EI Insider Terms of Service and Intellectual Property Notice

1. Overview
Welcome to EI Insider, a publication of Mal Harrison and the Center for Erotic Intelligence. By subscribing to, accessing, or using any content published through EI Insider, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to these terms, please discontinue use immediately.
2. Registered Trademark Notice and Intellectual Property Rights
EROTIC INTELLIGENCE® is a federally registered trademark owned by the Center for Erotic Intelligence, registered with the United States Patent and Trademark Office under the following registration:
USPTO Serial Number: 87977997. Registration Number: 5638057. Application Filing Date: April 26, 2017. Registration Date: December 25, 2018. International Class: 041 US Classes: 100, 101, 107. Section 8 Declaration: Accepted. Section 15 Acknowledgment: Acknowledged. First Use in Commerce: September 21, 2016
Pursuant to 15 U.S.C. §1065, this mark has achieved incontestable status, conferring the highest level of legal protection available under United States trademark law. The validity of the mark, the Center for Erotic Intelligence’s ownership, and its exclusive right to use the mark in connection with all registered goods and services cannot be challenged on most grounds.
The registered goods and services under International Class 041 cover educational services, courses, lectures, workshops, training, cultural and entertainment services, online seminars, digital publications, blogs, newsletters, articles, life coaching, and all associated educational materials in the fields of marriage, dating, relationships, sexuality, and human connection.
3. Scope of Trademark Protection
The EROTIC INTELLIGENCE® trademark, associated methodology, frameworks, concepts, and educational materials developed by Mal Harrison and the Center for Erotic Intelligence are protected under federal trademark law, copyright law, and applicable common law rights.
The following uses are strictly prohibited without explicit written licensing permission from the Center for Erotic Intelligence:
Using the name Erotic Intelligence®, any colorable imitation thereof, or any confusingly similar name in connection with educational services, coaching, workshops, courses, seminars, publications, blogs, newsletters, or any other goods or services within or related to International Class 041. Teaching, presenting, distributing, or monetizing the Erotic Intelligence® methodology, frameworks, or associated concepts in any professional, educational, commercial, or public context. Incorporating the Erotic Intelligence® name or methodology into your own professional practice, educational curriculum, coaching programs, workshops, courses, or any commercial offering. Presenting Erotic Intelligence® concepts, frameworks, or methodology as your own work in any professional or educational setting, regardless of whether attribution is provided. Using the Erotic Intelligence® name or associated content in any marketing, promotional, or commercial materials without explicit written permission.
Any unauthorized use of the EROTIC INTELLIGENCE® mark constitutes federal trademark infringement under 15 U.S.C. §1114, unfair competition under 15 U.S.C. §1125(a), and may constitute trademark dilution under 15 U.S.C. §1125(c). Violations will result in legal action seeking injunctive relief, monetary damages, disgorgement of profits, attorney’s fees, and all other remedies available under the Lanham Act and applicable law.
4. Copyright Notice
All content published in EI Insider, including but not limited to articles, essays, Field Guide Stories, newsletters, blog posts, educational materials, frameworks, methodologies, graphics, and associated materials, is protected by United States copyright law and international copyright treaties.

