We, LLP “KHEPRI ZHER, TOO”, with full legal and corporate responsibility, hereby issue this Confidentiality &
Non-Circumvent Letter to be signed by all parties (Seller, Buyer). This letter confirms our readiness to issue a
copy of the SGS Report to the Buyer’s representative only, strictly for the purpose of verification, in
accordance with the agreed procedure under the signed Commercial Invoice Contract No: KZ-EN-590-11519-
7097 between LLP KHEPRI ZHER, TOO and GM COMMODITIES TRADING PTY LTD.

This Confidentiality & Non-Circumvent Letter is to be signed by the following parties:


1. LLP KHEPRI ZHER, TOO – Supplier/Refinery Company
2. GM COMMODITIES TRADING PTY LTD – Buyer & Exit Buyer

SCOPE AND CONDITIONS:

1. This agreement is pursuant to the transaction under Commercial Invoice Contract No: KZ-EN-590-11519-
7097 between LLP KHEPRI ZHER and GM COMMODITIES TRADING PTY LTD for our ongoing transaction
involving the allocation of Ultra Low Sulfur Diesel (EN590) 100,000 Metric Tons (MT) at Rotterdam Port
Terminal.
2. The SGS Report shall be released only to Buyer’s representative for the purpose of physical verification and
confirmation.
3. The SGS Report or any related information shall not be disclosed, released, or provided to GM
COMMODITIES TRADING PTY LTD or any third party without express written authorization.
4. The document and verification shall remain strictly confidential and handled with the highest level of
discretion.
5. The SGS Report shall only be released via email after the Buyer completion of the required code for the
injection schedule.

ACKNOWLEDGEMENT AND AUTHORITY:

By signing below, all parties confirm:


- They are authorized signatories of their respective firms.
- They have reviewed this letter with legal counsel where required.
- They fully understand, agree, and accept the terms of this Confidentiality & Non-Circumvent Letter, effective
as of the date above.

All communication and documentation under this agreement are strictly confidential and shall not be
circulated in any manner to unauthorized persons.
