Exposing one of known Dubai Bank’s Baseless Claim of Negligence Against some one unknown. The unknown approached me for legal consultation regarding a disputed claim by of the known Bank in Dubai. The bank alleges that unknown authorised her credit card to be added to Apple Wallet, even though she owns a Samsung phone and does not use an Apple device. As a cyber lawyer and forensics expert, I provided the unknown with detailed legal guidance and conducted a thorough case analysis to demonstrate the bank’s baseless claim. Forensics Investigation: Device Forensics: Since unknown owns a Samsung phone, we confirmed that Apple Wallet cannot be installed or accessed on her device. Credit Card Authorization Verification: We examined the phone logs, notifications, and transaction records for any attempts to authorize the credit card on any unauthorized platform. No such attempt was detected. Review of Bank Records and Logs: We demanded that the bank provide evidence supporting their claim, including timestamps, IP addresses, and device logs that could potentially link the credit card authorization to Apple Wallet. The request aimed to compel the bank to provide proof of negligence on unknown part, which they are unable to produce yet. Legal Actions and Guidance: Formal Written Complaint: The unknown was guided to file a formal written complaint with the Bank in Dubai, disputing the charges and providing all relevant evidence. The complaint highlighted the forensics approach to be taken by the cyber crime cell, including that the unknown does not use an Apple device, making it impossible for her to authorize the credit card to Apple Wallet. Demand for Evidence: We formally demanded that the bank cease all collection actions until they could provide conclusive evidence of the unknowns alleged negligence. We requested that the bank investigate their systems for potential fraud, especially as other customers had experienced similar issues. Consumer Rights and Protection: I advised the unknown to leverage UAE consumer protection laws, which safeguard consumers from unfair practices. The unknown was referred to relevant regulations, such as the UAE Consumer Protection Law, to assert her right against the unjust charges and the harassment from the bank's collection team. Case Acceptance and Halt of Harassment: Thanks to the detailed cyber forensics analysis and legal guidance, the Cyber Crime Cell of Dubai accepted the unknowns case and asked the unknown to visit the station where they will issued a formal letter confirming the acceptance of her case. This letter once received will be submitted to the bank, forcing them to halt any further collection actions or penalties while the matter was under official investigation. The unknown is now protected from further harassment as the case proceeds under the jurisdiction of the Cyber Crime Police, and her consumer rights are being upheld under UAE law.
