DigiDocuments, Inc. (“we”) welcome you. This Privacy Notice ("Privacy Notice") applies to our platform ("FormsPal" or "Platform") available at formspal.com, and to the Scan & Sign by FormsPal mobile app ("App"). Where a section applies only to the App, it says so.

The Privacy Notice describes which of your personal data FormsPal collects, how stores, processes, and uses it, and what happens when you use the Platform. This Privacy Notice is publicly available at a non-geo-blocked URL and is intended to be accessible to automated crawlers.

About us

We are the controller of your personal data processed through the Platform. This means that we determine the purposes and means of personal data processing.

About you

When you visit the Platform, you become our user (“User”).

We divide the Users into categories so you can easily find details about the processing of your personal data. Pay attention that you can fall into several categories depending on your actions.

Sources of data

We receive your data when you visit the FormsPal and interact with it, depending on your actions on the Platform.

You can change your personal data in FormsPal by exercising your right to rectification or by the Platform’s functionality. Please note that the same lawful basis and storage terms apply to the changed data.

We may also receive data from third parties. It depends on your settings and the features you use.

Lawful bases for processing

To process your personal data, we rely on the following lawful bases:

  • performance of the contract — for the processing of personal data necessary for the negotiating on, conclusion, and performance of a contract (mainly, the Terms of Service) with you;
  • legitimate interest — for the processing necessary at the development of our services, taking into consideration your interests, rights, and expectations;
  • legal obligation — for the processing as required by applicable laws (for example, to comply with tax or KYC/AML regulations) or if requested by a law enforcement agency, court, supervisory authority, or another state-authorized public body;
  • consent — for additional specific purposes.

Users’ data

When you visit the Platform, we collect some data automatically. We collect some technical data about the Users to optimize performance, debug issues, and enhance features while ensuring security and privacy to improve the overall user experience.

Most of the technical data we collect are anonymous, but some data is associated with your IP address and device ID. Please read about personal technical data below.

App Users' data (Scan & Sign by FormsPal)

The Scan & Sign by FormsPal app is local-first. Scans are captured with your camera and stored on your device. Nothing is sent to us automatically. A document leaves your device only when you choose to send it.

Data storage Documents saved to your account are stored until you delete them or delete your account. Documents sent to Chat with this PDF and page images sent for text recognition are processed for that request and are not retained. Diagnostics are stored on your device and sent only when you share them.

The App contains no advertising, analytics or tracking software, and we do not use App data to track you across other apps or websites.

Deleting your account from the App (Settings > Account > Delete account) erases the account as described under "Account deletion". The scans on your phone stay on your phone.

Content Uploaders’ data

We collect some of your personal data when you upload, edit, or convert your files on the Platform.

Please note! We share user information with third parties involved in the signing of a document. Specifically, this includes the user’s name, email address, geolocation, and IP address. Upon the completion of the signing process, all participants receive a copy of the signed document and a certificate containing the above-mentioned information.

Meta (Facebook) Login data:
If you choose to sign up or sign in using Facebook Login, we may receive the following information from Meta, depending on the permissions you grant: your name, email address, profile picture, and a Facebook user identifier. We use this information to create and authenticate your FormsPal account, secure our services (fraud/abuse prevention), and provide customer support. We store this information until you delete your account (see "Account deletion"), or until you ask us to delete it earlier.

We receive some data from Solidgate when you buy a monthly or annual subscription to FormsPal. The data may include:

Please note! We do not have access to the data you are filling in the payment form on the Platform.

YouTube API Services

FormsPal uses YouTube API Services to publish and manage tutorial videos on our official YouTube channel. Some pages on the Platform may also contain embedded YouTube videos. When you interact with embedded YouTube content, Google and YouTube may process information about your interaction in accordance with the Google Privacy Policy.

Our internal publishing tool accesses only FormsPal’s own YouTube channel through authorization granted by our Google Account. It may upload, update, and manage videos and related channel content. The tool does not access, collect, or store personal data belonging to FormsPal website users or YouTube viewers.

The Google Account that authorized the internal publishing tool may review or revoke the tool’s access through the Google Account connections settings.

Use of AI-generated content and data handling

By using our AI-powered document or text creation tools, you acknowledge that these documents may contain personal data, such as your name, images, and other information, depending on the content of the document or text. Please see more information in the Platform Terms of Service.

Your personal data is processed strictly following the relevant data protection regulations. We commit to ensuring your data is used solely for content generation and publication purposes. You retain full rights to your personal data and can manage your privacy preferences at any time.

Usage guidance

The AI tools on our Platform are designed to assist with text and document generation. Outputs from these tools should always be reviewed and interpreted by users to ensure suitability for their intended purposes.

We can share your personal data with third parties without any harm to you and in full compliance with applicable law. In addition, we have implemented organizational and technical measures to ensure the security of personal data during data transfer to third-party.

To exercise your rights, contact us.
We will answer your request within 30 to 60 days, depending on the state and legislative requirements. If your complaint is not satisfied, you can submit a complaint with the Federal Trade Commission.
Please note! Some states do not have privacy laws. The rights of residents of such states are governed by U.S. federal law. If your state is not on the list, please contact us.

Account deletion

You can delete your FormsPal account yourself at any time at formspal.com/support/delete-my-account, or from the Scan & Sign by FormsPal app under Settings > Account > Delete account. If you are signed in, type DELETE to confirm. If you are not signed in, enter your account email and we send a single-use confirmation link to that address; only the person who can open that email can finish the deletion.

Deletion is immediate and permanent. Your documents, saved details, settings and sign-in sessions on every device are erased, any active subscription is cancelled, and if you signed in with Apple, Google or Facebook, we disconnect that sign-in from FormsPal. There is no restore.

We keep only what the law or a pending dispute requires us to keep:

  • invoices and payment records, for 7 years, for tax purposes;
  • support correspondence, for 3 years after our last message to you;
  • records needed to resolve a dispute that is open when you delete your account, until it is resolved.

You can also ask us to delete your data by email at support@formspal.com with the subject "Data Deletion Request", including the email address of your FormsPal account, or via our contact form. We answer such requests within 45 days.

Do not sell my personal information

California residents have the right under the California Consumer Privacy Act (“CCPA”) to opt out of the “sale” of their personal information by a company governed by CCPA.

We do not sell your personal information to anyone nor use your data as a business model.

However, we support CCPA by allowing California residents to opt out of any future sale of their personal information. If you would like to record your preference that we will not sell your data in the future, please contact us.

Do-not-track requests

California residents visiting the Platform may request that we do not automatically gather and track information about their online browsing movements across the Internet.

Such requests are typically made through web browser settings that control signals or other mechanisms that allow consumers to exercise choice regarding collecting personal data about an individual consumer’s online activities over time and across third-party websites or online services.

We currently do not have the ability to honor these requests. We may modify this Privacy Notice as our abilities change.

Privacy Notice updates

The Privacy Notice is developed according to the Delaware Personal Data Privacy Act, US privacy legislation, other applicable privacy laws, and best privacy practices.

Existing laws and requirements for the processing of personal data are subject to change. In this case, we will publish a new version of the Privacy Notice on the Platform.

If there are material changes to the Privacy Notice or the Platform that affect your data privacy rights, we will notify you by displaying information on the Platform and, if necessary, ask for your consent.
