis on "The Contractual Nature of the Freight Contract", for which he was awarded 𝘴𝘶𝘮𝘮𝘢 𝘤𝘶𝘮 𝘭𝘢𝘶𝘥𝘦. Roger has been supporting our team with his expertise for more than ten years. His preferred areas of practice are liability and insurance law, transport and customs law, and real estate law. He uses his experience to assist clients in an advisory capacity as well as before state courts or in arbitration proceedings. We are happy to welcome Roger as a partner in our firm and look forward to working with him in the future. Interesting decision by the Commercial Court of the Canton of Bern on the transitional provision in the new SICA (appeal pending before the Federal Supreme Court): The direct right of claim under Art. 60 para. 1bis SICA (in force since 1 January 2022) falls within the scope of the transitional provision of Art. 103a SICA. As a qualified silence is to be assumed, the transitional provisions of the CC do not apply. Interesting read: Ambiguous or unclear language in insurance contracts can only be interpreted against the insurance company if the insurance company drafted the clause in question. This is particularly not the case if the policyholder or the broker has provided the wording of the insurance contract, as is often the case in the area of industrial insurance.   See the article recently published by Clemens von Zedtwitz and Riccardo Maisano in HAVE 2/2024, p. 200 et seqq.
