Terms
A plain-English summary sits at the top of each section. The full wording follows it and is what applies.
1. Who we are and this agreement
Formcrier (formcrier.com) is run by Coysh Digital Ltd, a company registered in England and Wales (number 16868808), whose registered office is 14 Sutherland Close, Warwick, CV34 5UJ. "We" and "us" mean Coysh Digital Ltd. "You" means the business or organisation that uses Formcrier, and the person who accepts these terms confirms they can agree to them on its behalf.
These terms apply when you create an account or use Formcrier. Our privacy policy explains how we handle personal data about you, and our data processing agreement forms part of these terms and covers the form submissions we handle for you.
Formcrier is for business use. You confirm you are using it for your trade, business or profession and not as a consumer.
2. Your account
You must be 18 or over to create an account, and the details you give us must be accurate and kept up to date.
You are responsible for everything done in your account and workspaces, including by people you invite. Keep your password safe, turn on two-factor authentication, give people the lowest role they need, and remove access when someone leaves. Treat your secret API keys like passwords.
Tell us straight away at [email protected] if you think someone has got into your account.
3. The service
Formcrier receives submissions from forms on your websites, stores them for your plan's history period, and sends alerts to the destinations you connect: WhatsApp, text message, email, Telegram, Slack and Microsoft Teams.
We work hard to deliver every alert within seconds, and every submission is saved in your dashboard even when an alert can't be sent. But alerts depend on WhatsApp, mobile networks, email providers and the other channels, which we don't control, so we can't promise every alert arrives or arrives on time. Don't rely on Formcrier as the only record of an enquiry, or for emergencies.
Your forms keep working as they do now: Formcrier listens alongside them, and doesn't replace your website's own emails or storage.
We may change and improve Formcrier over time. If we remove something important to a paid plan, we'll tell you at least 30 days before, and you can cancel.
4. Plans, trials and payment
Plan prices and limits are on our pricing page. Prices are in GBP, EUR or USD, whichever you choose before you first subscribe, and exclude VAT and other sales taxes.
Stripe sells Formcrier for us. Stripe is the merchant of record for paid plans: it takes your payment, adds the tax that applies where you are, and issues your invoices. Stripe's own terms apply to the payment itself.
- Trials. Each workspace can try a paid plan free for 14 days, once. No card is needed. If you don't subscribe before it ends, the workspace moves to Free.
- Renewal. Paid plans are billed monthly or annually in advance and renew automatically until you cancel. Annual plans cost ten months' price for twelve.
- Upgrades apply straight away, and we charge the difference for the rest of the current period.
- Downgrades and switching from annual to monthly apply at the end of the current period.
- Cancelling. Cancel from Billing at any time. You keep your plan until the end of the period you've paid for, then move to Free.
- Refunds. We don't refund part-used periods, except where the law requires it.
- Failed payments. If a payment fails, Stripe tries again and we'll let you know. If it still can't be collected, the subscription ends and the workspace moves to Free.
We may change our prices. We'll tell you at least 30 days before a change affects you, and it applies from your next renewal after that.
5. Alert limits
Each plan includes a number of alerts a month. WhatsApp, Slack, Teams and Telegram messages count as one alert each, and texts one alert for every 160 characters. Email alerts don't count. Paid plans include 10% extra as a grace allowance.
When you run out, submissions are still saved, alerts pause until your next monthly period, and they go by email instead. We email you at 80% and 100%.
Email alerts are unlimited within fair use: up to 200 on Free, 2,000 on Starter, 6,000 on Pro and 20,000 on Agency a month, which is far more than a website's forms send. If a workspace reaches that, its email alerts pause until the next monthly period, submissions are still saved, and we email the owner.
If you move to a plan with fewer sites or destinations than you have, the newest ones are paused, not deleted. Submissions are kept for your plan's history period (Free 7 days, Starter 30 days, Pro 90 days and Agency 1 year), or a shorter period you choose in Workspace settings, and then deleted automatically.
6. Acceptable use
You must only install Formcrier on websites you own or are authorised to manage, and only collect personal data you are allowed to collect. You are responsible for telling your visitors about Formcrier in your own privacy notice.
You must not use Formcrier to:
- send spam, marketing messages or anything other than alerts about your own form submissions;
- collect payment card details, passwords, health records or other special category data, except where the law allows it and you have the right safeguards in place;
- break the law, infringe anyone's rights, or harass anyone;
- break the rules of the channels we deliver to, including WhatsApp's Business and Commerce policies, mobile network rules for texts, and Slack's, Telegram's and Microsoft's terms;
- send alerts to people who haven't agreed to receive them;
- try to get around plan limits or rate limits, overload the service, probe it for weaknesses without our permission, or reverse engineer it except where the law allows.
If you find a security problem, please tell us at [email protected] and give us a chance to fix it.
7. Your data
You own the submissions and other content you send through Formcrier. You give us the permission we need to store, process and deliver it to run the service for you, and nothing else.
For your visitors' personal data, you are the controller and we are your processor, under our data processing agreement.
You can see and delete submissions in your dashboard. When you delete a workspace or your account, its data is deleted as the privacy policy describes.
8. Agencies and client workspaces
On the Agency plan you can manage workspaces for your clients. You confirm that you have your clients' permission to set up Formcrier on their websites and to handle their submissions, and that you've agreed data processing terms with them that are at least as protective as ours.
Your clients' alerts count towards your plan and are billed to you, unless you set a client to pay for itself: it then has its own plan, paid by whoever you send its payment link to (or who subscribes from its Billing screen), and the subscription is theirs. If your plan no longer includes client workspaces, those workspaces move to their own plans.
9. Availability and support
We aim to keep Formcrier available at all times, but it may occasionally be unavailable, for example for maintenance or because of a problem with a provider. When the service is unavailable, the Formcrier script lets your forms carry on as normal.
Support is by email at [email protected], our contact form or the Support page in your dashboard. We usually reply within one working day.
10. Suspension and ending
You can stop using Formcrier, cancel your plan or delete your account at any time.
We may suspend or close an account, or disconnect a destination, if you seriously or repeatedly break these terms, if you don't pay, if a channel provider requires it, or if we need to protect the service or other people. Where we can, we'll warn you first and give you a chance to put things right.
We may end these terms for any reason with 60 days' notice, and we'll refund any period you've paid for but won't receive.
Sections 7, 11 and 13 continue after these terms end.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
Subject to that, we are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss, including enquiries you miss because an alert was delayed or not delivered.
Subject to the first paragraph, our total liability to you in any 12-month period is limited to the greater of £100 and the fees you paid us in the 12 months before the event.
Formcrier is provided as described on our website. We don't give any other promises about it, except those the law implies and doesn't allow us to exclude.
12. Changes to these terms
We may update these terms. We'll show the date at the top of this page, and email account owners at least 30 days before a change that affects you. If you don't agree, you can cancel before it applies.
13. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
If you have a complaint, please contact us first and we'll try to put things right.
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we can still enforce it later. You can't transfer your account or these terms without our agreement; we can transfer them to a company that takes over Formcrier, and we'll tell you if we do.
