The Canadian Web3 Council recently submitted our comments on the Canadian Securities Administrators (CSA) - Autorités canadiennes en valeurs mobilières (ACVM)' proposed amendments to National Instrument 81-102 Investment Funds and 81-102CP. We appreciate the opportunity to provide comments and believe public consultations are an important part of the rule-making process. 🔎 Key Points of our Submission: 1. Clarification and Definitions: We commend the CSA for initiating amendments that consider crypto assets. Clear definitions across the regulatory framework are essential to ensure consistency in the interpretation and application of defined terms. We believe the CSA's proposed description of crypto assets leads to inconsistent results particularly once tokenization of real-world assets take hold. 2. Investor Protection and Regulatory Alignment: We stress the importance of evolving securities regulations in tandem with other legal and regulatory frameworks to address overlapping jurisdictional issues and to protects investors adequately. Aligning with global standards will enhance Canada's position in the international market and ensure our regulations are comprehensive and forward-thinking. 3. Creating a Crypto Asset Taxonomy: It is crucial to establish a taxonomy that differentiates among classes of crypto assets based on their primary functions and the nature of the underlying assets. This approach will support the CSA's goals of investor protection and will reduce regulatory burdens by facilitating clearer and more targeted regulations. 4. Flexibility and Innovation: We encourage the CSA to adopt principles-based regulations that allow for flexibility to adapt to rapid technological changes. This will support innovation in the crypto asset space while ensuring investor protections remain robust. 🌍 Looking Ahead: The Canadian Web3 Council is dedicated to working constructively with policymakers to establish Canada as a leader in Web3 technology. We believe thoughtful and inclusive regulatory approaches are crucial to achieving this goal. 📀 Stablecoin access timeline extended by securities regulators to October 31, 2024! ⏳ Today, the Canadian Securities Administrators (CSA) - Autorités canadiennes en valeurs mobilières (ACVM) announced they are prolonging the deadline by which registered crypto trading platforms (CTPs) must prohibit their clients from buying or depositing stablecoins that are "fiat-backed", unless a number of conditions are met. The previous timeline was set to expire April 30 🔜 Stablecoins which are not "fiat-backed" have been prohibited on CTPs since December 29, 2023. USDC is currently the only stablecoin readily available on most Canadian CTPs. Among the conditions to trade "fiat-backed" stablecoins are that they reference the value of only the Canadian or U.S. dollar on a one-to-one basis with reserves backed by audited, specified "real-world" assets (like cash and regulated money-market funds) measured at fair value and held with a qualified custodian 🏛 🌎 With the stablecoin compliance deadline under the Markets in Crypto-Assets Regulation (MiCA) regulation in Europe set for July 2024, domestic market participants will now have time to see whether (and to what extent) stablecoin regulation in Canada aligns with other approaches around the globe. The Canadian Securities Administrators (CSA) have extended the deadline for crypto asset trading platforms (CTPs) to comply with new regulations for value-referenced crypto assets (VRCAs) until December 31, 2024. This includes stablecoins like USDC and Tether, as well as wrapped tokens such as WBTC and WETH. Currently, no VRCAs meet the CSA’s requirements, which could lead to significant disruptions in the Canadian crypto market if non-compliant assets are delisted. Recognizing the potential impact, the CSA is actively engaging with industry stakeholders to explore alternative regulatory approaches and possible exemptions.
