Introduction To Zambia's Sources of Law

According to the Oxford Dictionary of Law, “sources of law” refer to something (such as a
constitution, treaty, custom, or statute) that provides the authority for judicial decisions and
legislation. In other words, these sources serve as the basis for legal decisions and the creation
of law. Zambia’s legal system is a fascinating blend of historical, cultural, and colonial
influences. Understanding these sources provides valuable insights into the country’s legal
framework. In this assignment, we will explore the sources of law in Zambia, covering the
Constitution, Legislation, Common law, Equity, Judicial precedent, and Customary law.

1. The Constitution:
• Cornerstone of Legal Order: Zambia’s constitution is the supreme law, guiding
governance, rights, and institutions.
• Evolution: Since independence, Zambia has had several constitutions, reflecting
societal changes and aspirations.
• Bill of Rights: The constitution safeguards fundamental rights, empowering
