LEGAL ENGLISH / IMPORTANT LEGAL MAXIMS

1. Ab initio - From the beginning.

2. Actus reus - A guilty deed or act. Result of guilty intention. Result of human conduct.

3. Ad interim: in the meantime. In the middle.

4. Alibi - At another place, elsewhere.

5. Amicus curiae - A friend of the Court.

6. Audi alteram partem - Hear the other side.

7. Bona fide - Sincere, in good faith

8. De facto - In fact.

9. De jure - Rightful, by right. By law.

10. De novo:- starting afresh

11. Ex post facto:- by reason of a subsequent fact. After the fact.

12. Exceptio probat regulam:- an exception proves the rule.

26. Jus dicere, non jus dare:- to declare the law, not to make the law.
27. Lis pendens:- pending litigation.

28. Locus standi:- place of standing. Person’s right to take an action or to be heard by a court.

29. Mala fide:- in bad faith.

30. Mens rea:- guilty mind. Evil intent. Evil mind.

31. Modus of operandi:- manner of doing something. Method of committing crime.

32. Mutatis mutandis:- things being changed which are to be changed. With some changes.

33. Nemo bis punitur pro eodem delicto - No one can be twice punished for the same offence.

34. Nemo debet esse judex in propria causa - No one can be judge in his own case.

35. Nemo punitur pro alieno delicto - No one is punished for the crime of another.

36. Per curiam - In the opinion of the court.

37. Prima facie:- on the face of it. Evidence good and sufficient on its face.

38. Qui non improbat approbat:- he who does not disapprove, approves.

39. Qui tacet consentire videtur:- he who is silent appears to consent.

40. Ratio decidendi:- reason behind the decision of court. The principle upon which decision rests.

41. Res gestae - Things done.

42. Res ipsa loquitur:- the thing speaks for itself.

43. Res judicata:- matter already decided.

44. Res subjudice:- matter in issue is already under judicial scrutiny.

45. Stare decisis:- to stand by decided things. Precedent. Authority.

46. Sub judice:- matter still under consideration by the court.

47. Sui juris:- person who has full legal rights.

48. Ultra vires:- beyond the powers.

49. Vice versa - The other way around.
