Across Washington, there is growing agreement that America’s permitting process is failing to keep pace with the country’s energy needs. The consequences are increasingly difficult to ignore: delayed infrastructure, rising energy demand and higher costs for consumers. These challenges may take different forms, but they share a common obstacle—our inability to build critical energy infrastructure efficiently. The case for permitting reform is clear. But broad agreement on the problem will not be enough to move legislation through Congress. Lasting reform will depend on the specific provisions needed to create a more predictable, efficient and durable process. So, what should meaningful permitting reform actually include? The Partnership to Address Global Emissions and like-minded organizations are asking Congress to pass the following bipartisan modernizations to Clean Water Act (CWA) and National Environmental Policy Act (NEPA) reviews for all types of energy infrastructure: · Predictable deadlines. When billions of dollars and Americans’ access to energy are on the line, there needs to be established and enforceable timelines for decisions. · Clean Water Act modernization. FERC is tasked with regulating interstate energy infrastructure, and it should be no different under the Clean Water Act. · Concurrent reviews. If projects face multiple reviews, those reviews should happen at the same time. · Permit certainty. Once an environmental review is done, it’s done. Currently, bad-faith lawsuits intended to delay, not win, successfully halt projects for years AFTER environmental reviews are already complete. Congress has an opportunity this year to repair a process that is holding back energy projects of every kind. The urgency is clear, and the solutions are on the table. Any meaningful Senate permitting reform package should include reforms such as those proposed in the American Energy and Mineral Infrastructure Act of 2026 (S. 4944) to address the weaponization of CWA and NEPA reviews that continue to create roadblocks for all forms of energy infrastructure. Now is the time to act.

Most infrastructure policy announcements are noise. Here is how to spot the signal. Here is what most investors get wrong about permitting reform: they view it as a secondary administrative hurdle. The reality is that in 2026, permitting velocity is the primary determinant of your risk-adjusted return. Regulatory bodies are shifting from opaque, manual reviews to transparent, KPI-driven frameworks. We are seeing a legislative mandate to accelerate grid-adjacent assets—like storage and charging infrastructure—embedded directly into frameworks like the European Grid Package. Jurisdictions that digitize these pipelines are fundamentally lowering the cost of capital by eliminating the binary "permit-denied" risk. What the smart money is doing: they are re-rating assets based on their location within "high-velocity" regulatory zones, essentially pricing in the speed of the approval process as a core component of the project's internal rate of return. For allocators: prioritize jurisdictions that have codified measurable KPIs for permitting efficiency, as these represent significantly lower execution risk. America doesn't just need more energy infrastructure. It needs a faster path to build it. 🏗️ Momentum around permitting reform is growing in the Senate. The American Energy and Mineral Infrastructure (AEMI) Act has gained 13 additional Senate cosponsors, bringing its total to 17 as lawmakers push for changes to the federal permitting process. And one line from Senator Alan Armstrong captures the urgency: “Our national energy infrastructure is like a bridge: nobody really cares about it until it falls down, and the cracks are starting to show right now.” ( https://lnkd.in/g_pVT5KH ) The challenge is becoming harder to ignore. As power demand grows—driven by AI, advanced manufacturing, and industrial expansion—the infrastructure required to support that growth still has to make its way through complex permitting and regulatory processes. The AEMI Act proposes changes aimed at creating greater certainty and reducing duplicative reviews and project delays. But faster permitting doesn't make regulatory complexity disappear. It makes understanding changing requirements even more important.