Unauthorized reproduction, distribution, adaptation, or commercial exploitation of any content published in EI Insider is strictly prohibited and constitutes copyright infringement under 17 U.S.C. §501, subject to statutory damages of up to $150,000 per work for willful infringement.
5. Permitted Sharing and Proper Attribution Requirements
We encourage the thoughtful sharing of ideas. Subscribers may share, quote, or reference content from EI Insider provided that all of the following attribution requirements are strictly observed:
Author’s full name: Mal Harrison. Publication name: EI Insider. Direct hyperlink to the original post. If sharing frameworks and methodologies on Erotic Intelligence, then the designation Erotic Intelligence® with the registered trademark symbol where the mark is referenced.
Proper attribution example: “Mal Harrison, EI Insider [direct link], Erotic Intelligence®”
Subscribers may share screenshots of content on social media provided proper attribution as outlined above is included. Brief quotations for purposes of commentary, criticism, or educational reference may be permitted under fair use doctrine, however such use does not extend to wholesale reproduction of articles, frameworks, or methodologies.
Sharing, reproducing, or referencing content without proper attribution constitutes both copyright infringement and potential trademark infringement and may result in legal liability.
6. Prohibited Uses
The following are strictly prohibited without explicit prior written permission from the Center for Erotic Intelligence:
Reproducing full articles, posts, newsletters, or substantial portions of any content in any format or medium, whether print, digital, or otherwise. Using the EROTIC INTELLIGENCE® name, methodology, or frameworks in professional practice, educational curricula, workshops, courses, coaching programs, or any commercial context. Sublicensing, selling, or transferring any rights to EI Insider content to any third party. Using any content published in EI Insider to train, develop, fine-tune, or improve artificial intelligence models, large language models, machine learning systems, or any automated data processing or content generation systems. This prohibition applies regardless of whether such use is commercial or non-commercial, and applies to all parties including technology companies, research institutions, and individual developers. Any commercial exploitation of EI Insider content in any form or medium.
7. Field Guide Contributor Agreement
Contributors who submit personal stories for potential publication as Field Guide Stories retain full ownership of their original creative work. Unless otherwise agreed upon, by submitting a story to EI Insider for consideration, contributors grant the Center for Erotic Intelligence a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to publish, reproduce, distribute, adapt, and display their contributed story across the following platforms and contexts:
EI Insider and its complete archive. Educational courses offered by the Center for Erotic Intelligence, whether online or in-person. Workshops, seminars, and training programs. Social media platforms and digital marketing materials. Any other educational, promotional, or media contexts at the Center for Erotic Intelligence’s sole discretion.
Contributors acknowledge and agree that identifying details including names, locations, and other personally identifiable information will be altered to protect contributor privacy unless otherwise discussed and agreed to prior to publication. Contributors represent and warrant that their submitted stories are original works and do not infringe upon the rights of any third party.
8. Medical, Mental Health, and Relational Disclaimer
The content published in EI Insider is intended solely for educational, informational, and entertainment purposes. Nothing contained in EI Insider constitutes, or should be construed as, medical advice, psychological advice, therapeutic guidance, relational counseling, or any other form of professional advice.
All content should be considered in the context of your own unique personal circumstances. Before acting upon any information, suggestions, or concepts encountered in EI Insider, you are strongly encouraged to consult with a qualified medical professional, licensed therapist, mental health practitioner, or other relevant professional.
The Center for Erotic Intelligence and Mal Harrison expressly disclaim all liability for any actions taken or not taken based upon content published in EI Insider, including but not limited to decisions or assumptions regarding medical diagnoses, mental health conditions, relational choices, sexual health decisions, or any other personal or professional matters. Your use of EI Insider content is entirely at your own risk.
9. AI Training and Automated Systems Prohibition
All content published in EI Insider, including articles, Field Guide Stories, newsletters, comments, frameworks, methodologies, and all associated materials, is expressly excluded from use in the training, fine-tuning, development, or improvement of artificial intelligence models, machine learning systems, large language models, or any automated content generation or data processing systems.
This prohibition applies to all parties without exception, including but not limited to technology companies, research institutions, academic organizations, and individual developers, regardless of whether such use is intended to be commercial or non-commercial in nature.
Any use of EI Insider content for AI training purposes constitutes copyright infringement and unauthorized use of proprietary intellectual property, and will be subject to legal action and monetary damages to the fullest extent permitted by law.
10. Licensing Inquiries
The Center for Erotic Intelligence welcomes licensing inquiries from qualified educational institutions, practitioners, and organizations seeking to incorporate Erotic Intelligence® methodology into their professional practice or educational programming. All licensing arrangements require a formal written licensing agreement executed by an authorized representative of the Center for Erotic Intelligence prior to any use.

11. Enforcement and Legal Remedies
The Center for Erotic Intelligence actively monitors and vigorously enforces its intellectual property rights. Unauthorized use of the EROTIC INTELLIGENCE® trademark, methodology, frameworks, or associated content will be pursued to the fullest extent of the law, including but not limited to:
Injunctive relief to immediately cease unauthorized use. Monetary damages including actual damages and disgorgement of profits. Statutory damages of up to $2,000,000 for willful trademark infringement under the Trademark Counterfeiting Act. Statutory damages of up to $150,000 per work for willful copyright infringement. Recovery of attorney’s fees and litigation costs. Any and all other remedies available under the Lanham Act, the Copyright Act, and applicable state law.
12. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action arising from or related to these terms shall be brought exclusively in the federal or state courts located in New York County, New York.
13. Modifications to These Terms
The Center for Erotic Intelligence reserves the right to modify these Terms of Service at any time. Modifications will be effective upon posting to EI Insider. Continued subscription to or use of EI Insider following the posting of any modifications constitutes your acceptance of the revised terms.
14. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect.
