The Supreme Court of Canada | Cour suprême du Canada has issued a landmark patent decision about the patentability of methods of medical treatment. On July 17, 2026, the Court released Pharmascience Inc. v. Janssen Inc., 2026 SCC 26. In a 7-2 decision, the majority confirmed the exclusion survives: methods of medical treatment remain unpatentable where they monopolize a physician's professional skill and judgment. But dosing regimens? Those can still be patentable, subject to certain limits.  So where is the line now drawn, and what does it mean for your patent strategy? Today in London, the Judicial Committee of the Privy Council hears a landmark appeal on the constitutionality of laws criminalizing consensual same-sex intimacy. Two litigators from our Firm, Adam Goldenberg and Grace McDonell (she/her), are representing five LGBTQIA+ advocacy organizations in the appeal Jason Jones v The Attorney General of Trinidad and Tobago. We are acting pro bono alongside Anna Hoffmann of 4 Pump Court, instructed by Enyo Law LLP. This is the first time the JCPC will be asked to determine whether provisions criminalizing consensual same-sex intimacy are compatible with the constitutional rights and freedoms guaranteed by a Caribbean constitution. The court's decision will carry binding or persuasive authority across the region and will affect the rights of LGBTQIA+ individuals. A judgment is expected in the coming months. For our Firm, this matter reflects our commitment to pro bono advocacy and to litigation that is recognized well beyond Canada. We are proud of the team advancing this work!

Litigators from our Firm will be counsel in an appeal to the Judicial Committee of the Privy Council for the first time since the 1960s. We are proud to represent five LGBTQIA+ advocacy organizations in Jason Jones v The Attorney General of Trinidad and Tobago. This appeal will be the first time the JCPC will be asked to determine whether provisions criminalizing consensual same-sex intimacy are compatible with the constitutional rights and freedoms guaranteed by a Caribbean constitution. The JCPC sits in London, UK. It is the highest court of appeal for the Crown Dependencies, the British Overseas Territories, several Commonwealth countries, and a few institutions in the United Kingdom. Permission to intervene is rare, reserved for third parties who can offer a perspective that directly assists the court. The interveners work with and represent LGBTQIA+ people, communities, and organizations across the Caribbean and wider region. Their intervention will help ensure the court hears independent submissions informed by regional experience and community insight.
