Regulators in several states are now treating med spas as medical clinics, meaning they must be specially registered and licensed. On paper, most of these med spas are still just salons, but the procedures they offer (injectables, lasers, peels) are medical, and oversight is finally treating them that way. So we looked at how 12,646 med spas describe themselves in their own filings. 85.9% classify under a beauty-industry code, the same bucket as nail salons and day spas, rather than a medical one. In New York, 87.9% of traditional medical practices register as professional corporations, the structure the state requires for physician-owned medicine. Among med spas, the pattern flips: most file as standard LLCs. Even though plenty of med spas certainly run compliant management-services structures, the industry codes that represent these businesses are still self-reported. So when a business offering medical procedures files like a salon, that gap is exactly what a registration-only KYB check waves through, and exactly what regulators are now chasing. An excellent article regarding the right-to-repair. We need to continue to request our legislators at both the state and federal level be more engaged on this issue. The logic and reasoning behind preventing healthcare equipment owners and trained HTM professionals access to training and technical support is seriously flawed. It is a safety issue and is impacting our healthcare costs.

Most dry eye clinics have a constraint problem, not a "marketing problem". Today at the Inaugural DESA Conference in New York City, I’ll be walking through how the Theory of Constraints applies specifically to dry eye practices – and I’ll show this simple 4‑stage model you can use to find your real bottleneck in under 10 minutes. The carousel in this post is the deck I’ll be using. On those slides, I map out your dry eye value chain from left to right – from generating the right patients, to getting them to commit to care, to actually delivering that care at scale, to making sure the economics make sense so you can keep reinvesting. Here’s the punchline: Your practice does not grow at the speed of your best area. It grows at the speed of your worst constraint. For some clinics, it’s not enough qualified dry eye patients coming through the door. For others, it’s patients not converting from “curious” to committed to a treatment plan. In many, the real limiter is capacity and flow – too few assessment slots, staff, or chairs. And in more than a few, the biggest drag is the economics: pricing, packaging, and profit per patient.
